OWNER Etiwanda SB Investment 2190 Hornet Road San Mateo, CA 91108 (626) 943.8199 APPLICANT: Kevin Roberts Spectra Homes, LLC 521-1/2 Myrtle, No.7 Monrovia, CA 91016 (626) 305.9444 BACKGROUND The applicant requests that the Mayor and Common Council approve Tentative Tract Map No. 16947 to subdivide approximately 6.78 acres into 29 single-family residential lots and Development Permit (Type III ) No. 04-44 to construct 28 detached single-family homes. The project site is located on the north side of 7th Street, between San Carlos Avenue and San Anselmo Avenue in the RS, Residential Suburban land use district (Exhibit 1). Specifically, approval of this tract map would authorize the City to initiate its eminent domain proceedings pursuant to the Subdivision Map Act, Section 66462.5. The proceedings would allow the City to utilize its power to acquire certain needed right-of-way from Ms. Kenia Canales (Property owner of APN: 0142-032-03) for Cleveland Street extension. The needed right-of-way, approximately 3,948 square feet (42' x 94'), is to allow Cleveland Street (60 feet in width) to connect with the existing Cleveland Street east of the proposed tract. The needed right- of-way from Ms. Kenia's backyard leaves her property with no setback problem and noise. The City has 120 days (4 months) to acquire by negotiation the interest in the land that will permit the improvements to be made. The 120 days starts at the time of filing of the final map (presentation to the Mayor and Common Council for final approval). In the event that the City fails to meet the time limitation, the applicant shall be required to construct a knuckle at the intersection of Cleveland Street and San Benito Avenue. Please refer to the Planning Commission Staff Report for additional discussion (Exhibit 2). At their meeting of February 8, 2005, the Planning Commission opened the public hearing and received public testimony on this matter. At the hearing, the project applicant stated that he has been unsuccessful in attempts to acquire the needed right-of-way for extension of Cleveland Street and is requesting that the City initiate its eminent domain power in order to resolve and facilitate this matter. Ms. Canales asserted that although the project applicant had made a few attempts to acquire the needed right-of-way, a suitable offer price had not been put forth for her consideration. She was also concerned that the eminent domain proceedings would remove her rights to a fair compensation for her property. Additionally, Ms. Charlesetta Jacobs, a local resident, spoke on drainage problems located generally on 7th Street, approximately 60 feet south of the project site. Apparently, ponding occurs quite often along 7th Street. She was concerned that this development could compound the drainage problems and pose a serious public health and safety issue in this neighborhood. Councilman Rikke Van Johnson told the Planning Commission that he was aware of the drainage issues and had reported the problems the to City (See Exhibit C for details). After considerable discussion, the Planning Commission made a motion to recommend approval of Tentative Tract Map No. 16947 and Development Permit (Type III) No. 04-44, which includes initiation of eminent domain proceedings. Commissioners Brown, Coute, Durr, Heasley, Morris, and Sauerbrun voted 6 to 0 in support of the proposals. Commissioner Enciso was absent. In an effort to acquire the needed right-of-way, Mr. Kevin Roberts, project applicant, made additional contacts with Ms. Canales after the Planning Commission hearing. To date, Mr. Roberts has been unsuccessful and is requesting that the City utilize its power pursuant to the Subdivision Map Act to help settle this matter. FINANCIAL IMPACT None. The applicant paid the Tentative Tract Map and Development Permit (Type III) filing fees and will be required to pay all costs associated with the eminent domain proceedings. RECOMMENDATION That the hearing be closed and that the Mayor and Common Council: I. Adopt the Mitigated Negative Declaration and the Mitigation Monitoring/Reporting Program (Attachment F), and 2. Approve Tentative Tract Map No. 16947 and Development Permit (Type III) No. 04-44 based upon the Findings of Fact contained in the Staff Report and subject to the Conditions of Approval (Attachment C) and Standard Requirements (Attachment D), which includes initiation of eminent domain proceedings. The residential lots will have a minimum lot size of 7,205 square feet. Development Permit No. 04-44 is for approval to construct 28 single-family homes. The site contains one existi,ng single-family home for a total of 29 homes. The project site is located on the north side of 7th Street, between San Carlo Avenue and San Anselmo Avenue in the RS, Residential Suburban land use district (Attachment A). The tract circulation has been designed to extend San Carlo Avenue and San Benito Avenue northerly approximately 281 feet connecting to Cleveland Avenue