CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT Subject: Resolution awarding contract to Tunnel Equipment Manufacturing Company dba TEMCO for Sanitary Sewer System Improvements for Proposed SR-210 Freeway Extension at 27th Street along Medical Center Drive and Cajon Boulevard (SW 04-18) per Plan No. 10743. Back2round: Mayor and Common Council approved Utility Agreement No. 19948 with the California Department of Transportation (Caltrans) for the relocation of the subject sewer in connection with the extension of the SR-21 0 Freeway. On September 15, 2003, the Council approved this project as a part of the 2003/2004 CJ.P. The cost of this project is 100% percent reimbursable from Caltrans under terms of Utility Agreement No. 19948. The City must submit an itemized bill to the State within 360 days after completion of work. Plans and Specifications for this Sanitary Sewer Relocation for Proposed SR-210 Freeway Extension at 27th Street along Medical Center Drive and Cajon Boulevard (SW 04-18) have been approved. Bids have been received and the construction project is ready to be awarded. This project was advertised locally in the San Bernardino County Sun Newspaper, F. W. Dodge Company, Reed Construction Data, Bid America Electronic online Plan Room, Construction Data (Hot Sheet), Construction Bid Source, the City's web site, and with the San Bernardino Area Chamber of Commerce. CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT - Continued If the project is awarded, it is anticipated that construction can start in February of 2004, and be completed by July of 2004. Financial Impact: Sufficient funding for this project, in the amount of $572,554.00, was approved in the FY 2003/2004 C.I.P. budget in Account No. 245-365-5504-7417, "27th Street - Relocation of Existing Sewer Main for SR-210 Freeway (SW04-18)." The entire cost of this project is reimbursable under terms of Utility Agreement No. 19948 and was approved by the Mayor and Common Council on September 4, 2003. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION I. Tunnel Equipment Manufacturing Company dba TEMCO at 24805 Rosepark Ct. Newhall, CA, 91321 is the lowest responsible bidder for Construction of Sanitary Se\\'er System Improvements for Proposed SR-210 Freeway Extension at 27th Street along Medical Center Drive and Cajon Boulevard (SW 04-18), per Plan No, 10743. A contract is 13 awarded accordingly to said bidder in a total amount of $467,595.00, with a contingency 14 amount of $50,202.50, but such award shall be effective only upon being fully executed by both 15 16 17 18 19 20 21 22 23 24 25 26 27 parties. All other bids, therefore, are hereby rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by reference as fully as though set forth at length. SECTION 2. This contract and any amendment or modifications thereto shall not take effect or become operative until fully signed and executed by the parties and no party shall be obligated hereunder until the time of such full execution. No oral agreements, amendments, modifications or waivers are intended or authorized and shall not be implied from any act or course of conduct of any party. SECTION 3. This resolution is rescinded if the parties to the contract fail to execute it within sixty (60) days of passage of the resolution.
