BACKGROUND The California Law Enforcement Telecommunications System (CLETS) and the Central Name Index (CNI) are essential law enforcement tools. This access is used to run criminal histories, check wanted status and warrants, enter stolen and recovered vehicles, property, missing and found persons and used for general Officer and public safety issues. FINANCIAL IMPACT The Police Department has allocated $14,659.68 to subscribe to this essential service. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1: That the Mayor and Common Council of the City of San Bernardino authorize the Purchasing Manager to execute an agreement between the City of San Bernardino and the County of San Bernardino, in an amount not to exceed $12,067.68 for user access into the National Law Enforcement Telecommunications System (NLETS) and the California Law Enforcement Telecommunications System (CLETS), a copy of which is attached hereto marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. SECTION 2: That the Mayor and Common Council of the City of San Bernardino authorize the Purchasing Manager to execute an agreement between the City of San Bernardino and the County of San Bernardino, in an amount not to exceed $2592.00 for user access into the Sheriffs Central name Index (CNI), a copy of which is attached hereto marked Exhibit "B" and incorporated herein by reference as fully as though set forth at length. SECTION 3: The total amount shall not exceed $14,659.68 and the authorization to execute the above referenced purchase orders is rescinded if purchase orders are not issued within ninety (90) days of the passage of this resolution. 1/1 III Ylo. REPORT/RECOMMENDATION TO THE BOARD OF SUPERVISORS OF SAN BERNARDINO COUNTY, CALIFORNIA AND RECORD OF ACTION September 28, 2004 FROM: GARY PENROD, Sheriff Sheriff's Department SUBJECT: SECOND AMENDMENT TO CONTRACT NO. 02-744 WITH CITY OF SAN BERNARDINO POLICE DEPARTMENT FOR ACCESS TO THE COUNTY'S COMPUTERIZED LAW ENFORCEMENT DATA FILES RECOMMENDATION: Approve Second Amendment to Contract No. 02-744 with the City of San Bernardino Police Department for access to the County's computerized law enforcement data files and maintenance of related equipment in the amount of $2,592, for the period of July 1, 2004 through June 30, 2005. BACKGROUND INFORMATION: The County provides teleprocessing services, including Central Name Index (CNI), to various cities throughout the County in order to promote effective regional law enforcement through the cooperative use and maintenance of the County's computerized law enforcement data files. The rates for CNI service are established based upon the actual cost charged to the Sheriffs Department by the County Information Services Department for this service. On July 16, 2002 the Board of Supervisors approved Contract No. 02-744 with the City of San Bernardino Police Department. This contract is amended annually to revise the fee schedule to ensure proper cost recovery to the County. This proposed amendment, in the amount of $2,592, is for the period of July 1, 2004 through June 30, 2005, and results in a reduction of $15,900 from last year's contract amount due to a reduction in County equipment utilized by the City (access is being provided through City- owned personal computers instead of County-owned terminals); a decrease in County lSD's billing rate per hour; and a decrease in the number of transactions processed by the City. Under the terms of the contract, either party may terminate with 30 advance written notice. This contract was received from the City on September 13th and is being submitted for approval on the first available Board date after completion of the review process. REVIEW BY OTHERS: This item has been reviewed and approved as to form by County Counsel (Kevin L. Norris, Deputy County Counsel) on May 3, 2004, and has been reviewed by the County Administrative Office (Laurie Rozko, Administrative Analyst, 387-8997) on September 20, 2004. FINANCIAL IMPACT: There is no local cost impact related to this item. Revenue generated by this contract, in the amount of $2,592, fully offsets the cost of providing this service and was included in the Sheriffs 2004-05 budget. BACKGROUND INFORMATION: By state mandate, the Sheriff's Department oversees the local switching center that allows access by local law enforcement and other agencies to CLETS, a statewide criminal justice database. In turn, the Department contracts with these agencies to spread the cost of the system among those using the system. The rates are established based upon the actual cost charged to the Department by third parties, either County ISO or outside vendors, for this service. Contracts for CLETS access are reviewed annually to revise the fee schedule to ensure proper cost recovery to the County. On July 16, 2002 the Board of Supervisors approved Contract No. 02-746 to provide CLETS access to the City of San Bernardino Police Department. This contract amendment, in the amount of $12,067.68, is for the period of July 1, 2004 through June 30, 2005 and represents an increase of $540.96 from 2003-04 due to an increase in the number of transactions processed by the City. Under the terms of the contract, either party may terminate with 90 days advance written notice.