to provide a through traffic circulation pattern. The proposed project will be developed in one phase with the density of 4.3 units per acre (Attachment B). The proposed project offers a I-story and 2-story housing style with 3 different model plans. Each model plan offers 2 variations of finishes that includes a stucco look, masonry veneer, stone veneer and other style for a total of 12 variety choices. A 6-foot vinyl fence will be constructed for the perimeter fencing and for each house (Attachment B). The layouts are as follows: Home square footage Plan 1, I-story, 1,910 square feet (living area) with a 2-car garage (400 square feet). Plan 2, 2-slOry, 1,932 square feet (living area)-wi.th a 3-car garage (588 square feet). Plan 3; 2-story, 2,102 square feet (living area) with a 3-car garage (588 square feet). Tract composition Plan 1 (4bd/3ba) 10 homes (35%) Plan 2 (4bd/2.5ba) 8 homes (30%) Plan 3 (4bd/3ba) 10 homes (35%) Total..........................28 homes (100%) Plans 1, 2, and 3 offer some extra features for personal preferences to convert a loft into a bedroom/retreat area or to convert a fireplace into a fountain. The homes are wood- frame/stucco construction with concrete tile roofs. Architectural treatments include variations in roof style, front entry projection and garage door designs. The homes include window treatments on all four sides, metal roll up garage doors and fully landscaped front-yards for all the houses. TITM No. 16947 DPll1 No. 04-44 Page 3 SETTING/SITE CHARACTERISTICS The project site is occupied with one residential structure located on Lot 20. The remainder is vacant. Etiwanda Avenue forms the northern project site boundary. The site can be accessed through Eitwanda Avenue, San Carlo Avenue, San Benito Avenue and Cleveland Street. The site is located in the RS, Residential Suburban land use district and surrounded by single- family residential pevelopment in all directions. BACKGROUND The Development/Environmental Review Committee (D/ERC) initially reviewed the proposed tract on November 18, 2004. The D/ERC determined that the project applicant should make every effort to obtain the right-of-way from the property identified as APN: 0142-032-03 for Cleveland Street. The needed right-of-way is approximately 3,948 square feet (42' x 94'). The right-of-way is to allow Cleveland Street (60 feet in width) to connect with the existing Cleveland Street east of the proposed tract. Public Works also prefers Cleveland Street extension to allow a through traffic flow. In the event that the project applicant is unable to acquire the right-of-way, the City may file an eminent domain action against the property owner of APN: 0142-032-03 pursuant to the State Subdivision Map Act or require the project applicant to construct a knuckle at the intersection of Cleveland Street and San Benito Avenue. To date, the project applicant has been unsuccessful in acquiring the right-of-way for Cleveland Street from the property identified as APN: 0142-032-03 which is approximately .64 acres (27,730 square feet - 94' x 295'), and contains a single-family structure fronting Etiwanda Avenue. The reduction of the 42' x -94' (3,948 square feet) area from the backyard leaves the lot with .54 acres (23,782 square feet), with no setback problems and noise. Several attempts were made including sending an offer letter and a personal visit. The owners of APN: 0142-032-03 are not interested in selling part of their portion (Attachment G). Pursuant to the Subdivision Map Act, Section 66462.5, the applicant is requesting that the City initiate eminent domain proceedings against the property owner of APN: 0142-032-03-0000 to permit the necessary improvements to be made. Per the above Section, the City has 120 days (4 months) to acquire by negotiation the interest in the land that will permit the improvements to be made. This time frame includes proceedings for immediate possession of the property. The 120 days starts at the time of filing of the final map. In the event that the City fails to meet the time limitation, the applicant shall be required to construct a knuckle at the intersection of Cleveland Street and San Benito Avenue. CEQA STATUS Tom Dodson prepared an Initial Study on behalf of the project applicant. The Environmental Review Committee independently reviewed, analyzed, and exercised judgement in reviewing the Initial Study and mitigation measures and making its determination. Pursuant to the Public Resources Code and CEQA guidelines, a Notice of Intent was filed with the County and the Initial Study was made available to the public for review and comment beginning on November 24,2004, and ending on December 15, 2004. No comment was received on the Initial Study. ITTM No. 16947 DP1l1 No. 04-44 Page 4 On December 16, 2004, the D/ERC determined that the proposed Initial Study adequately addressed the environmental issues and recommended that a Mitigated Negative Declaration be adopted and moved Tentative Tract Map No. 16497 to Planning Commission. Additionally, the D/ERC first heard Development Permit (Type III) No. 04-44 for construction of homes on DeceJUber 2, 2004, and moved the project to the Planning Commission. The D/ERC determined that the Initial Study included action measures to properly mitigate and monitor any potential significant negative intpacts relating to development and construction of this site. FINDINGS AND ANALYSIS TENT A TIVE TRACT MAP 1. 