Backl!round:
On October 4, 2004, the Mayor and Common Council adopted an Agreement with San Manuel Band of
Mission Indians or public improvement projects for tribal project impacts. Staff has identified the design of
street, storm drain, traffic signal and sound wall improvements along Victoria Avenue from Highland
A venue to L ynwood Avenue as a proj ect that can best be accomplished by a consultant.
With the complexity and time constraints of this project and current staffing limitations, a consultant would
have greater resources to complete the design needed in a timely manner. The consultant selected for this
project will follow the City's design standards and prepare a complete working set of specifications and
drawings ready for bidding.
Requests for Proposals (RFP) for Professional Services were sent to 16 civil and traffic engineering firms.
Four (4) firms responded to the RFP. The four (4) RFP's were reviewed and ranked by the selection
committee.
Proposals were received from the following consultant entities:

A selection committee interviewed the top three (3) ranked consultant firms. The committee consisted of:
Mark Lancaster, Deputy Director/City Engineer; Peggi Hazlett, Assist. to the Mayor/Community Liaison;
Terri Rahhal, Principal Planner; Peter Watts, representing the San Manuel Band of Mission Indians; and
Robert Eisenbeisz, Sf. Civil Engineer.
The reviewers/evaluators selected the team of Engineering Resources of Southern California based on their
qualifications, completeness of the proposal, understanding of the project, and other criteria established in
the City Council's approved evaluation criteria and rating system.

Engineering Resources of Southern California is a traffic and civil engineering, DBE firm specializing in
traffic design for freeways, streets, stations, and traffic signals for various agencies in Southern California.
Engineering Resources of Southern California has designed numerous traffic control projects of similar
scope for local municipalities and also has extensive experience in managing and inspecting the
construction of these types of projects.
The team's response to the RFP and the evaluation interview conducted by City Staff demonstrated
experience with similar projects and specific knowledge of the proposed design of street, storm drain,
traffic signal, and sound wall improvements along Victoria Avenue from Highland Avenue to Lynwood
Avenue.

RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING A
SERVICES AGREEMENT WITH ENGINEERING RESOURCES OF SOUTHERN
CALIFORNIA, INC. FOR DESIGN OF STREET, STORM DRAIN, TRAFFIC SIGNAL,
AND SOUND WALL IMPROVEMENTS ALONG VICTORIA AVENUE FROM
HIGHLAND AVENUE TO L YNWOOD A VENUE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Engineering Resources of Southern California, Inc. is competent,
experienced and able to perform the design of street, storm drain, traffic signal, and sound wall
improvements, and has provided the most advantageous and best proposal for provision of the
design of street, storm drain, traffic signal, and sound wall improvements along Victoria A venue
from Highland Avenue to Lynwood Avenue, per Agreement for Professional Services, attached
hereto and incorporated herein as Attachment A, for the not-to-exceed amount of $340,000 with
a contingency of $10,000 for a total project budget of $350,000. Pursuant to this determination,
the Purchasing Manager is hereby authorized and directed to issue Purchase Orders for said
services to said firm which reference this resolution. The Mayor is hereby authorized and
directed to execute said Agreement on behalf of the City.
SECTION 2. The authorization to execute the above referenced Agreement is rescinded
ifit is not executed within sixty (60) days of the passage of this resolution.

AGREEMENT FOR PROFESSIONAL SERVICES
(City-Funded Projects)
This AGREEMENT is made and entered into this day of
2005, by and between the CITY OF SAN BERNARDINO, California, a municipal
corporation, hereinafter referred to as the "City" and Engineering Resources of Southern
California, Inc. hereinafter referred to as "Consultant."
WITNESSETH:
A. WHEREAS, City has need for Civil/Traffic Engineering Services; and,
B. WHEREAS, Consultant is competent, experienced and able to perform
said services; and,
C. WHEREAS, Consultant has provided the most advantageous and best
proposal for the provision of such services;
NOW THEREFORE, the parties hereto agree as follows:
1. SCOPE OF SERVICES
Consultant shall perform those services specified in the Request for Proposal
(RFP), dated November 23, 2004, to provide Civil/Traffic Engineering Services
for the design of street, storm drain, traffic signal and sound wall improvements
along Victoria Avenue from Highland Avenue to Lynwood Avenue, attached and
incorporated herein as Attachments B, C, & D.
2. TERM OF AGREEMENT
The services of Consultant are to commence after the City has authorized work to
start by issuance of a Notice to Proceed. This Agreement shall expire one year
from the date of this Agreement, unless extended by written agreement of the
parties.
3. STANDARD OF PERFORMANCE
Consultant shall complete all work product and design in conformance with City
of San Bernardino Standard Specifications and Standard Drawings.
4. CHANGES/EXTRA SERVICES
A. Performance of the work specified in the Proposal is made an obligation of
Consultant under this Agreement, subject to any changes made
subsequently upon mutual written agreement of the parties. Any change,
which has not been so incorporated, shall not be binding on either party.

5. COMPENSATION
A. The City shall reimburse the Consultant for actual costs (including labor
costs, employee benefits, overhead, profit, other direct and indirect costs)
incurred by the Consultant in performance of the work, in an amount not
to exceed $340,000, except that reimbursement shall not include courier
services, mileage or reimbursement for travel to the City to attend
meetings or conduct the activities. Actual costs shall not exceed the
estimated wage rates and other costs as set forth in the Proposal.
B. Said compensation shall not be altered unless there is significant alteration
in the scope, complexity or character of the work to be performed.
Any adjustment of the total cost of services will only be permitted when
the Consultant establishes and City has agreed, in writing, that there has
been, or is to be, a significant change.
C. The Consultant is required to comply with all Federal, State and local laws
and ordinances applicable to the work.
6. PAYMENT BY CITY
A. The billings for all services rendered pursuant to this Agreement shall be
submitted monthly by Consultant to City and shall be paid by City within
thirty (30) days after receipt of same, excepting any amounts disputed by
City. City retains the right to challenge all or any part of an invoice. All
tasks as specified in Proposal shall be completed prior to final payment.
7. SUPERVISION AND ACCEPTANCE OF SERVICES
A. The Director of Development Services of City or his designee, shall have
the right of general supervision over all work performed by Consultant
and shall be City's agent with respect to obtaining Consultant's
compliance hereunder. No payment for any services rendered under this
Agreement shall be made without prior approval of the Director of
Development Services or his designee.

