BACKGROUND: The California Integrated Waste Management Board receives an annual appropriation from the California Tire Recycling Management Fund to administer the Tire Recycling Act and related legislation. In turn, the Board has allocated funds for the Waste Tire Enforcement Grant Program. For the last nine years, the City has received grant funding to monitor businesses generating waste tires within the City. Funds allocated by the Board for the Waste Tire Enforcement Grant are for inspection, compliance and survey activities at waste tire facilities, tire dealers, and auto dismantlers. The intent of this activity is to develop and implement an effective . inspection and compliance program at the local level that will provide guidance to facility operators, and if necessary, take initial enforcement action necessary to remediate threats to public health, safety, and the environment. These activities enhance the City's current tire enforcement program and compliment enforcement actions by the State. During the current grant period, a total of 69 inspections of local tire dealers were successfully completed by the City's Environmental Projects staff. Of these inspections, it was determined that three sites had minor violations. Additionally, the California Integrated Waste Management Board has requested inspection of car dealerships (new and used) and fleets for proper storage and disposal of waste tires, adding approximately 20 more businesses to be inspected during the grant term. Currently, the City is completing enforcement and survey activities for the 2003/04 Waste Tire Enforcement Grant. The City has noticed a substantial increase in the business owners'awareness of State laws and manifesting requirements as a result of the program and a substantial decrease in the number of illegally stockpiled tires. Grant funds will be used by the City to continue local monitoring, enforcement, and education efforts for a sixth grant period. Grant funding will allow the City to continue educating and monitoring waste tire generators and haulers. The grant application is due January 14, 2005. The grant term is from June 30,2005 through June 30, 2006. FINANCIAL IMPACT: The amount requested in grant funding is $18,000.00. There are no matching funds required by the City. Of this total request, $16,170 is used to offset personnel costs within the Environmental Projects Division. The remaining $1,830 will be utilized for printing and distribution of educational materials and required training conferences and workshops. OO-{Py RESOLUTION AUTHORIZING THE MAYOR OF THE CITY OF SAN BERNARDINO OR HER DESIGNEE TO APPLY FOR AND ADMINISTER WASTE TIRE ENFORCEMENT GRANT FUNDS FROM THE CALIFORNIA INTEGRATED WASTE MANAGEMENT BOARD. WHEREAS, funds allocated are available from the California Integrated Waste Management Board for grants to solid waste Local Enforcement Agencies (LEA) and cities and counties with regulatory authority within the city and county government to perform waste tire enforcement surveys and compliance activities at waste tire facilities; and WHEREAS, the City proposes to implement a Waste Tire Enforcement Program that involves inspection and compliance activities at tire dealers, auto dismantlers, and waste tire facilities that will reduce illegal stockpiling and disposal of 14 waste tires. The City has demonstrated it has sufficient staff resources, technical 15 expertise, and experience with similar projects to carry out the proposed program; NOW, THEREFORE, BE IT RESOLVED THAT THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Authorizes the submittal of an application to the California Integrated Waste Management Board for a Waste Tire Enforcement Grant (attached hereto as Exhibit "An). The Mayor of San Bernardino, or her designee, is hereby authorized to execute in the name of the City of San Bernardino all necessary contracts, agreements, and amendments for the purposes of securing grant funds and to implement and carry out the purposes specified in the application. SECTION 2.
