Resolution awarding a contract to Gwinco Construction and Engineering, Inc., for Old Waterman Canyon
Road Bridge Repair (SS05-ll) per Plan No. 11304.

On September 7, 2004, the Mayor and Common Council allocated, as part of the FY 2004/05 Capital
Improvement Program (CIP), $138,750 in FEMA Funds and $46,250 in State (OES) Funds for Old
Waterman Canyon Road Bridge Repair (Capital Improvement Program Project No. SS05-11)) to repair the
damage to the bridge that was caused by the storm of December 25,2003.
This project consists of the following:
1. Removal of large boulders that may cause future damage and removal of existing logs (debris) for
better flow.
2. Construction of new wingwall and railing, and placement of new compacted soil.
3. Repair of damaged girders, abutments, and roadway improvements caused by or resulting from the
Old Fire and Christmas Flood of2003.
These improvements will repair the bridge to a safe condition for both residents and emergency access
vehicles.
The plans and specifications for this project are complete. The project was advertised locally in the San
Bernardino County Sun Newspaper, F. W. Dodge, Construction Data Hot Sheet, Reed Construction Data,
Bid America, Construction Bid Source, the City's web sites, and with the San Bernardino Area Chamber of
Commerce.
The following are bids that were received from three contractors:

Based on review of the sealed competitive bids received, staff has determined that Gwinco Construction and
Engineering, Inc., of Alta Lorna, the apparent low bidder, has met the minimum requirements of the
specifications and bid guidelines; and therefore, recommends that the Mayor and Common Council award
the referenced contract to Gwinco Construction and Engineering, Inc.

If approved, this project is expected to begin construction in January of 2005 and be completed by March
of 2005. The regulatory deadline from FEMA/OES to complete the project is April 27, 2005.
Financial Impact:
Funds for this project are available in FY 2004/2005 CIP in Account No. 004-362-5004-7452 (SS05-11) in
the approximate amount of $185,000.00. The cost of this project (up to $185,000) will be reimbursable
from the Federal Emergency Management Agency (FEMA) and the California State Office of Emergency
Services (OES).
Recommendation:
Adopt Resolution.

ENGINEERING, INC., FOR OLD WATERMAN CANYON ROAD BRIDGE REPAIR
(SS05-11) PER PLAN NO. 11304.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Gwinco Construction and Engineering, Inc. at 8126 Inspiration Drive,
AHa Lorna, CA 91701, is the lowest responsible bidder for Old Waterman Canyon Road
Bridge Repair (SS05-11), per Plan No. 11304. A contract is awarded accordingly to said
bidder in a total amount of $141,991.76, with a contingency amount of $7,099.00, but such
award shall be effective only upon being fully executed by both parties. All other bids,

13 therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said
14 contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk
15 and incorporated herein by reference as fully as though set forth at length.

SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be
18
19 obligated hereunder until the time of such full execution. No oral agreements, amendments,
20 modifications or waivers are intended or authorized and shall not be implied from any act or
21

course of conduct of any party.
SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it
24 within sixty (60) days of passage of the resolution.
