MCC Date: January 10,2005 From: James Funk, Director Dept: Development Services Date: January 4, 2004 Synopsis of Previous Council Action: 07/10/00 Allocated $400,000 for street improvements of Pepper Linden (now known as Campus Parkway) from Kendall Drive to Northpark Blvd, and shared traffic analysis with CSUSB as part of the FY 2000/01 CIP Budget. 11106/00 Mayor and Common Council approved a Memorandum of Understanding between the City of San Bernardino and CSUSB to conduct a traffic study. 11120/00 Mayor and Common Council approved authorization to execute Agreement with Korve Engineering, Inc. for Civil Engineering Services for street improvements of Pepper Linden (now known as Campus Parkway) from Kendall Drive to Northpark Blvd. 07/15/02 Mayor and Common Council approved the CIP Budget for FY 2002/03 and increased the allocation to $500,700 for design, property acquisition, and partial construction for Phase I extension of Pepper Linden (now known as Campus Parkway) from Kendall Drive to Northpark Blvd. 05/19/03 Resolutions of Necessity were adopted for acquisition of three parcels relative to the extension of Pepper Linden Drive (now known as Campus Parkway). 05/19/03 The Negative Declaration was adopted for street improvements to Pepper Linden Drive (now known as Campus Parkway) from Kendall Drive to Northpark Blvd. and installation of traffic signal at Pepper Linden Drive and Kendall Drive. 06/02/03 Redevelopment Agency adopted CDC/2003-20, approving the purchase of certain property by Watson & Associates and approving that certain Disposition and Development Agreement between the Redevelopment Agency and Watson & Associates; and adopted Resolution No. 2003-120, approving that certain Purchase and Sale Agreement between the City of San Bernardino and the Redevelopment Agency of the City of San Bernardino relating to property located at the northwest comer of University Parkway and Northpark Boulevard. 10/06/03 Mayor and Common Council approved 2 Resolutions (Items #R-31) Redevelopment Agency adopted CDC/2003-32. 01120/04 Mayor and Common Council adopted 2 Resolutions (Item#R37) Community Development Commission. 04/05/04 Adopted Resolution No. 2004-95 authorizing an Agreement with Watson & Associates for grading of Campus Parkway between Kendall Drive and Northpark Boulevard. Various ~ See Attachment "I" '94 .Jl:: ,JDos---7 Finance: Agenda Item No. 10 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT Subiect: Resolution awarding a contract to Matich Corporation for construction of Campus Parkway (SS 04-01) and installation of a traffic signal at Kendall Drive and Campus Parkway (TC 04-07) per Plan Nos. 10952 & 10232, authorization for the Director of Finance to amend the FY 2004/05 adopted budget and authorization for the Director of Development Services to amend the Measure "I" 5-Year Capital Improvement Program. Back2round: On September 7, 2004, the Mayor and Common Council allocated, as part of the FY 2004/05 Capital Improvement Program (CIP), $1,477,000 for Campus Parkway Construction (Capital Improvement Program Project No. SS04-01) to construct a new roadway between Kendall Drive and Northpark Boulevard. Additionally, the Mayor and Common Council, as part of the FY 2004/05 CIP, allocated $151,400 for Campus Parkway (formerly Pepper Linden Drive) and Kendall Drive Traffic Signal (CIP Project No. TC04-07) for installation of a new traffic signal at the intersection of Campus Parkway and Kendall Drive. Some staff time and costs have been incurred bidding the project. The net funding currently available for the project is approximately $1,574,400. The project consists of construction of a new, mile long, 4-1ane divided roadway known as Campus Parkway between Kendall Drive and Northpark Boulevard; installation of a new traffic signal at the intersection of Campus Parkway and Kendall Drive; installation of a curbed median; installation of an irrigation system in the median; installation of landscaping in the median; and installation of grouted river rock at selected locations in the median. The median irrigation system, landscaping planting and the grouted river rock were bid as additive alternates, so the items could be added to