1s the proposed map consistent with the General Plan? Yes, the proposed map is consistent with the General Plan and Development Code as shown in Table A below. The RS, Residential Suburban land use district allows single- family residential units at a maximum density of 4.5 units per gross acre. The proposal is for single-family development at 4.3 units per gross acre. All lots created meet the minimum lot size, width and depth requirements. Yes, the proposal is consistent with the objectives and policies of the General Plan as follows: ITTM No. 16947 DPl11 No. 0444 Page 5 General Plan Objective 1.10 states: "Promote the development oflow-density, large lot, high quality single-family detached residential units." The proposed tract complies with Development Code requirements and will enhance the existing residential development in this surrounding area. This project will promote and implement the objectives and policies of the General Plan. 3. Is the site physically suitable for the type of proposed development? Yes, the site of the proposed project is physically suitable for the proposed development in that the division of land is consistent with the Subdivision Map Act. The tentative tract map conforms to the subdivision design standar9s specified by the Development Code in that it meets the minimum lot size for the RS, Residential Suburban land use district. All of the proposed lots will have access to a dedicated roadway and infrastructure that will provide water, sewer, power, gas, telephone, and cable to the site. 4. Is the site physically suitable for the proposed density of development? Yes, the site is physically suitable for the proposed development in that the division of land is consistent with the Subdivision Map Act and the proposed lots will be compatible in design with the existing residential lots in all four directions to the east, north, west and south. The proposed subdivision is consistent with the RS development standards. The proposed density at 4.3 units per gross acre is lower than that of the RS district requirements at 4.5 units per gross acre. 5. Is the design of the subdivision likely to cause substantial environmental damage, or substantially and unavoidably injure fish or wildlife or their habitat? No, as described in the CEQA Section of this report, based on the Initial Study prepared by Tom Dodson & Associates on November 2004, no evidence of sensitive 'habitats for plant or animal species were observed, and none were expected due to the fact that no native or natUral habitat remains on the site. 6. Is the design of the subdivision likely to cause serious public health problems ? No, all lots proposed to be created will have access to a dedicated street. The design of the proposed subdivision meets all of the applicable requirements for the RS land use district. The circulation layout has been reviewed by the City Engineer and designed to accommodate the type of traffic forecast to be generated by the proposed subdivision and is unlikely to result in any serious public health problems. TITM No. 16947 DP111 No. 04-44 Page 6 Additionally, should the right-of-way property acquisition for Cleveland Street proven to be unsuccessful pursuant to the State Subdivision Map Act, the applicant shall be required to construct a knuckle at the intersection of Cleveland Street and San Benito A venue. Based on this, the design of the subdivision is unlikely to cause serious public health problems. 7. Will the design of the subdivision or the type of improvements conflict with any easements, acquired by the public at large, for access through or use of, property within the proposed subdivision? No, the easements identified in the Preliminary Title Report relate to electrical lines and other utilities. The design of the subdivision and the proposed improvements will not conflict with these easements, because any existing easements would be abandoned or relocated as determined by the Public Works/Engineering Division through processing of the Final Map. DEVELOPMENT PERMIT 1. Is the proposed development permitted within the subject zoning district and does it comply with all of the applicable provisions of the Development Code, including prescribed development/site standards and any/all applicable design guidelines? Yes, the proposed homes are consistent with the General Plan and Development Code, in that the RS, Residential Suburban land use district allows single-family residential units at a maximum density of 4.5 units-per gross