8. COMPLIANCE WITH CIVIL RIGHTS LAWS AND AMERICANS WITH
DISABILITIES ACT
Consultant hereby certifies that it will not discriminate against any employee or
applicant for employment because of race, color, religion, sex, age, marital status,
national origin or disability. Consultant's hiring practices and employee policies
shall comply with applicable Federal, State and local laws. Such action shall
include, but not be limited to, the following: Recruitment and recruitment
advertising, employment, upgrading and promotion.
9. TERMINATION OF AGREEMENT
A. This Agreement may be terminated by either party upon thirty (30) days
written notice in the event of substantial failure of the other party to
perform in accordance with the terms of this Agreement. Each party shall
have twenty (20) days following date of such notice within which to
correct the substantial failure giving rise to such notice. Consultant hereby
covenants and agrees that upon termination of this Agreement for any
reason, Consultant will preserve and make immediately available to City,
or its designated representatives, maps, notes, correspondence, or records
related to work paid for by the City and required for its timely completion,
and to fully cooperate with City so that the work to be accomplished may
continue. Any subsequent use of such incomplete documents shall be at
the sole risk of the City and City agrees to hold harmless and indemnify
Consultant from any claim, losses, costs, including attorney's fees, and
liability arising out of such use.
B. This Agreement may be terminated for the convenience of the City upon
thirty (30) days written notice to Consultant. Upon such notice,
Consultant shall provide work product to City and City shall compensate
Consultant in the manner set forth above.
C. Following the effective date of termination of the Agreement pursuant to
this Section, the Agreement shall continue until all obligations arising
from such termination are satisfied.
10. CONTINGENCIES
In the event that, due to causes beyond the control of and without the fault or
negligence of Consultant, Consultant fails to meet any of its obligations under this
Agreement, and such failure shall not constitute a default in performance, the City
may grant to Consultant such extensions of time and make other arrangements or
additions, excepting any increase in payment, as may be reasonable under the

circumstances. Increases in payment shall be made only under the "Changes"
provision of the Agreement.
II. INDEPENDENT CONTRACTOR
Consultant shall act as an independent contractor in the performance of the
services provided for under this Agreement. Consultant shall furnish such
services in its own manner and in no respect shall it be considered an agent or
employee of the City.
12. ASSIGNMENT OR SUBCONTRACTING
Neither this Agreement, nor any portion thereof, may be assigned by Consultant
without the written consent of City. Any attempt by Consultant to assign or
subcontract any performance of this Agreement without the written consent of the
City shall be null and void and shall constitute a breach of this Agreement.
13. NOTICES
All official notices relative to this Agreement shall be in writing and addressed to

14. RESPONSIBILITIES OF PARTIES
Upon termination, or completion of all work under this Agreement, Consultant
will transfer ownership and title to City of all programs, reports, documents, plans
and specifications.
15. INDEMNITY
Consultant shall indemnify, defend and hold CITY, its officers, employees and
agents harmless from and against any and all claims, demands, suits, actions,
proceedings, judgments, losses, damages, injuries, penalties, costs, expenses
(including attorney's fees) and liabilities, of, by, or with respect to third parties,
which arise from Consultant's negligent performance of services under this
Agreement. Consultant shall not be responsible for, and City shall indemnify,
defend and hold harmless Consultant from and against, any and all claims,

demands, suits, actions, proceedings, judgments, losses, damages, injuries,
penalties, costs, expenses (including attorneys' fees) and liabilities of, by or with
respect to third parties, which arise from the City's negligence. With respect to
any and all claims, demands, suits, actions, proceedings, judgments, losses,
damages, injuries, penalties, costs, expenses (including attorneys' fees) and
liabilities of, by or with respect to third parties, which arise from the joint or
concurrent negligence of Consultant and City, each party shall assume
responsibility in proportion to the degree of its respective fault.
16. LIABILITYIINSURANCE
Consultant shall maintain insurance policies meeting the minimum requirements
set forth herein. All insurance maintained by the Consultant shall be provided by
insurers satisfactory to the City. Certificates evidencing all insurance coverage
required herein shall be delivered to the City prior to the Consultant performing
any of the services under the Agreement. All insurance certificates required
herein shall name the City as an additional insured and provide for thirty (30)
days written notice from the insurer to the City prior to cancellation of any
insurance policy of the Consultant.
A. ERRORS & OMISSIONS - The Consultant shall maintain errors and
omissions insurance with a combined single limit of not less than One
Million Dollars ($1,000,000.00) per occurrence.
B. COMPREHENSIVE GENERAL LIABILITY AND AUTOMOBILE
INSURANCE - The Consultant shall maintain comprehensive general
liability and automobile liability insurance with a combined single limit of
not less than One Million Dollars ($1,000,000.00) per occurrence.
C. WORKER'S COMPENSATION INSURANCE - The Consultant shall
maintain worker's compensation insurance in accordance with the laws of
the State of California for all workers employed by the Consultant.
17. VALIDITY
Should any provision herein be found or deemed to be invalid, this Agreement
shall be construed as not containing such provision, and all other provisions
which are otherwise lawful shall remain in full force and effect, and to this end
the provisions of this Agreement are declared to be severable.

18. ENTIRE AGREEMENT
III
This Agreement represents the entire and integrated understanding between the
parties hereto and supersedes all prior and contemporaneous negotiations,
representations, understandings and Agreements, whether written or oral, with
respect to the subject matter thereof. This Agreement may be amended only by
written instrument signed by both parties.

