Recommended Motion: Approve the City Attorney's Office request to establish the new classification of Supervising City Attomey and reclassify (1) existing City Attorney Investigator to the new classification. Classification and salary adjustment to be effective August 16, 2004, with the following motions: 1. Establish new classification of Supervising City Attorney Investigator, Range 3507, $5,565 - $6,765/month. 2. Reclassify one (1) City Attorney Investigator position, Range 3477, $4,792-5,824/month, to new classification of Supervising City Attorney Investigator, Range 3507, $5,565- $6,765/month. 3. Description) Finance: ~ Council Notes: Agenda Item No.~ 8/,r,!DY CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subject: The City Attorney's Office has requested the establishment of a new classification of Supervising City Attorney Investigator. Upon establishment of the classification, one existing City Attorney Investigator position would be reclassified to Supervising City Attorney Investigator. Background: The City Attorney's Office currently employs one (I) full time and four (4) part-time City Attorney Investigator positions. The establishment of a Supervising City Attorney Investigator classification will provide more effective organization of the Investigation assigmnents and staff. Financial Impact: Budgeted cost for FY 2004-05 Salary $67,808 Benefits 15.078 Total $82,866 Proposed Cost for FY 2004-05 Salary $72,676 Benefits 15.502 Total $88,178 The total annual cost to implement the new classification and proposed reclassification is approximately $5,300. The additional cost will be absorbed in the existing budget through Personnel Savings. Recommendation: I. Establish new classification of Supervising City Attorney Investigator, Range 3507, $5,565 - $6,765/month. 2. CITY OF SAN BERNARDINO SUPERVISING CITY ATTORNEY INVESTIGATOR Class specifications are intended to present a descriptive list of the range of duties performed by employees in the class. Specifications are!!!!! intended to reflect all duties performed within the job. SUMMARY DESCRIPTION Under direction, supervises, assigns, reviews, and participates in the work of staff responsible for conducting investigations of violations of City codes and tort cases; and performs related work as required. ORGANIZATIONAL RELATIONSHIPS The class of Supervising City Attorney Investigator is a working-supervisory level field management class. Supervision is exercised over the City Attorney Investigators assigned to the City Attorney's Office. REPRESENTATIVE DUTIES The following duties are typical for positions in this classification. Any single position may not perform all of these duties and/or may perform similar related duties not listed here: I. Provides courteous and expeditious customer service to the general public and City department staffs. 2. Plans, prioritizes, assigns, supervises, reviews, and participates in the work of staff responsible for conducting investigations of violations of City codes and tort cases. 3. Adjusts work assignments, procedures, and priorities to expedite work flow; investigates and takes appropriate action on complaints regarding operations and personnel supervised; participates in the training and evaluation of personnel to ensure efficient operations. 4. Conducts field investigations and appears in court; performs investigations of violations of City codes and tort cases as directed by the City Attorney. 5. Locates and interviews suspected persons and witnesses, and analyzes and evaluates their testimony; prepares support material for cases; searches and obtains factual evidence. 6. Assists legal staff in trials and witness reports; interprets and explains provisions of laws, rules, and regulations related to the purpose of investigations. 7. Performs aU aspects of investigations including conducting interviews, securing evidence, establishing facts, preparing reports on the results of investigations, and making recommendations concerning investigations; 8. Assists attorneys representing the City in aU aSPCCts of case preparation, including service of process and obtaining witness statements as may he required; 9. Participates in the selection and training of personnel by interviewing candidates and recommends hiring, promotion, discipline and termination to the City Attorney; 10. Directs work by establishing and implementing guidelines and procedures for the investigation of cases that are the responsibility of the City Attorney's Office; II. Instructs investigative staff as to their duties and department procedures and policies through training sessions, on-the-job training, staff meetings, and individual assistance as needed to insure consistent and proper discharge of responsibilities; 12. Receives aU referrals and complaints including phone caUs, letters and written referrals and detennines the appropriate assignment of cases depending on the nature of complaint, type of violation and extent of information provided; Page - 1 -~. Reviews all completed investigations for thoroughness of investigative work, accuracy and completeness of the evidence and documentation for prosecution purposes, in order to determine appropriate course(s) of action to be taken; 14. Assists the City Attorney in the prosecution of cases by providing a synopsis of cases and providing case files as requested by the City Attorney to begin the process of prosecution; 15. Evaluates operations of the investigations unit, recommends and implements changes in policies and procedures; 16. Initiates and assists in the formulation of staff development and training sessions; 17. Testifies in civil, criminal and administrative hearings, and presents evidence as required; 18. Acts as the City Attorney Investigators liaison with other departments and agencies to facilitate the exchange of information, to establish procedures for obtaining confidential information for investigations and to assist in obtaining restitution; 19. Supervises Investigators assigned to work with Code Enforcement and/or Fire Prevention Officers on patrol, abatement cases, and/or specific assignments involving Code Enforcement and/or Fire Prevention; 20. Prepares and maintains records and reports on investigations and prosecutions; 21. Assures that all required reports are prepared and submitted in a timely manner; 22. On assignment, acts in liaison capacity between the City departments and City Attorney's office; 23. Keeps necessary records and prepares correspondence and reports; 24. Routinely adheres to and maintains a positive attitude towards City and Department goals; 25. Performs related work as required. OUALIFICATIONS Knowledl!e of: Principles and techniques of investigation; Principles and techniques of court procedure; Principles and practices of criminal and civil law; Legal rights of citizens; Characteristics of public entity; Principles and practices of tort liability; Principles of rules of evidence; Thorough knowledge of the techniques, procedures and sources used in conducting investigations; Good knowledge of the techniques and procedures involved in establishing legal action in court; Good knowledge of State of California Penal Code and criminal prosecution laws; Good knowledge of interviewing techniques; Good knowledge of the techniques and procedures used in investigations for criminal prosecution; Good knowledge of the rules of evidence; English, grammar, syntax, word usage, spelling and punctuation; Principles of supervision. Ability to: Gather, analyze and evaluate facts and evidence; Make recommendations; Obtain information through interview and interrogation; Page - 2 . Minimum OuaIlftcations Completion of 60 semester units (90 quarter units) of coIlege level course work in law enforcement or related field and ten years experience in law enforcement, governmental investigation or related field. Up to two additional years of specified experience may be substituted for two years of education on the basis of 30 semester units being equivalent to one year of experience. License or Certificate: Possession of a valid Class "C" California Driver's License is required. Possess or obtain within one year of employment a valid Private Investigator's License issued by the State of California, Bureau of Consumer Affairs and keep said license current and valid throughout employment as a Supervising City Attorney Investigator.