acre. The proposal is for single- family development at a density of 4.3 units per gross acre. All units created meet minimum unit size, lot coverage, and setback criteria as shown in Table "A" below. Yes, the proposal is consistent with the General Plan objective and policy as follows: General Plan Objective 1.11 states: "Promote the development of single-family detached units in a high quality suburban setting." General Plan Policy 1.11.10 states: "Permit the development of single-family detached residential units at a density of up to 4.5 units per gross acre........in areas designated as "Residential Suburban (RS)" This proposal is for single-family dwelling units located in the RS land use designation. The development of the site will provide this area with needed improvements surrounded by single family homes. The proposed single-family detached residential units will be compatible with the adjacent residential units in the surrounding areas to the east direction. 3. Is the proposed development harmonious and compatible with eXlstmg and ftl.ture . developments within the land use district and general area, as well as the land uses presently on the subject property ? Yes, the proposed project is consistent with the residential character of the surrounding land uses as well as future residential development. The proposed single-family units are compatible with and will complement the existing single-family units in this area. The residential character of the proposed development is similar to that ofrecently completed single-family homes in this neighborhood. The home designs and treatment elements are designed to provide continuity with neighboring single-family structures. Architectural treattnents include variations in roof style, entry area and garage door designs. All windows and doors and side and rear elevations will be architecturally treated. ITTM No. 16947 DPlll No. 04-44 Page 8 4. /s approval of the Development Permit for the proposed development in compliance with the requirements of the California Environmental Quality Act and Section /9.20.030(6) of the Development Code? Yes, the Initial Study and Mitigated Negative Declaration that were prepared for Tract No. 16947 included the development and construction of this site with 28 single family dwellings. ; Approval of this Development Permit is in compliance with the requirements of the California Environmental Quality Act and Development Code Section 19.20.030 (6) pertaining to environmental resources and constraints. Approval of the proposed project would not result in any significant effects relating to traffic, noise, air quality or water quality. This is because all the necessary infrastructure is already in place to handle the anticipated capacity resulting from this proposed project. It is anticipated that the impacts relating to traffic, noise, air quality or water quality will be less than significant. 5. Will there be potential significant negative impacts upon environmental quality and natural resources that could not be properly mitigated and monitored? No significant harmful effects on the quality of the environment or on natural resources will exist as a result of this project. The project site is not located in geological hazard area and occurs within city limits and the site has no habitat value for endangered or threatened species. The site can be adequately served by all required utilities and public services. The proposed project complies with the RS land use development standards and is consistent with Development Code. 6. /s the subject site physically suitable for the type and density/intensity of use being proposed? Yes, the site is physically suitable for the type and density/intensity of the project being proposed as evidenced by project compliance with all applicable Development Code Standards as noted in Table" A". The proposed project complies with the density requirement at 4.3 du/ac from 4.5 as permitted by the Code for the RS" district. 7. Are there adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the"proposed use would not be detrimental to public health and safety? Yes, all agencies responsible for reviewing access, and providing water, sanitation and other public services have all had the opportunity to review the proposal, and none have indicated an inability to serve the project. The proposal will not be detrimental to the public health and safety in that all applicable Codes and will apply to the construction of this project. TlTM No. 16947 DPlll No. 04-44 Page 9 8. Are the location, size design and operating characteristics of the proposed development detrimental to the public interest, health, safety, convenience, or welfare of the City? No, the proposal is consistent with all provisions of the Development Code. The proposed size and design of the units will be compatible with the single-family units developed in the area. The location and operating characteristics of the proposed project will not