PUBLIC HEARING - DUFFY STREET TRAIN DERAILMENT AND PIPELINE EXPLOSION Council Member Pope-Ludlam made a motion, seconded by Council Member Maudsley and unanimously carried, that the Mayor and Council hold a pUblic hearing on a non-agendized item: the Duffy Street pipeline explosion, as the decision by CAL-NEV to reopen the pipeline occurred sUbsequent to the posting of the Council Agenda for the May 31, 1989, meeting. Assemblyman Dave Elder, 57th District, Chairman of the California Assembly's Select Committee on Hazardous Materials, Pipeline, Chemical Plant and Refinery Safety, read his letter dated May 30, 1989, to United States Senators Pete Wilson and Alan Cranston supporting the City's request that CAL NEV be required to move the Duffy Street pipeline to the west side of the Southern Pacific Railroad berm. DUFFY STREET DISASTER - CONTINUATION OF PUBLIC HEARING Lynda Holcomb, 2541 Duffy Street, spoke devastating trauma and stated she did not want to neighborhoOd. regarding the return to the . Peter Brierty, Supervising Environmental Specialist for the County of San Bernardino, answered questions from the audience regarding the water table and the sodium carbonate spilled during the derailment. City Attorney Penman also answered questions. The residents of the Duffy Street disaster area were requested to form a committee and select an official spokesperson to enable city representatives to effectively communicate with the residents who are now scattered due to the disaster. GENERAL PLAN PUBLIC HEARING - FINAL ENVIRONMENTAL IMPACT REPORT This is the time and place set for discussion on the environmental impact report on the General Plan. final (la) Woodie Tescher "Finalizing Addendum Response to Comments of Envicom distributed a document entitled to the Draft Environmental Impact Report and Document". This document assesses the effects that changes to the policies and programs, identified in the draft Environmental Impact Report to mitigate impacts, may have had on the determinations and findings. The Finalizing Addendum assures that policy changes made during the review process are evaluated to determine if the finalized plan's impacts are still mitigable under the remaining modified or new policies. Additionally, the Finalizing Addendum provides responses to comments not included in the Response to Comment document and modifications to be made to previously provided responses as requested by the City staff and Environmental Review Committee. The final EIR is comprised of the draft EIR, the Responses to Comments document and the Finalizing Addendum. After certification of the EIR by the Mayor and Common Council, the components will be compiled into a single document. . Woodie Tescher explained Section II "Identification of Substantial Policy Changes to the Draft General Plan", Section III, "Reevaluation of the Environmental Impacts", Section IV, "Final Determination of the Level of Significance", and Section V, "Revisions to the Response to Comments Document". Ann Larson, Senior Planner, read a memorandum dated May 31, 1989, from Planning Director Brad Kilger entitled "Staff Recommendations on Proposed Mitigation Measures in the Draft EIR, Response to Comments Document and Finalizing Addendum". The Senior Planner explained each section of the document attached to the memorandum and presented the recommendations from staff for acceptance and/or rewording of various pOlicies and mitigation measures involving land use, housing, historical/archaeological resources, traffic circulation, water supply, hazardous material uses, noise, and biological resources. Council Member Reilly made a motion, seconded by Council Member Flores and unanimously carried, to amend the last paragraph of Subsection 4 under Section I Land Use (above document page 3) to read: "The City shall monitor economically depressed commercial corridors in the Northwest Redevelopment Project Area as well as other depressed commercial corridors. . " . . . - 7 - 5-31-89 . . . J - No further action on the above documents was taken. GENERAL PLAN TEXT AND LAND USE MAP CHANGES DATED MAY 26, 1989 Ann Larson, Senior Planner, presented a memorandum dated May 26, 1989, from Planning Director Brad Kilger, written to the Planning Commission listing substantial changes to General Plan text and the land use map that were made by the Mayor and Council as a result of the pUblic hearings. The items are listed below: Text Items A. Downtown Residential Densities The Planning Director explained that Community Development requested that the density cap for senior housing be raised from 108 to 150 in the CR-2 designation. The base of 54 units would be retained but the cap would be 150 units. The Commission concurred in this request. Council Member Reilly made a motion, seconded by Council Member Miller, to concur with the Planning Commission recommendation and raise the cap from 108 to 150 units in the CR-2 designation. The motion carried by the following vote: Ayes: Members Reilly, Maudsley, Minor, Pope-Ludlam, Miller. Council Member Flores. Absent: Council Member Estrada. Council Noes: B. Extension of Commercial Uses into Residential Areas The Planning Director stated that the Commission rejected the Mayor and Common Council's decision to permit commercial uses only for parking to extend into residential areas where the uses would not be a detriment to the residential neighborhood. The Commission was concerned that there would be a problem with control and would only consider expansion of parking into residential areas along major corridors. Woodie Tescher of Envicom suggested a CUP process to control encroachment of parking into residential. Council Member Reilly made a motion, seconded by Council Member Miller and unanimously carried, to amend the text to permit expanded parking into residential areas through the CUP and design review process. (Sections 1.20.30 and 1.22.30) C. Relationship to Open Space (adopted by Commission) On May 20, 1989, the Mayor and Council adopted a memo dated May 16, 1989, from the Planning staff regarding open space. The Commission concurred. No action of the Council was required. - 8 - 5-31-89 . D. RU Expansion . At a previous meeting the Council expanded the RU designation to allow duplexes