This is the time and place set for a joint Adjourned Regular
Meeting of the Mayor and Common Council and the Community
Development Commission of the City of San Bernardino at their
regular meeting held at 8:35 a.m., on Monday, November 6, 1989,
in the Council Chambers of City Hall, 300 North "0" Street, San
Bernardino, California.
The City Clerk has caused to be posted the Order of
Adjournment of said meeting held on Monday, November 6, 1989, and
has on file in the office of the City Clerk an affidavit of said
posting together with a copy of said Order which was posted at
10:00 a.m., on Tuesday, November 7,1989, on the door of the
place at which said meeting was held.
The joint Adjourned Regular Meeting of the Mayor and Common
Council and Community Development Commission of the City of San
Bernardino was called to order by Mayor Holcomb at 1:20 p.m.,
Monday, November 13, 1989, in the Council Chambers of City Hall,
300 North "0" Street, San Bernardino, California.
ROLL CALL
Roll call was taken by City Clerk Clark with the following
being present: Mayor Holcomb; Council Members Estrada, Reilly,
Flores, Maudsley, Miller; Senior Assistant City Attorney Barlow,
City Clerk Clark, City Administrator Julian. Absent: Council
Members Minor and pope-Ludlam.
INVOCATION
The invocation was given by Phil Arvizo, Executive Assistant
to the Council.
PLEDGE OF ALLEGIANCE
The pledge of allegiance was led by Council Member Miller.

RES. 89-440 RESOLUTION OF THE MAYOR AND COMMON

City Clerk Clark read the title of the resolution.
In a memorandum dated November 9, 1989, James E. Robbins,
Acting Executive Director of the Redevelopment Agency, stated
that on October 19, 1989, the commission authorized the formation
of a citizen advisory committee to provide citizen input
concerning the Mt. Vernon Corridor Redevelopment Project area.
Attached to the proposed resolution was Exhibit "B", a list
of interested persons recommended for appointment to the Mt.
Vernon Corridor Citizens Advisory Committee as follows:

After a review of the interested persons list of names
(Exhibit "B"), the Commissioners recommended that the category
for line item 4, Mr. R. Wade Byars, and line item 5, Ms. Vicky
Argo, be changed to read "residential property owner."
Commissioner Estrada distributed to the commissioners the
following list of interested persons to be included in (Exhibit
"B") of the proposed resolution for appointment to the Mt. Vernon

Council Member Estrada made a motion, seconded by Council
Member Flores and unanimously carried, that further reading of
the resolution be waived; that said resolution be amended by
changing the category for line item 4, Mr. R. Wade Byars, and
line item 5, Ms. Vicky Argo, on Exhibit "B" to "residential
property owner," and said resolution be adopted as amended; and
that the interested persons list submitted by Commissioner
Estrada be approved.
Resolution No. 89-440 was adopted by the following vote:
Ayes: Council Members Estrada, Reilly, Flores, Maudsley, Miller.
Noes: None. Absent: Council Members Minor and pope-Ludlam.
Sue Gonzales, Project Manager in the Redevelopment Agency,
answered questions regarding the Planning Commission's approval
of the individuals recommended for appointment to the Mt. Vernon
Corridor Citizen Advisory Committee.
COMMUNITY-WIDE CLEAN-UP DAY
In a memorandum dated November 2, 1989, Marshall Julian,
City Administrator, stated that a sum of one million dollars from
bond proceeds has been allocated for use in a massive community-
wide clean-up effort in the City of San Bernardino. The first
programmed event is a community wide clean-up day which would
focus on major traffic arteries in the city utilizing citizen
groups and city resources to accomplish this task. The cost of
this program is estimated at $100,000. (3)
Mayor Holcomb explained that the details of the clean-up
program are still being worked on and refined. He explained that
this clean-up program is designed to appeal to the public and to
encourage them to take care of their own property. He stated
that this appeal would also be extended to volunteers who wish
to participate in the clean up of blight in various areas of the
city. He further stated that there would be special recognition
and prizes given to the outstanding volunteer who participated in
this program.
John Husing, Consultant to the Mayor, explained the clean-
up advertisement program. He stated that the first newspaper
advertisement will appeal to the public to clean up their own
property. The second advertisement will provide information as
to how community and citizen groups can earn money by cleaning
up blight in their neighborhood. The third advertisement will be
used to inform the public of city ordinances that will be used to
enforce blight control.