be detrimental to the public interest, health, safety, convenience, or welfare of the City. CONCLUSION The proposals meet all applicable Findings of Fact for approval of Tentative Tract Map No. 16947 and Development Permit (Type III) No. 04-44. RECOMMENDATION Staff recommends that the Planning Commission independently review, analyze, and exercise judgement in reviewing the Initial Study in making its determination and recommend that the Mayor and Common Council: 1) Adopt the Mitigated Negative Declaration and the Mitigation Monitoring/Reporting Program (Attachment F), 2) Approve Tentative Tract Map No. 16947 and Development Permit (Type III) No. 04-44 based upon the Findings of Fact contained In- the Staff Report and subject to the Conditions of Approval (Attachment C) and Standard Requirements (Attachment D), which includes initiation of eminent domain proceedings. I II 1 , ~ ~ ~ I "ATTACHMENT C" CONDITIONS OF APPROVAL Tentative Tract Map No. 16947 & Development Permit (Type III No. 04-44 1. This approval is for subdivision of Tentative Tract Map No. 16947 to subdivide approximately 6.78 acres into 29 residential lots and Development Permit for construction of 28 dwellings on Tract No. 16947. The project site is located on the north side of 7th Street, between San Carlos Avenue and San Anselmo Avenue in the RS, Residential land use district. 2. Tentative Tract MaD No. 16947: Within two years of this approval, the filing of the final map with the Council shall have occurred or the approval shall become null and void. Expiration of a tentative map shall terminate all proceedings and no final map or parcel map shall be filed without first processing a new tentative map. The City Engineer must accept the final map documents as adequate for approval by Council prior to forwarding them to the City Clerk. The date the map shall be deemed filed with the Council is the date on which the City Clerk receives the map. The review authority may, upon application filed 30 days prior to the expiration date and for good cause, grant an extension to the expiration date pursuant to Section 19.66.170 of the Development Code and the State Map Act. Expiration Date:.lfebruary 8, 2007 3. DeveloDment Permit (TvDe III) No. 04-44: Within two years of development approval, commencement of construction shall have occurred or the permit/approval shall become null and void. In addition, if after commencement of construction, work is discontinued for a period of one year, then the permit/approval shall become null and void. However, approval of this application does not authorize commencement of construction. All necessary permits must be obtained prior to commencement of specified construction activities included in the Conditions of Approval and Standard Requirements. Expiration Date: February 8, 2007 4. The review authority may, upon application being filed 30 days prior to the expiration date and for good cause, grant one time extension not to exceed 12 months. The review authority shall ensure that the project complies with all current Development Code provisions. Tentative Tract 16443 Page 2 5. In the event that this approval is legally challenged, the City will promptly notify the applicant of any claim or action and will cooperate fully in the defense of the matter. Once notified, the applicant agrees to defend, indemnify, and hold harmless the City, the Economic Development Agency, the Redevelopment Agency, their affiliates, its officers, agents and employees from any claim, action or proceeding against the City of San Bernardino. The applicant further agrees to reimburse the City, the Redevelopment Agency and the Economic Development Agency of any costs and attorneys' fees which the City, the redevelopment Agency or the Economic Development Agency may be required by a court to pay as a result of such action, but such participation shall not relive applicant of his or her obligation under this condition. The costs, salaries, and expenses of the City Attorney and employees of his office shall be considered as "attorneys fees" for the purpose of this condition. As part of the consideration for issuing this permit, this condition shall remain in effect ifthe Tentative Tract Map and Development Permit are rescinded or revoked, whether or not at the request of applicant. 