on parcels greater than 6,200 square feet in defined downtown areas. This action allowed development on existing sub-standard lots. The Council approved in concept RU-I and RU-2 designations. The RU-1 designation reflected the existing RU designation. The RU-2 allowed duplexes on 6,200 square foot lots in designated areas. When this was presented to the Planning Commission, some members rejected the Mayor and Council's decision because of the desirability of encouraging consolidation of lots for new development. The Commission remained split on a three-three vote. The action of the Council stands. Land Use Map Items A. The Planning Commission concurred in the Council's decision to designate the west side of Waterman from 23rd Street to 27th Street from RS to RU to reflect existing duplexes; also from RS to CO-1 from Alexander to 29th Street. The Council was not required to take another action. . B. An 80 acre site bounded by Base Line to the north, Seventh Street to the south, Arrowhead Avenue to the west and Waterman Avenue to the east is shown as RU on the Land use map. However, it is addressed in Alternative "H" of the EIR for RM density. Council Member Reilly made a motion, seconded by Council Member Miller and unanimously carried, to leave the area RU as originally proposed. C. RU-2: Council Member designation in Waterman Avenue Council Member Reilly made a motion, seconded by Miller and unanimously carried, to give an RU-2 areas bordered by Highland Avenue, Fifth Street, and the 1-215 Freeway. Eiqhth and Western Ken Henderson, Director of Community Development, stated that a senior citizen project near Casa Ramona on Eighth Street needs an increase in density to be successful. Council Member Miller and a motion, seconded by Member Pope-Ludlam and unanimously carried, that the 2.5 the southwest corner of Eighth Street and the west Western be designated RMH at 24 units per acre. Reconsider Sixth and Sterlinq - Cohen Council Hember Estrada made a motion, seconded by Council Hember Pope-Ludlam, that the designation for the northeast corner of Sixth and Sterling be reconsidered. (See Page 10) The motion carried by the fOllowing vote: Ayes: Hembers Estrada, Reilly, Pope-Ludlam, Hiller. Noes: Hember Flores, Hinor. Absent: Council Hember Haudsley. Council Council Council Hember Estrada made a motion, seconded by Council Hember Pope-Ludlam, that the property be designated as follows: RHH-15 in 20 acres bounded by Sixth Street on the south, Cyprus on the north, and the extensions of Newcomb and HcKinley Streets on the west and east. OIP for the property bounded by Sixth Street on the south, Sterling on the west and the extension of Newcomb Street on the east. Council Council Reconsider southeast corner of Ninth and Arrowhead - Skipper (33) Council Hember Estrada made a motion, seconded by Council Hember Reilly and unanimously carried, that the request of Ron Skipper for RHH at the southeast corner of Ninth and Arrowhead be reconsidered. On Hay 20, 1989, the Council designated this parcel RH. The Planning Commission had recommended RHH 20. Council Hember Estrada made a motion, seconded by Council Hember Miller, that the property be designated RHH 20. The motion carried by the following vote: Ayes: Council Members Estrada, Reilly, Flores, Pope-Ludlam, Hiller. Noes: Council Member Minor. Absent: Council Hember Haudsley. RECONSIDER TABLE IA - RELATIONSHIP TO OTHER PLANS Table IA on page 6 of the text shows the relationship of various documents to the General Plan. Council Member Flores made a motion, seconded by Council Member Reilly and unanimously carried, that the RDA plans still be designated under the "Incorporated by reference" column of Table IA but the paragraph to the right be amended to read as follows: "General Plan will incorporate land use provisions of RDA plans as now existing and as may from time to time be amended provided that in the event of a conflict the land use provisions of the General Plan (and not the RDA plan land use provisions) shall control. COUNCIL MEMBER POPE-LUDLAM EXCUSED Council Member Pope-Ludlam left the Council Table. Southeast corner of Belmont and Palm - Gipson (57) Council Member Minor made a motion, seconded by Council Member Flores and unanimously carried, that the previous action designating the southeast corner of Belmont and Palm be reconsidered. On May 23, 1989 (Page 15 of the minutes) the Council concurred with a Planning Commission recommendation to expand an RE designation to cover the southeast corner of Belmont and Palm Avenues. Mr. Gipson had requested a higher density: RL. Council Member Minor made a motion, seconded by Council Member Flores and unanimously carried, to change the RE designation to RL for property south of WaShington Street bordered by the flood control channel, east to the property lines next to Verdemont Villas (the two parcels on the east side of Palm south of Washington to the flood control channel) Brvant and Allen area adiacent to Hernandez Center Estrada and Robertson - (B15 and 73) Based on neighborhood support of a duplex project in the area, Council Member Estrada made a motion, seconded by Council Member Minor and unanimously carried, to reconsider action taken on May 20, 1989, concerning property located adjacent to Hernandez Center. RES. 89-158 - RESOLUTION OF THE CITY OF SAN BERNAR- DINO REQUESTING THE GOVERNOR TO PROCLAIM A STATE OF EMERGENCY. Absent: Council Members adopted by the Reilly, Flores, Maudsley, Pope- DUFFY STREET PIPELINE EMERGENCY MEASURES Council Member Flores made a motion, seconded by Council Member MInor and unanimously carried, that the Mayor be instructed to forward the above resolutions to area legislators and request their support to get the pipeline moved west of the Southern Pacific Railroad tracks. Council Member Estrada made a motion, seconded by Council Member Minor and unanimously carried, that the area 500 feet from the tracks as outlined on a map of the disaster area be designated a hazardous area based upon the criteria established by the Department of Transportation Hazardous Materials Manual and based upon a memorandum dated May 31, 1989, from the Acting City Administrator, and that residents be allowed to re-enter . that area only to get belongings.