Mayor Holcomb spoke regarding blight in the downtown area
and what the cost would be to clean up this area.
Manuel Moreno, Jr., Director of Public Services, answered
questions regarding the cost and quantity of trash containers
that would be needed to clean up the downtown area.
The Director of Public Services answered questions regarding
administration of the blight abatement lien program. He stated
that this program would be operated on a six month trial basis.
If the lien program is successful in the first six months, it
will be continued for another six month period.
Director Moreno explained that there will be a blight
abatement kick-off Clean-Up Day campaign which is tentatively
scheduled for Saturday, December 9, 1989, to clean up city
parkways and parcels to within three feet of the property line.
The blight abatement kick-off program will utilize private
volunteers, citizen groups, and city resources.
The Director of Public Services answered questions regarding
whether or not the blight abatement program includes backyard
cleanup.

Mayor Holcomb suggested that the following recommendations
be considered: a) that cleanup costs in high growth areas be
recovered through the blight abatement lien process; b) that
free clean-up services be discontinued; b) that code
enforcement personnel be instructed to start issuing notices
immediately; c) that funds be authorized to hire more manpower
and equipment; d) that a code enforcement officer be assigned to
each community police center in order to respond more quickly to
complaints concerning blight.

Mayor Holcomb spoke regarding the Board of Building
Commissioner's meetings being held once a month. He stated that
when a building has been declared a nuisance and must be abated,
the property owner has to wait thirty days before the case is
heard by the Building Commission. He explained the concept of
having a hearing officer hear the case as it arises. He further
stated that this concept would eliminate the thirty day time lag.

Council Member Miller made a motion, seconded by Council
Member Estrada and unanimously carried, that the designation of a
community-wide clean-up day for San Bernardino, utilizing
citizens groups and city resources be continued to Monday,
November 20, 1989, in the Council Chambers of City Hall, 300
North "D" Street, San Bernardino, California.

RES. 89-441 - RESOLUTION OF THE CITY OF SAN BERNARDINO
AUTHORIZING THE DIRECTOR OF BUILDING AND SAFETY TO
RECOMMEND TO THE SAN BERNARDINO MUNICIPAL COURT BAIL
FORFEITURE PENALTIES FOR CERTAIN CERTIFICATE OF
OCCUPANCY AND PROPERTY MAINTENANCE STANDARD VIOLATIONS
LISTED IN THE MUNICIPAL CODE. (4)
City Clerk Clark read the title of the resolution.
In a memorandum dated November 9, 1989, Larry Reed, Director
of Building and Safety, provided a bail schedule for the
enforcement of city ordinances requiring a certificate of
occupancy (MC-671), and dealing with property maintenance and
requiring minimum standards (MC-679).
Larry Reed answered questions regarding the purpose of this
resolution.
Senior Assistant City Attorney Barlow answered questions
regarding whether or not additional costs will be incurred if an
individual contests a violation.
Wayne Overstreet, Superintendent of
explained the process that an individual
he/she were found innocent or guilty of a
ordinances.

Superintendent Overstreet explained the process for issuing
warning notices for vehicle abatement and parking citations. He
stated that a thirty day warning notice is given to the
individual. If the individual does not comply, he/she is then
given a citation.
Larry Reed answered questions regarding the $25.00 bail
schedule fee.
A discussion ensued regarding increasing the bail schedule
fee as a deterrent to future misconduct.
COUNCIL MEMBER ESTRADA EXCUSED
Council Member Estrada left the Council Meeting.
Larry Reed answered questions, stating that code enforcement
inspectors would issue a ten day notice to an individual who
violates the certificate of occupancy and property maintenance
ordinances.
Council Member Maudsley made a motion, seconded by Council
Member Reilly and unanimously carried, that all references in
Exhibit "A" be changed from $25.00 to $50.00.

Member Miller and unanimously carried, that further reading of
the resolution be waived; and that said resolution be amended by
changing all references in Exhibit "A" from $25.00 to $50.00 and
said resolution be adopted as amended.

RECESS MEETING - CLOSED SESSION
At 2:10 p.m., Council Member Miller made a motion, seconded
by Council Member Pope-Ludlam and unanimously carried, that the
Mayor and Common Council and Community Development Commission
recess to closed session for the following: (5)
a. to give instruction to the CitY's/Commission's
negotiator on the purchase of property pursuant to Government
Code Section 54956.8. The real property which the negotiations
concern is generally located along 201 North "E" Street, and at
Highland and Arden;

b. to confer with the attorney regarding pending litigation
pursuant to Government Code Section 54956.9(b)(1), as there is
significant exposure to litigation;
c. to confer with the attorney regarding pending litigation
pursuant to Government Code Section 54956.9 (c) , so that
Council/Commission may decide whether to initiate litigation;
d. to consider personnel matters pursuant to Government
Code Section 54957;
e. to meet with designated representatives regarding labor
relations matters relative to fire fighter negotiations and/or
other employee labor organizations, pursuant to Government Code
Section 54957.6;
f. to confer with the attorney regarding pending litigation