6. The final map, grading plan, and site improvement plans shall be in substantial conformance with the Tentative Map approved by the Planning Commission. Minor modifications to the planes) shall be subject to approval by the Director of Development Services through a minor modification permit process. Any modification which exceeds 10% of the following allowable measurable design/site considerations shall require the re-filing of the original application and a subsequent hearing by the appropriate hearing review authority if applicable: -'_ a. On-site circulation and landscaping. b. Placement and/or height of walls, fences and structures. c. Minor lot line adjustments, provided the lot area of each approved lot shall not be reduced below the minimum lot area permitted in the Development Code. d. Additional conditions, such as truck route approval, traffic controls, bonding, covering of loads, street cleaning, etc. may be required by the City Engineer. e) An on-site Improvement Plan is required for this project. Where feasible, this plan shall be incorporated with the grading plan and shall conform to all requirements of Section 15.04-167 of the Municipal Code (See "Grading Policies and Procedures"). t) One 4' x II' PCC pad at least 4" thick shall be provided in the rear or side yard area of each lot for storage of recycling containers. The pad shall be screened from public view and a 3' wide concrete walkway shall be provided from the driveway to the pad. All gates along the access way shall have a clear width of 3'-6" minimum. The property owner, prior to plan approval, shall execute this easement and 'covenant unless otherwise allowed by the City Engineer. 3. On existing home on the project site will remain on a newly created CS-166 (Spectra IS) IS 1 CITY OF SAN BERNARDINO DEVELOPMENT SERVICES INITIAL STUDY lot (lot 20) in the subdivision. Based on existing grading calculations, about 250,000 cubic yards of grading cut and fill will occur, with about 6,500 cubic yards of fill material needed to be imported to the project site to accomplish the ultimate elevations of the project site. The grading for each pad will incorporate sufficient detention to r'etain about three-quarters of an inch of rain over each parcel. Thus, retention will occur on each of the 29 lots and will ensure that storm runoff will not increase when the project site is fully developed. Currently, access to the site exists at the northern, southern. an'(fMstern site boundaries from Etiwanda Avenue, San Carlo Avenue, San Benito Avenue, and Cleveland Street, all streets located within the City of San Bernardino. 9. Other agencies whose approval is required (e.g., permits, finance approval, or participation agreement): Since the proposed development is greater than one acre, the developer must submit a Notice of Intent (NOI) to the State Water Resources Control Board for a General Construction Permit, NPDES Permit (National Pollution Discharge Elimination System) permit. This permit is granted automatically by submittal of an NOI to the State Board, but is enforced through a Storm Water Pollution Prevention Plan (SWPPP) that identifies construction best management practices for the site. The South Coast Air .Quality Management District (SCAQMD) adopted its most recent Air Quality Management Plan (AQMP) is 2003, and it is designed to bring the SoCAB into attainment with all federal air quality standards by 2010. It is in this context that emissions from individual projects are considered under CEQA. The AQMP and related plans adopted by the Southem California Association of Governments (SCAG), such as the Regional Comprehensive Plan and Guide (RCPG), are being implemented in such a manner that existing emissions within the SoGAB, plus those emissions associated with forecast growth that is consistent with these regional plans over the next six years, will allow the SoGAB to be in attainment by 2010. The proposed project includes the development of approximately 6.78 acres of land owned by the project proponent. Development of this property is proposed to include up to 29 units of single-family residential. BUilding construction assumes the following structures will be built during the construction phase on the project site: 29 single-family residential units and associated roadways. The SGAQMD establishes a 177 acre quarterly area of disturbance. The proposed project will be graded over a period of 30-60 days with an estimated total of 6.78 acres of disturbance. Assuming 26 Ibs/day of PM10 emissions per acre, seven acres would generate 182 Ibs. of PM10 emissions without any mitigation. Implementation of the following measures can reduce fugitive dust emissions by at least 50%, or to 911bs/day of PM10 emissions well below the threshold. No potential exists for significant project specific or cumulative air emissions to be generated by this proposed project. No operational air pollutant mitigation measures will be required for this project. Both the construction and operation emissions of the proposed project will fall below SCAQMD significance thresholds and will not individually or cumulatively Contribute to significant air quality impacts. III.e During construction, the proposed project includes operations that will have diesel odors associated with equipment and materials. None of these odors are permanent, nor are they normally considered so offensive as to cause sensitive receptors to complain. Diesel fuel odors from construction equipment and new asphalt paving fall into this category. Discussion: VlIl.a The proposed project Is not forecast to generate any wastewater, other than domestic