TO

FOR
THE DESIGN OF STREET, STORM DRAIN, TRAFFIC SIGNAL, AND
SOUND WALL IMPROVEMENTS ALONG VICTORIA AVENUE FROM
HIGHLAND AVENUE TO L YNWOOD DRIVE

I. INTRODUCTION
The City of San Bernardino (City) intends to engage the services of a consulting engineering
firm (Consultant) to provide environmental documents and construction documents, including
plans, specifications, and estimate of costs (PS&E) for street improvements (including street
lighting), storm drain, traffic signal and sound walls along Victoria Avenue from Highland
Avenue to Lynwood Drive.
II. PROJECT DESCRIPTION
Victoria Avenue is to be widened to provide four (4) travel lanes, two (2) lanes in each
direction, separated by a 12-foot wide, landscaped median. Left turn access (median breaks)
will only be provided at the Citrus Street and Mirada Road intersections. The Lynwood Drive
intersection is to be modified to provide limited access (right turns only for eastbound traffic)
at Victoria Avenue. A second left turn lane is to be added for eastbound traffic, and an
exclusive right turn lane at the Highland Avenue intersection for southbound traffic is to be
added.
Existing storm drain facilities are to be modified or relocated to accommodate the proposed
widening of Victoria Avenue, including, but not limited to the channel crossing/culvert
located at 28th Street, the 24" RCP culvert crossing located north of the Patton State Hospital
(PSH) entry (Date Street), and the 18" RCP catch basins connector pipe located south of the
PSH entry.
Sound walls are to be constructed along both sides of Victoria Avenue. A sound wall is to be
constructed along the east edge of Victoria Avenue between the north side ofPSH and the San
Manuel Indian Reservation/City boundary. A sound wall is to be constructed along the west
side of Victoria Avenue between the northerly of the existing flood control basin property
(across from PSH) to Lynwood Drive. A sound wall is to be constructed along the south side
of Lynwood Drive between Victoria Avenue and the existing drainage channel property.
A new Traffic signal is to be installed at the Lynwood Drive intersection and the existing
traffic signal at Highland A venue is to be modified to accommodate the street widening on
Victoria Avenue and Highland A venue to provide two (2) left turn lanes for eastbound traffic
and an exclusive right turn lane for southbound traffic.
III. SCOPE OF SERVICES
ENVIRONMENTAL DOCUMENTS/COMMUNITY MEETINGS
1. The Consultant shall prepare the necessary documents to satisfy CEQA requirements for
the project and provide related support services from initial application through project
approval, including appropriate response to comments received during public review.

2. The Consultant shall facilitate and conduct community meetings to provide a public
presentation of the project, identifying anticipated impacts, proposed mitigation measures,
and responses to public comments.
IMPROVEMENT PLANS
3. Consultant shall provide preliminary engineering to analyze the proposed improvements
and develop conceptual alignment alternatives, identifying right-of-way deficiencies,
estimated construction costs and estimated schedule for completion for each alternative.
Consultant shall meet and confer with the City to review the alternatives and present
selection recommendations. The City shall select the best alternative based upon the
Consultant's recommendations, consistent with the project objectives, and considering
overall project cost and completion timing
4. Consultant shall develop a phasing plan to implement construction of the selected
alignment alternative selected by the City. The City desires to begin sound wall
construction and right-of-way acquisition early. Long lead items, such as utility relocation,
should also be included in the initial phase.
5. Consultant shall provide final engineering to prepare all required construction documents,
including plans, specifications, and cost estimates for the construction of street, storm
drain, traffic signal, and sound wall improvements associated with this project.
6. Consultant shall provide landscape and irrigation plans for the landscape areas within the
public right-of-way on Lynwood Drive and Victoria Avenue, including medians and
parkways.
7. Consultant shall prepare legal descriptions (including plats) for all right-of-way
acquisition required for completion of the street, storm drain, traffic signal, and sound wall
improvements, including any required temporary construction easements.
8. Consultant shall conduct utility research and identify the location and depth of all existing
underground utilities within the limits of the proposed improvements. Consultant shall be
responsible for identifying and resolving conflicting utilities, both overhead and
underground. Copies of all written communication (including maps) between the
consultant and utility companies shall be provided to the City.
9. Consultant shall coordinate with utility companies to identify and initiate any required
utility relocation work as soon as possible. Consultant shall monitor the progress of utility
relocation and provide regular status reports to the City regarding progress on this activity.
Consultant shall prepare all required utility service applications, including but not limited
to landscape water service and traffic signal electrical service.
10. Consultant shall coordinate with all other affected agencies having jurisdiction within or
adjacent to the limits of the proposed improvements, including but not limited to the City
of Highland and San Bernardino County Flood Control District (SBCFCD), State of
California (Patton) and Caltrans. Consultant shall prepare permit applications and other
documents required by other affected agencies.

11. Consultant shall prepare all required construction documents (PS&E) in conformance with
City of San Bernardino standards and applicable SBCFCD standards, Caltrans standards,
and the requirements of the Manual on Uniform Traffic Control Devices (MUTCD) and
California Supplement, latest editions. Additionally, the consultant shall prepare all plans,
specifications, and estimates in conformance with the following design requirements:
a) All construction plans shall be prepared on standard 24" by 36" sheets, using the City
of San Bernardino standard title block.
b) Plans shall be prepared to clearly show existing conditions, including but not limited
to, the location and type of existing signal poles, signal equipment, loop detectors,
signing and striping, pavement markings, street improvements, drainage facilities, and
right-of-way/property lines.
c) All plans shall clearly show the size, type and location of all existing utilities within
the limits of proposed improvements, including, but not limited to sewer, water, storm
drain, electrical, telephone, cable television, and gas facilities.
d) Consultant shall be responsible for survey, research and other data needed to establish
and document existing conditions, including existing right-of-way.
e) Plans shall clearly show the location and type of the proposed improvements,
including but not limited to, the type and location of signal poles, loop detectors,
wiring, signing and striping, pavement markings, curb markings, parking spaces, street
improvements, and drainage improvements.
f) All signal plans shall include conductor schedules and pole schedules that clearly
specify the types and locations of all signal poles including, but not limited to signal
and luminaire mast arm lengths; the types, locations, and attachments of pedestrian
and vehicle displays; locations of pedestrian push buttons; and street name signs.
g) All signal plans shall include phasing diagrams that reflect phase sequences adhering
to National Electrical Manufacturers Association (NEMA) phasing standards.
h) All signal plans shall clearly indicate the type and location of existing and proposed
signing and striping, including but not limited to lane striping, stop bars, crosswalks,
pavement markings, and any other traffic control devices.
i) All sidewalks and curb ramps shall be designed in compliance and accordance with the
latest Americans with Disabilities Act (ADA) requirements.
j) The plans, specifications and cost estimates shall be signed and sealed by a civil
engineer, licensed to practice civil engineering in the State of California. Legal
descriptions and plats shall be signed and sealed by a civil engineer or land surveyor,
licensed to practice surveying in the State of California.