the project if the budget allowed. The plans and specifications for this project are complete. The project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge, Construction Data Hot Sheet, Reed Construction Data, Bid America, Construction Bid Source, the City's web sites, and with the San Bernardino Area Chamber of Commerce. The following are bids that were received from seven (7) contractors: Amount of Basic Bid $1,599,599.00 $1,769,620.50 $1,811,093.00 $1,874,033.20 $2,012,388.00 $2,054,291.50 $2,254,126.69 $1,569,583.00 Based on review of the sealed competitive bids received, staff has determined that Matich Corporation of San Bernardino, the apparent low bidder based on the basic bid, has met the minimum requirements of the specifications and bid guidelines; and, therefore, recommends that the Mayor and Common Council award the referenced contract to Matich Corporation. 2 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT - Continued The estimated project costs are as follows: Construction Cost (basic bid) $ 1,599,599.00 Additive Bid No. 1 (Irrigation Svstem) $ 174,485.00 Additive Bid No.2 (Landscape Planting) $ 160,673.00 Additive Bid No.3 (Grouted River Rock Median) $ 247,120.00 Total Bid Amount $ 2,181,877.00 Contract Management and Inspection $50,123.00 Contingencies $200,000.00 Estimated Total Project Cost $2,432,000.00 If approved, this project is expected to begin construction in February of 2005 and be completed by September of 2005. Financial Impact: The total funding currently available in the FY 2004/05 Capital Improvement Program under Account No. 129-367-5504-7007 (SS04-01) and Account No. 250-370-5504-7262 (TC04-07) is $1,574,400, leaving a shortfall of $857,600. $292,000 in Measure "I" funds was proposed to be allocated in FY 2005/06 for Campus Parkway construction, SS04-01. Staff is recommending that those funds be allocated this fiscal year from the unallocated Measure "I" fund balance. Additionally, staff has identified $565,600 in savings from projects that came in under budget. We recommend that savings from SS-B "Construct Accessibility Improvements at Various Locations (Annual)"; SS05-1O "Pepper Linden Avenue Extension Property Acquisition"; SS05-06 "University Parkway Free Flowing Right Turn Lane"; and SS04-30 "Hospitality Lane Signal Modification and Street Improvements" be transferred to the Campus Parkway project as shown in Attachment "1" attached hereto. The sidewalk and ADA ramps constructed as part of this project will contribute to our annual goal of constructing at least $500,000 in ADA improvements throughout the City. After completion of construction of Campus Parkway, the median will be placed in a landscape maintenance district and the annual cost of maintenance will be assessed against the lots in Tract No. 16509. Recommendation: 1. Authorize the Director of Finance to amend the FY04/05 adopted budget and transfer $857,600 to Account No. 129-367-5504-7007 from the following: $292,000 from Measure "I" unallocated fund balance and $565,600 in savings from various project savings as outlined in Attachment "1"; and 2. Matich Corporation, at P.O. Box 50,000, San Bernardino, CA 92412, is 8 the lowest responsible bidder for construction of Campus Parkway (SS 04-01) and installation 9 10 of a traffic signal at Kendall Drive and Campus Parkway (TC 04-07) per Plan Nos. 10952 & 11 10232. A contract is awarded accordingly to said bidder in a total amount of $2,181,877.00, 12 with a contingency amount of $200,000, but such award shall be effective only upon being 13 fully executed by both parties. All other bids, therefore, are hereby rejected. The Mayor is 14 hereby authorized and directed to execute said contract on behalf of the City; a copy of the 15 16 contract is on file in the office of the City Clerk and incorporated herein by reference as fully 17 as though set forth at length. 18 19 20 SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, 21 22 modifications or waivers are intended or authorized and shall not be implied from any act or 23 course of conduct of any party. 24 25 26 27 28 I I I I SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it within sixty (60) days of passage of the resolution.