wastewater. The domestic wastewater will be delivered into the existing sewage system serving the existing residences. The domestic sewage will be delivered to the City's regional wastewater reclamation facility located south of the intersection of Arrowhead Avenue and Orange Show Road. This plant discharges to the RIX facility in south Colton which currently operates in conformance with its existing discharge requirements. The proposed project will not result in a potential for violating water quality standards or waste discharge requirements from the domestic wastewater that will be generated by future residential development. The second area where this project has a potential to cumulatively contribute to violation of water quality standards is through the discharge of storm water runoff from a proposed urban residential development. The proposed project will discharge storm water runoff (at least that not detained on individual lots) initially to the local streets and ultimately to Lytle Creek and the Santa Ana River. Both during construction and after occupancy, the proposed project has a potential to contribute urban pollutants (sediment, fertilizers, trace metals, pesticides, oil, grease and trash and other materials) to these streams and cause violations of water quality standards established for these streams in the Water Quality Control Plan (Basin Plan) adopted by the Santa Ana Regional Water Quality Control Board in 1995. As for all new project, the proposed project must comply with Storm Water Regulations for new developments. Construction-related water quality impacts are regulated through the National Pollutant Discharge Elimination System (NPDES) program that is managed through the implementation of a Storm Water PollutlQn Prevention Plan (SWPPP). The SWPPP is a mandatory component for complying with the General Construction Permit (Permit) issues through the State Water Resources Control Board through the submittal of a Notice of Intent. Since the SWPPP is mandatory, a mitigation measure is not required to ensure that it is prepared. The SWPPP must include a visual monitoring program, a chemical monitoring program for "non-visible" pollutants to be implemented if there is a failure of BMPs, and a sediment monitoring plan. However, the specific best management practices (BMPs) to control pollutant discharges during construction and the degree of control over pollutants, such as trash or sediment, are not specified. Therefore, the following mitigation measure will be implemented to control potential level of pollutant discharges from the project site to a less than significant level. V111.a-1 The project proponent will select best management practices from the' City's standard BMP measures. These BMPs.shall achieve an SO-percent reduction in sediment relative to an uncontrolled condition. The SWPPP and specific BMPs shall be approved by the City prior to ground disturbance. Potential long-term water quality impacts generated from new urban development are regulated through a water quality management plan implemented to conform with City and County requirements for the Middle Santa Ana Watershed Management Area established by the Santa Ana Regional Water Quality Control Board (Regional Board). If the proposed project contributes substantial urban pollutants to storm water runoff after it is developed and occupied, it could cause a violation of the MS4 permit issued to the County and City for non point source discharges. i.e., those discharges from the land, whether developed or not. The project's use of domestic water from the Department is not forecast to result in any significant effects on groundwater as the City must limit pumping to allocated water rights, plus imported water offsets. At this time the City has adequate water supplies to ensure that the groundwater table is not significant lowered. Further, the project site does not serve as a major groundwater recharge site and the conversion of the site to residential use will not cause a substantial loss of water recharge to the groundwater aquifer. No mitigation is required. VlIl.c The project site is located in an upland area, so no potential exists for the implementation of the project to alter the course of a stream or river. All on-site flows will be captured within the proposed lots or the curb and gutter system. The Storm Water Pollution Prevention Plan (SWPPP) has been prepared and will be implemented to ensure that both short- and long-term storm runoff discharges are not unacceptably degraded by sediment or other pollutants. With the introduction of concrete slabs and pavement, there will be a decrease in surface permeability by impermeable surfaces. In addition, the area has several hospitals that are equipped to provide emergency medical response. These include: Loma Linda Hospital; Arrowhead Regional Medical Center; Community Hospital; and St. Bemardine's Hospital. All of these facilities have adequate emergency response