12. Consultant shall conduct the necessary research to determine the existing public right-of-
way and identify any additional right-of-way that must be acquired to construct the subject
improvements. Where right-of-way acquisition is required, the consultant shall prepare the
appropriate legal descriptions and plats describing the property to be acquired.
13. Consultant shall identify any additional improvements that are required to construct the
desired improvements. Additional improvements may include but not be limited to curb
and gutter, drainage improvements, storm drains, street widening, curbs, curb ramps, and
channelization. If additional improvements are required, consultant shall include the
design of those improvements in the scope of the proposal to incorporate them into the
plans, specifications and cost estimates.
14. Consultant shall submit an updated project schedule within 2 weeks of receiving a notice
to proceed, indicating the design tasks and project timing from start to submittal of final
PS&E for each location. Consultant shall provide an updated schedule showing progress
and timing every two (2) weeks.
IV. PROPOSAL REQUIREMENTS
A. Six (6) copies of the proposal shall be submitted to the following:

Proposals shall be received in hand by this Division up to the hour of 5:30 P.M. on
Wednesday. December 15. 2004.
B. Responsive proposals will include, but not be limited to, the following:
1. Responsive proposals will present a Scope of Services that includes at a
minimum the above described services and any other tasks necessary to
achieve completion of design (PS&E) needed for the successful construction of
the proposed improvements.
2. Identify the professional, technical and support staff that will be performing the
work associated with the proposed scope of services. Short resumes may be
included, but extensive resumes should be limited to key personnel only.
3. Include a timeline indicating project milestones, including the delivery of final
plans, specifications, and cost estimates ready for public bid. The proposal
should provide a flow chart showing project tasks and timing.

4. Include a list of similar projects recently completed by the Consultant,
identifying the location, date, agency and contact person name, address and
phone number.
5. Previous obligations with other projects (related to time and availability of
staff) .
6. Name of sub-consultants to be used for specific aspects of the project,
including a summary of previous working arrangements on similar types of
work.
7. Statement of local preference eligibility, including identification of any office
located in the City of San Bernardino and the number of employees stationed at
the office, the number of employees doing business inside the City limits, and a
copy of your firm's City of San Bernardino Business License. The proposal
should state which individuals that will be working on this project are actually
stationed in the local office.
8. Items, actions or information the Consultant expects to be provided by the
City.
9. Any comments or suggestion that the Consultant believes necessary to improve
the finished project or to comply with the requirements ofthis RFP.
10. Separate sealed envelope. Fixed fee or noHo-exceed fee for the work
required by this RFP, together with an hourly rate sheet applicable to this
project, including all materials and expenses, shall be submitted in a separate
sealed envelope.
Please note that the City will not payor compensate for travel time, courier
services, mileage or reimbursement for travel to or from the City of San
Bernardino to attend meetings or conduct the activities necessary to complete
tasks required as part of subject consultant services.
V. SELECTION PROCESS
The selection process will be based on a point system and will consist of three phases as
follows:
1. First phase selection shall consist of an evaluation by staff (including the Development
Services Director, City Engineer, a Senior Engineer and Project Manager) of proposals
based on the above items identified in Section III B (except No. 10). An additional
five (5) points will be given to City of San Bernardino based consultants. In order to
be deemed as "City of San Bernardino Based Consultant, the company shall have an
office with a minimum of one (1) owner or employee doing business inside the City
limits and shall possess a City Business License. The three (3) consultants with the
highest points will continue to the interviews. A maximum of 100 points can be
achieved in this phase of the selection process. The three consultants with the highest

numerical scores will be invited to continue with the second phase of the selection
process.
2. Second phase of the selection process will consist of staff evaluation of a presentation
by the three consultants with the highest numerical score from the first phase selection.
The interview will be detailed questions on this specific project, including, but not
limited to, personnel, schedule, project staging, and knowledge of the project. Five (5)
points of local preference will also be awarded in this phase of the selection process
for Consultants that meet the requirements identified in paragraph 1 above. A
maximum of 100 points can be achieved in this phase of the selection process.
3. The third and final phase of the selection process will consist of staff submitting a final
package to the Mayor and Council for consideration approval. Final scores of the top
three consultants will be submitted to the Mayor and Common Council with a
recommendation to award an Agreement for Professional Services to the consultant
with the highest numerical score. However, the Mayor and Common Council have the
prerogative to award an Agreement for Professional Services to any of the top three
consultants or reject all proposals.
4. If the Mayor and Common Council award an Agreement for Professional Services, the
selected consultant will be requested to execute an Agreement for Professional
Services (draft copy attached). Failure of the consultant to execute the Agreement
within 60 days of approval by the Mayor and Common Council will void the approval.
VI. GENERAL
This "Request for Proposal" does not commit the City to award a contract, pay any costs
incurred in the preparation of a proposal in response to this request, procure or contract for
any services. All proposals submitted in response to this request will become the property of
the City and may be used by the City in any way deemed appropriate. The City reserves the
right to accept or to reject, in part or in its entirety, the response to the request for proposal if
such action is deemed to be in the best interest of the City.
Any contract entered into as a result of this proposal shall be considered to include the items
of work detailed in this proposal unless specifically deleted in the proposal at the request of
the City.
VII. PAYMENT
The Consultant that is recommended by Staff and approved by Mayor and Common Council
shall attend the pre-design meeting to establish the start date. Once the Notice to Proceed has
been given, the Consultant can submit for payments. The City will release funds at
percentages with receipt of Plans, Notices, or Specifications. No payment shall be given
above the percentage of completed work accepted by the City. The City shall hold 15% of the
total cost for 360 calendar days after acceptance of plans and specifications by the City, or 45
calendar days after the City issues a Notice of Completion for the project, whichever occurs
first.

LIABILITY / INSURANCE
REQillREMENTS
Engineer shall maintain insurance policies meeting the minimum requirements set
forth herein. All insurance maintained by the Engineer shall be provided ,by insurers
satisfactory to the City. Certificates evidencing all insurance coverage required herein
shall be delivered to the City prior to the Engineer performing any of the services
under the Agreement. All insurance certificates required herein shall name the City as
an additional insured and provide for thirty (30) days written notice from the insurer to
the City prior to cancellation of any insurance policy of the Engineer.
A. ERRORS & OMISSIONS - The Engineer shall maintain errors and
omissions insurance with a combined single limit of not less than One
Million Dollars ($1,000,000.00) per occurrence.
B. COMPREHENSIVE GENERAL LIABILITY AND AUTOMOBILE
INSURANCE - The Engineer shall maintain comprehensive general
liability and automobile liability insurance with a combined single limit of
not less than One Million Dollars ($1,000,000.00) per occurrence.
c. WORKER'S COMPENSATION INSURANCE - The Engineer shall
maintain worker's compensation insurance in accordance with the laws of
the State of California for all workers employees by the Engineer.

