An Ordinance ofthe City or San Bernardino amending Section 15.24.030 ofthe
San Bernardino Municipal Code regarding property maintenance definitions
(Agenda Item #28)
Currently, Chapter 15.24 of the San Bernardino Municipal Code sets forth certain exterior
maintenance requirements in which the term "visible" is used relative to the requirement that
"visible side yards" be properly landscaped.
The proposed ordinance would add in the definitions section of Chapter 15.24 the defmition
of visible to mean ''viewable from the public right-of-way or from any residence/property in
proximity." Such a definition is necessary in order to maximize effective enforcement of this
chapter.
The Legislative Review Committee recommended approval of the subject ordinance to the
Mayor and Common Council. It is requested that the proposed ordinance be laid over for fmal
adoption.

4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
5 ORDAIN AS FOLLOWS:
6 SECTION 1. San Bernardino Municipal Code Section 15.24.030 is amended to now read
7 in its entirety as follows:
8 "15.24.030 Definitions.
9 Except as otherwise defined in this Chapter, all terms used in this Chapter which are defined by
10 applicable state law, the Uniform Building Code, or this Code, are used in this Chapter as so defined,
11 unless from the context it clearly appears that a different meaning is intended:
12 1. Owner means any person having a legal or equitable interest in the property.

2. Person means an individual, partnership, corporation, association, organization, or the
14 agent of any of the forgoing.
15 3. Visible means viewable from the public right-ol-way or from any residence/property