c!lpabilities to provide medical aid for residents without experiencing a significant impact to their capacity to provide such aid. These are logical modifications in the roadways, so no disjointed pattern of roadway improvements will occur and no unusual hazards will be created. More than adequate access will be provided by the local road system. Temporary circulation impacts resulting from construction activities may occur. During construction activities. the traffic flowwill be maintained to the highest level possible with the use of standard traffic control devices. The one structure on the site will be demolished and the demolition waste will be recycled to the extent feasible. After developed, the project will generate typical domestic solid waste that will be taken to existing landfills (MidValley and San Timoteo) with capacity extending more that the five year planning period into the future. No significant solid waste issues or impacts are posed by the proposed project. No mitigation is required as recycling requirements are mandated by local jurisdictions in accordance with adopted Source Reduction and Recycling programs. XII.g All required utility infrastructure is available either adjacent to the site or nearby. No major extension of utility infrastructure will be required to support this project, so no adverse pattern of utility extensions can result from project implementation. No mitigation is required. The potential impacts of implementing the proposed project have been evaluated in this Initial Study. The City will require the implementation of all identified mitigation measures to ensure that potentially significant impacts from constructing and occupying the proposed project will not impact any of the following resource values or physical conditions that occur at the project site: earth resources, hydrology and water quality, air quality, transportation/circulation, hazards, and noise. This program has been prepared in compliance with the California Environmental Quality Act (CEQA) and the State of California and City of San Bernardino CEQA Guidelines. CEQA Section 21081.6 requires adoption of a monitoring and/or reporting program for those measures or conditions imposed on a project to mitigate or avoid adverse effects on the environment. The law states that the monitoring or reporting program shall be designed to ensure compliance during project implementation. The Mitigation Monitoring and Reporting Program contains the following elements: 1. The mitigation measures are recorded with the action and procedure necessary to ensure compliance. We visited the site and talked with Ms. Jacob's, a resident at 2430 W. ih Street. She pointed out ponding in the gutter in front of her house. Uplifting of the curb by tree roots causes the ponding. She stated that the ponding never goes away due to nuisance drainage from existing properties to the west. She said the she fears the new subdivision, when completed, will compound the problem. I've asked the Public Services Department to review the problem and determine if they can remove and reconstruct the curb and gutter at Ms. Jacob's property so that is will drain properly. ih Street is an existing residential street, which runs east west. It was constructed in 1956 on a very flat grade of 0.30%. Current design standards would require, a minimum grade of 0.50%; however, the desirable minimum longitudinal street grade is 1.0%. During our field review, ponding at various locations along the street was observed. Ponding at some locations was worse than the ponding observed in from of Ms. Jacob's house. The flatness of the street grade is such that tree leaves or other debris in the gutter will cause ponding of the nuisance drainage water. I reviewed the Initial Study for proposed Tentative Tract No. 16947 and found paragraph IV.I that states "No other hydrology or water issues are known to affect the project site or to be affected by the proposed project". The City Engineer concurred with this assessment since there is enough street capacity available to carry drainage that will be generated by proposed Tentative Tract Page 2 No. 16947. It is possible that the street may be partially flooded during major storms, however, that is not an unusual occurrence. Based on the flatness of the street, there is no easy fix for the ponding problems. The area-wide solution to the drainage problem is construction of Master Plan storm drain Project No. 3-2 in 6th Street and in Meridian Avenue. The cost of such a storm drain is estimated to be $3,600,000; however, the nuisance ponding will still be a problem. Unfortunately, ponding problems such as this are common in the older areas of town where tree roots have uplifted the curbs. More frequent street sweeping may alleviate the problem somewhat. It is usually requested that adjacent residents along impacted streets assist by keeping the gutter cleaned of debris; however, there is no easy permanent solution to the problem.