Gentlemen:
Engineering Resources of Southern California, Inc. (ERSC) proposes to complete the planning
and design services as outlined in the accompanying proposal concerning the Victoria Avenue
improvements for the City for a lump sum amount of $285,230.
Proposed lump sum fee excludes preparation of legal descriptions and plats for permanent
acquisition of rights-of-way or temporary construction easements. Since the extent is very
uncertain, involving perhaps:l: fifty (SO) parcels, we propose to prepare such documents for an
amount of $750 per parcel which would include both a permanent take and temporary
construction easement for a parcel.
Proposed fee does not include preparation of a work area traffic control plan by Katz, Okitsu and
Associates. If desired, fee would be $17,500.
Additional services will be conducted in accordance with the enclosed Schedule of Hourly Fees
and those of our subconsultants, subject to a mark-up of 15 percent. This fee proposal does not
include any allowance for our current contract and compensation with the City of Highland for
modifications to the intersection of Victoria and Highland under the City's grant.

SECTION 1
PROJECT OVERVIEW AND SCOPE OF SERVICES
A. PROJECT SYNOPSIS
Victoria A venue in the City of San Bernardino north of Highland Avenue is a heavily-traveled
access to and from the San Manuel Indian Casino. A new and larger casino is to open in mid-
January which very likely will increase the already heavy traffic to the site consisting of cars,
many buses, and delivery and maintenance vehicles. Access to Victoria Avenue is from
Highland Avenue which, in the vicinity of Victoria Avenue, is wholly or partially within the City
limits of the City of Highland.
To provide for a safer passage, a more attractive entrance, and to allay issues concerning the
neighbors, the City is proposing to construct significant improvements to the reach of Victoria
Avenue from Highland north to the Indian Reservation/City boundary. As contained in the
City's RFP and per additional expressions of City staff, the Victoria Avenue improvement
project will include the following features.
. Widen Victoria to four travel lanes, two each way, separated by a l2-foot
landscaped raised median; median breaks will be provided only at Citrus Street
and Mirada Road intersections.
. There is, however, to be no right-of-way acquisition from residential parcels.
. Modifications are to be made to the intersection ofLynwood Drive to allow
eastbound traffic right-turn only to Victoria A venue south. Additionally, the
intersection is to be signalized.

Add a second left-turn lane to eastbound Highland Avenue for access to
northbound Victoria.

. Construct an exclusive southbound right-turn lane on Victoria Avenue to access
westbound Highland Avenue.
. Modify existing traffic signals at Highland A venue to accommodate the street
widening and two eastbound left-turn lanes, and a southbound exclusive right-turn
lane on Victoria Avenue.
. Construct new traffic signals at Lynwood Drive intersection.
. Modify or relocate existing storm drain facilities for the proposed widening of
Victoria A venue. These will include channel/culvert crossings located north of
28th Street, a 24-inch RCP culvert crossing north of the Patton State Hospital
(PSH) entry at Date Street, and a IS-inch RCP catch basin collector pipe located
south of the PSH Date Street entry.

. Construct sound walls on both sides of Victoria Avenue - on the east side from
PSH to the Indian Reservation/City boundary, and on the west side from the San
Bernardino County Flood Control District (FCD) property to Lynwood Drive and
extending on the south side ofLynwood Drive to FCD drainage right-of-way.
Funding for the project has been indicated to be from funds that the City has received from
negotiated settlement with the San Manuel Indian Tribe and can be used on the entire project
area. Of note, the City of Highland had a grant available which can be utilized only for upgrade
of the portions of the Victoria A venue and HigWand Avenue intersection within its boundaries
which includes all except the northeast comer.
B. PROJECT SITE OBSERVATIONS AND RELATED ADDITIONAL SERVICES
In addition to the facilities and features and the implied impacts and services from the City's
RFP, site inspection, observation, research, and contact with City staff indicates that the
following additional project requirements and design services to be necessary.

Curb and gutter exists on both sides of Victoria Avenue. Located at a consistent
distance from centerline on the west, the east side curb is considerably narrowed
at the PSH frontage. Behind the curb for most of the street is a three-foot,
stamped, brick-red concrete with trees, adjoining the sidewalk in a 12-foot
parkway. Block wall borders residential development. Existing street is located
within right-of-way which varies from 82.5 to 88 feet in width and also varies
from two lanes near Highland to four lanes north of PSH. Since there is to be no
right-of-way acquisition in the residential areas, widening in these areas will
impact the existing parkway width, as well as curb and gutter, landscaped strip,
the sidewalk, and curb returns at five locations. Construction of sound walls in
the residential areas will result in replacement of existing perimeter wall or
construction adjacent to stay in existing right-of-way. Caissons may be necessary
to stabilize the wall.
To aid in better mitigating traffic sound travel, sound measurements will be made
on Victoria Avenue and evaluation and recommendations by an acoustical
consultant.
.
There are existing overhead power lines along the west side of Victoria Avenue
from Highland Avenue northerly along the FCD frontage, extending beyond 28th
Street. Street lights are also found in the stamped concrete area.
.
In addition to the drainage facilities mentioned in the City's RFP, site inspection
revealed the existence of an open concrete drainage channel behind and adjacent
to the PSH fence on the east side of Victoria A venue. Conversation with the Plant
Operations Superintendent for PSH indicates that this channel conveys storm
runoff and also possibly overflow from PSH reservoir and onsite wells. There is

also a catch basin on the southwest comer of 28th Street which may be an
additional feature.
A considerable area of drainage to the north side of PSH from Orange Street on
the east is picked up, it is believed, by the channel crossing of Victoria Avenue
north of 28th Street on the north boundary of PSH. Research of City records
indicates that the channel transitions to a 42-inch CSP which underlies the
existing west side sidewalk, picks up drainage from the 28th Street catch basin,
and presumably discharges to the FCD detention basin. Street widening,
therefore, could affect this drainage channel and require modifications, also.
Design of median and parkway landscaping needs and will be done to achieve an
overall balance and effect. Additionally, consideration will be given to seek
retention of rainfall and excess irrigation within the landscaped portion to prevent
runoff of nutrients. Maintenance aspects of plants and irrigation method will be
coordinated with the City staff.

The existing signals at Citrus Street will also be impacted by proposed widening
of Victoria Avenue and require upgrade.
.
Concerning the Highland A venueNictoria Avenue intersection:
~
To effect the proposed exclusive southbound right-turn lane on Victoria
A venue to Highland may impact the existing apartments as well as the
corner mini-mart/service station. Ideally, storage lane needed to
accommodate turn traffic may be as long as 300 to 350 feet for a 45-mph
zone. Overhead power line and pole are also impacted by the proposal.
To widen this area, that is, the west side of Victoria, right-of-way take
would cause a major dislocation or necessary acquisition of the mini-
mart/service station. In ERSC's current work with the City of Highland
for this proposal, the property take has been appraised in excess of
$1,000,000.
Alternatively, moving to the east would require obtaining right-of-way
from the Indian parking lot frontage that may necessitate a misalignment
of Victoria Avenue north vs. that to the south of Highland Avenue.

To achieve the second left-turn lane on eastbound Highland Avenue will
impact right-of-way either at the mini-mart/service station to the north or
on existing residential properties on the south side or both. Currently,
there is no sidewalk on either side for this reach from the FCD property on
the north side or from Robinson Road on the south side to Victoria
Avenue. Adjacent residential property on the south side of Highland is
fenced, but with no finished street improvements, however. Relocation of

the power pole(s) and a gas vault will be required together with right-of-
way acquisition.
. Concerning the left-turn lanes on eastbound Highland, we would consider
a signal schedule to designate an additional proposed left-turn lane at
Highland Avenue and Victoria Avenue as a left-turn and through lane
during peak hours.
. It is our understanding that the San Manuel Indians had a detailed traffic
study completed recently. With the opening of the new casino, traffic
counts at the intersection should be updated. We, therefore, propose to
gather this information at peak traffic volumes to include turning
movements to provide current information to aid in design of storage for
left and right-turn lanes and for signal operation.
C. ERSC RELATED CONTRACT
ERSC is currently under contract with the City of Highland for design of modifications to the
intersection of Victoria Avenue and Highland A venue. With grant funding, the City is seeking to
construct a right-turn lane on southbound Victoria A venue, widening of westbound Highland
A venue and related signal modifications. ERSC staff has developed a number of alternatives to
achieve the City of Highland's objectives together with right-of-way impacts. Appraisal by the
County has put a high value on the service station/mini-mart on the northwest corner. Extension
of an exclusive right-turn lane on Victoria A venue will be hampered by limited parking for the
existing apartment just to the north.
Addition of a second left-turn lane for eastbound Highland A venue may require purchase of the
two residences east of Robinson Road and modifications to parking for an existing insurance
office.
D. SCOPE OF ENGINEERING SERVICES

In response to the needs of the project, the City's expressed requirements and with the benefit of
completion of many similar projects, ERSC has developed and presents the proposed approach
and scope of services to the Victoria A venue proj eel. Contained in this section is a description of
the overall services with engineering services to be conducted by ERSC presented in detail.
Proposed service proposals by our several subconsultants are contained in subsequent sections.
Services, then, proposed to be conducted by the ERSC project team to effect preparation of
contract documents needed and requested by the City, will include, then, the following major
task categories.
1. Environmental documents and related efforts will be conducted by the firm of
Tom Dodson and Associates. In general, their efforts will be directed to the

preparation of documents and processes necessary to satisfy CEQA requirements
for the project and provide the support services through project consideration
including necessary community meetings and identification of anticipated impacts
and proposed mitigation measures. A detailed proposal from Tom Dodson and
Associates of all the proposed tasks and detail is contained at Section 6.
Sound measurements and evaluations/recommendations will be made by the firm
of Hans Giroux and Associates. The firm's proposal is also contained in Section
6.
2. Street widening and related work will be conducted by ERSC, details presented
subsequently.
3. Median and parkway landscape and irrigation will be completed by the firm of
Purkiss Rose-RSI. Their detailed proposal is contained at Section 7. In general,
efforts will involve and include planning and advising concerning the overall
concept for the Victoria Avenue corridor as well as the Lynwood Drive portion,
suggestions concerning the mix and overall appearance and balance of the
landscape as well as design.
4. Design of signal modifications for the Victoria/Highland intersection and the new
signals at Lynwood Drive, related signing and striping, street lights will be
conducted by the firm of Katz, Okitsu and Associates, including application for
electric service. A work area traffic control plan can also be prepared at
additional cost if desired. Their detailed proposal is contained at Section 8.
An additional task or effort which we propose to conduct is the collection and
analysis oftraffic counts at the intersection of Victoria and Highland in order to
provide greater and more accurate information in design of signal operation and
turn lanes. This effort will be conducted by the firm of Counts Unlimited,
following opening of the new casino.

ERSC's efforts concerning design for the widening of Victoria A venue will include survey and
mapping, analysis of alternatives and, following selection, preparation of contract documents to
facilitate bidding and construction of street widening features of the project. Specific services,
tasks, and our general approach to the project will be as outlined in the following task
descriptions.
1. Kick-off planning and research meeting with the City staff involving key members
of the ERSC project team to confirm scope, project approach, design standards,
limits of work, schedule of service, review submittal requirements, and meetings
calendar. This would advantageously, we believe, include a field inspection trip
. to discuss and finalize planning and guidelines.

2. Conduct field surveys and aerial photography and topo mapping of the route with
field survey to include cross-sections, location of surface features which may not
show up in the aerial photo, as well as survey of evidence of all subsurface
utilities including drain and sewer inverts.
3. With the information obtained from the aerial topo mapping, ERSCwill then
prepare base topo maps at a scale of 1" = 40' or other scale for use in planning and
design for street improvements, signals, and landscaping. Information additional
to that shown in the aerial photo and obtained by on-the-ground field surveys, or
utilities research will be added.
4. Research records related to the project including that of utilities, existing street
improvements, and property ownership. This information will be added to the
base topo maps so that a clear and complete picture of all data which may impact
design is available.
5. Undertake and complete preliminary design and analyses of means of achieving
the City's objective for the widening of Victoria Avenue and Highland Avenue.
These efforts will include development of conceptual alignment alternatives,
identification of right-of-way impacts or deficiencies, identification of utility
impact or relocations that may be required, as well as estimated construction costs
and schedules for each alternative. During the conduct of this effort, ERSC's
Project Manager will maintain coordination and communication with the City
concerning progress and issues, and the Project Manager, together with key team
members, will meet and confer with the City as required to aid our analyses.
6. At the conclusion of planning and alternative analyses, project team members will
conduct a review meeting with the City to present our findings and
recommendations and to effect an alternative selection by the City.
7. ERSC will then prepare a phasing plan to reflect the City's construction priorities,
that is, sound wall construction, right-of-way acquisition, and utility relocation in
an initial phase. For areas in which right-of-way acquisition may be required and
ERSC will provide right-of-way acquisition documents. These will consist of
legal descriptions and plats necessary for all proposed improvements.
Additionally, we will prepare temporary construction easement documents where
required for that phase of the work.
8. Following preliminary planning and identification and selection of preferred
alternative, and with the use of utility records obtained per Item No.4, ERSC will
research and identify from available records, the location and depth of all existing
underground utilities within the limits of proposed improvements, as well as
. overhead utilities. We will identify underground and overhead utilities which will
conflict with proposed improvements and coordinate with utility companies to
initiate and effect required utility relocation work. ERSC's effort will encompass

13. Submittals at agreed upon completion stages or milestones will be made by ERSC
and subconsultants, and review meetings scheduled to receive City's input.
14. ERSC design staff will be available to respond to questions and issue
clarifications during the bid period.

estimates of the time required for the various tasks. Necessarily, some of the tasks, particularly

Subject: Victoria Avenue Street Improvements
Dear John:
Thank you for asking Tom Dodson & Associates (TDA) to submit this proposal to assist Engineering
Resources of Southern California (ERSC) with this project. It is our understanding that the City of San
Bernardino is proposing to construct a variety of road and infrastructure improvements associated with the
widening of Victoria Avenue from Highland Avenue to the boundary of the San Manuel reservation land.
Additionally, some improvements will be constructed on Highland Avenue.
The City's decision to construct and operate this project is considered a project under the California
Environmental Quality Act (CEQA) and State CEQA Guidelines Section 15378. Thus, to comply with
CEQA the City must consider the potential for adverse environmental impacts to result from implementing
this project. The first step in this evaluation is the preparation of an Initial Study. The Initial Study will focus
on those activities and components of the proposed project that can cause physical change to the existing
environment if the project is approved and implemented. The following scope of work outlines the work
effort that TDA proposes to meet the City's objective for this project. Fee proposal under separate cover.
Scope of Work
Task 1: Preoare Proiect Descriotion
~
Working with ERSC and City staff, TDA will prepare a project description for the proposed project. We
anticipate three meetings to obtain data and clarify the project and thereafter, finalize the project
description. TDA will submit a draft of the project description for review and comments to ERSC and the
City within 2 weeks of receipt of all needed data.
Task 2: Preoare Technical Assessments
The project is located within the existing right-of-way of Victoria and Highland avenues. It is our
understanding that the project will not affect land that has not been previously disturbed by previous
development. This proposal assumes that all technical studies (geotechnical investigations, drainage
studies, traffic studies, etc.) will be provided by ERSC or the City.
Using technical data supplied, TDA will prepare the Initial Study using the City's CEQA Guidelines checklist
format. Substantiation for all conclusions reached will be provided in the document. Mitigation measures
will be provided where necessary to reduce potential project-related impacts to the greatest extent feasible.

TDA will provide ERSC and the City with a screencheck draft of the completed Initial Study for review and
comment within 5 weeks of receipt of needed data. Agreed upon revisions to the Initial Study will be made
and the document will be circulated for public review and comment. This includes assisting the City with
the posting of a Notice of Intent to Adopt a Negative Declaration, a Notice of Availability, and a Notice of
Completion. The public review and comment period will be a minimum of 30 days to allow circulation to
the State Clearinghouse.
Task 3: Process the Neaative Declaration and Issue the Notice of Determination
Unless some issue(s) which is/are not known at this time arise, we feel a Mitigated Negative Declaraiton
(MND) will be the appropriate environmental determination for the project. TDA will assist the City with
preparation of responses to any comments received during the public review period. TDA will also assist
the City with preparation and processing of the Mitigation Monitoring and Reporting Program, MND, and
the Notice of Determination, if a MND is adopted for the project.
Task 4: Community Meetinas
TDA will assist the City to facilitate and conduct community meetings to provide a public presentation of
the project, identifying anticipated impacts, proposed mitigation measures, and responses to public
comments.
Schedule
TDA is prepared to meet with the City and ERSC to discuss the project, acquire data, and technical
documents for use in preparing the Initial Study within one week of authorization to proceed. TDA will
submit a screencheck draft of the project description within two weeks of receipt of needed data. TDA will
submit a screencheck Initial Study to the City and ERSC for review within 5 weeks after receipt of the
above mentioned data. TDA will provide a finalized Initial Study for circulation for public review and
comment within 2 weeks of receipt of the comments on the screencheck Initial Study.

We are pleased to submit this proposal to be part ofERSC's project team. We will prepare the
noise impact/mitigation study for the project. We have conducted numerous similar studies in
over 25 years of professional acoustical consulting services. My resume, and a listing of relevant
project experience, is attached.
Our scope of services will include the following:
. Conduct baseline noise measurements to establish current conditions,
. Perform traffic noise computer modeling for future volumes prior to any mitigation,
. Determine wall heights needed to achieve 65 dB CNEL in usable outdoor space,
. Discuss possible constraints in meeting the 45 dB CNEL interior standard at any livable
space not protected by sound walls (such as upstairs bedrooms),
. Evaluate other noise control options (rubberized asphalt, berms instead of walls,
structural upgrades, etc.) besides sound walls

. Attend two public forums to present findings or answer questions.
We will require fifteen (15) working days from completion of the traffic study to perform the

1. SCOPE OF SERVICES
Presented below is our Scope of Services with anticipated tasks, some of which are not spelled out
in the RFP, but are normally performed on similar projects.
PHASE J - CONCEPTUAL APPROVAL
Attend a kick-off meeting with the design team, staff and other agencies to confirm scope, project
approach, schedule of service and meeting calendar. Review submittal requirements, final limits of
work, design standards and all preferred materials.
A. Perform a site visit and review existing site conditions, landscape and points of connection.
B. Once we have the base sheets from the engineers and the planting area is defined, we will
develop a landscape concept that displays proposed landscape improvements for parkways
and medians. Seek approval of the landscape design layout, preliminary plant palette and
tree layout.
C. Develop a Construction Cost Estimate for planting and irrigation.
D. Work with the engineers to review and coordinate points of connection for water and power
in each designated planting area.
E. Based on public agency input, refine final layout plans and value engineering with staff.
F. Map agronomic testing areas for execution by the contractor as part of their work. We will
recommend inclusion of a test for Boron.

BACKGROUND
Katz, Okitsu & Associates will provide traffic engineering design services for Engineering Resources of
Southern California, Inc. in conjunction with the widening of Victoria Avenue from Highland Avenue to
Lynwood Avenue project in the Cities of San Bernardino and Highland. The required work will include:
. Traffic Signal Plan for three intersections
. Left-turn Lane Analysis
. Signing and Striping Coordination
. Street Lighting Plans
. Work Site Traffic Control
SCOPE OF SERVICES
Task 1 - Pre-Design Coordination
At the onset of the Project, Katz, Okitsu & Associates will discuss with the Engineer the proposed plan
and relevant projects. We will also discuss with staff of the City of San Bernardino the relevant issues
and current design standards. Base plan information and proposed street improvements for the subject
location would also be obtained from progress plans, City records, or other relevant records.
Task 2 - Field Review
~
For existing intersections, each site is fully inspected in the field with respect to needs for preparing the
design plans. Physical street improvements, existing traffic signalization, underground or overhead
utilities and obstructions, signing and striping, and other relevant items would be located in the field with
precision to be shown accurately on the plan. All improvement information obtained from records would
also be verified in the field in conjunction with this review.
Task 3 - Left-Turn Analysis
Katz, Okitsu & Associates will prepare a brief memorandum analyzing the left-turn pockets for the
Highland Avenue and Victoria Avenue intersection. This analysis is based upon the request from the City
of San Bernardino to determine if the left-turn pockets are at an adequate storage length due to the San
Manuel Casino opening nearby.

Task 4 - Traffic Signal Plan Preparation
An intersection base plan is prepared at I "=20' or metric equivalent for the location. The base plan will
show centerlines, right-of-way lines, relevant existing or proposed street improvements, utilities of record,
and existing traffic controls and improvements. All existing traffic signal poles, equipment, notes and
schedules would be inventoried in the field and shown on the base plan. Proposed new or modified
facilities will be designed and shown on the drawing to create a complete traffic signal plan. The plan
would confonn to the requirements of the City of San Bernardino and would reference the latest edition
of the Caltrans Standard Plans and Specifications. The plan would be designed in the specific fonnat
required or requested by the City of San Bernardino to meet their approval. The plan will include all
notes, schedules, and other features required to show future conditions completely and properly.
The plans and specifications will include any special design features that are routinely used by the City of
San Bernardino at all signalized intersections.
4.1 - Utility Coordination
The location of all utilities marked or evident in the field, indicated on reference plans, or indicated by
utility companies will be shown on the plans. Katz, Okitsu & Associates will distribute the plans and
coordinate the design directly with all utility companies which may have facilities in the site vicinity. We
will make design adjustments to avoid utilities as appropriate
4.2 - Signing & Striping Coordination
The striping work required for this location is expected to be minor, limited to relocation of crosswalks
and adjustment of existing lane lines. We will identify the need to revise striping and show required
changes on the signal plan. However, separate signing and striping plans are excluded from our Scope of
Services for this project. We prefer to prepare signing and striping plans at signalized intersections to
minimize the need for redesign. If we do not prepare the signing and striping plans, and if plan check
comments on signing and striping plans result in changes to the traffic signal plans, additional
compensation may be requested.
4.3 - Signal Interconnect Plan
Traffic Signal Interconnect conduits and related communication facilities may be affected. This work
will be shown in the intersection plan with notes explaining any work that does not appear on the plans.
No additional plan sheets are anticipated for signal interconnect for this project.
Task 5 - Street Lighting Design
Katz, Okitsu & Associates will provide plans for a street lighting design according to requirements of the
Cities of San Bernardino and Highland. The final street lighting plans would be prepared for final plotting
on D-sized sheets at 1"=40' (2400 feet of roadway). The project is expected to require 2 sheets.

PRINTING AND REPRODUCTION
Katz, Okitsu & Associates will provide the necessary copies of our plans and specifications during the
course of plan preparation. At the conclusion of the project, we would furnish original Mylar plan sheets
meeting the requirements of the City of San Bernardino, "camera ready" specifications, plus word
processing and CAD drawing files. Assembly of complete bid packages and printing would be the
responsibility of others.

Rock E. Miller, P.E. P.T.O.E.:
Mr. Rock Miller, P.E., will be the Principal-in-Charge for this project. Mr. Miller will perform Quality
Assurance and will sign the plans. Mr. Rock Miller is a Vice PresidentJPrincipal Engineer for Katz,
Okitsu & Associates. He is a registered Traffic and Civil Engineer in the State of California and has over
25 years of traffic signal planning, design, and operations experience. As the former City Traffic Engineer
for Costa Mesa and Traffic Engineer with the County of Orange, he is thoroughly familiar with the latest
capabilities and requirements available and expected from cities and municipal governments. For over 15
years, Mr. Miller has been a consultant at the senior or principal level in the field of traffic engineering.
He is recognized as an expert in traffic safety design in Southern California. Mr. Miller has been
responsible for completion of a wide variety of unique transportation projects, including an extensive
array of services in support of pedestrian safety and crosswalk enhancement, signing and striping, street
lighting, work site traffic control, impact analysis, and the design of street and highway improvements.
Mr. Miller is well regarded for his ability to apply strong fundamental traffic engineering knowledge to
custom situations.

San Manuel Indian Bingo & Casino Facility Renovation, Improvement, and Event Center Projects,
San Bernardino County, California: Katz, Okitsu & Associates prepared a traffic study on behalf of the
San Manuel Band of Serrano Mission Indians as part of a Tribal Environmental Study for the renovation
and improvement of the San Manuel Indian Bingo and Casino facility and the event center project. The
proposed Casino Project consisted of renovating the existing bingo and casino facilities and adding
approximately 300,000 square feet including 135,000 square feet for the convention and banquet hall,
70,000 square feet of additional gaming area, 55,000 square feet of additional food service area and
