The City Clerk has caused to be posted the Notice of Adjournment of said meeting held at 9:20 a.m.. Monday, August 3, 1987, and has on file in the Office of the City Clerk an Affidavit of said posting, together with a copy of said Order, which was posted at 11:30 a.m.. Tuesday, August 4, 1987, in a conspicuous place on the door of the place at which the meeting of August 3, 1987, was held. The Adjourned Regular Meeting of the Mayor and Common Council of the City of San Bernardino was called to order by Mayor wilcox at 9:10 a.m.. Friday, August 7, 1987, in the Council Chambers of City Hall, 300 North "0" Street, San Bernardino, California. INVOCATION The Invocation was given by Phil Arvizo, Executive Assistant to the Council. PLEDGE OF ALLEGIANCE The Pledge of Alleg iance was led by Counc i 1 Member Estrada. COMMENTS BY GENERAL PUBLIC were no brief comments made by the general READING AND WAIVING OF RESOLUTIONS City Clerk Clark read the titles of all of the reso- lutions on the Agenda. Council Member Estrada made a motion, seconded by Council Member Miller and unanimously carried, that fur- ther reading of the resolutions be waived. RES. 87-267 RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORI ZING THE EXECUT ION OF AN AGREEMENT WITH ENVICOM CORPORATION TO PROVIDE CONSULTANT SERVICES FOR THE COMPLETION OF THE COMMUNITY GENERAL PLAN. (Continued from August 3, 1987) (1) Council Member Reilly made a motion, seconded by Council Member Miller and unanimously carried, that said resolution be adopted. ONE. (Continued from August 3, 1987) (5) Council Member Estrada made a motion, seconded by Council Member Flores and unanimously carried, that said resolution be adopted. RES. 87-269 - RESOLUTION OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION NO. 6413 ENT ITLED IN PART, "RESOLUT ION. . . ESTABLISHING A BASIC COMPENSATION PLAN . . ."; AND PROVIDING A 5 PERCENT PAY IN- CREASE FOR THE CLASS OF SENIOR COMPANION PROGRAM COORDINATOR RETROACTIVE TO JULY 6, 1987, AND PROVIDING A PAY INCREASE FOR THE PART-TIME CLASS OF EXTRA RELIEF HEAVY LABORER FROM $4.4000/HR. TO $5. 0000/HR., EFFECTIVE AUGUST 3, 1987. (Continued from August 3, 1987.) COUNCIL MEMBER POPE-LUDLAM EXCUSED Council Member Pope-Ludlam left the Council Meeting. FISCALINI FIELD NOISE LEVEL - CONTINUED FROM AUGUST 3, 1987 This is the time and place set for discussion of the noise level resulting from San Bernardino Spirit Baseball Club, Inc. games at Fiscalini Field in Perris Hill Park. (2 & 4) On July 27, 1987, the Mayor and Common Council made a public announcement that the Mayor was authorized by the Common Council to direct the Parks, Recreation and Com- munity Services Department that upon expiration of 72 hours after notice to the San Bernardino Spirit Baseball Club, Inc. regarding excess noise levels at Fiscalini Field, and if no appeal is filed by the San Bernardino Spirit Baseball Club to the Mayor and Common Council, that a supervisor monitor the noise level from the surrounding neighborhood. If the noise level is found to be too high, the Police Department is instructed to assist the Parks, Recreation and Community Services supervisor in turning down the volume once; if the volume is again raised, they will return to the ballpark and remove the sound box and microphone. 2 8/7/87 In a letter dated July 29, 1987, Bruce Englebrecht, attorney representing the San Bernardino Baseball Club, Inc., appealed the action taken by the Mayor and Common Council, as the Spirit has taken steps to abate the nuisance by reducing the noise level of the sound system to a level that will not unreasonably disturb the quiet enjoyment of the neighboring residents. At the August 3, 1987, meeting of the Mayor and Com- mon Council, the appeal made by the San Bernardino Base- ball Club, Inc. was denied. In a memorandum dated August 6, 1987, Annie Ramos, Director of the Parks, Recrea t i on and Communi ty Serv ices Department, provided the recommendation of the Consultant Review Committee, which is comprised of neighborhood rep- resentatives and herself. Ray Schweitzer, City Administrator, requested autho- rization to enter into a contract with the recommended consultant, J. J. Van Houten & Associates, Inc. to provide noise assessment regarding the baseball games and related events at Fiscalini Field, in an amount not to exceed $13,890.00. Jack Nelson, 2303 Newport Avenue, San Bernardino, a neighborhood representative, answered questions regarding the process used for choos i ng a consul tan t, and the ser- vices to be rendered. James Penman, City Attorney, answered questions re- garding contracting the consultant. Council Member Minor made a motion, seconded by Coun- cil Member Miller and unanimously carried, that the Mayor be authorized to enter into a contract, not to exceed $13,890.00, with J. J. Van Houten and Associates, Inc. for consultant services for the Fiscalini Field noise problem; and that the City Attorney be directed to prepare a reso- lution to ratify the contract. City Attorney Penman stated that by the Council action taken, the contract would be drawn up and work could proceed without any further Council action. Mayor wilcox thanked the neighborhood representatives for their participation in resolving the noise problem at Fiscalini Field. VACATION OF ALLEY - WEST OF MT. VERNON AVENUE, NORTH OF EVANS STREET - REQUEST FOR WAIVER OF FEES - CONTINUED FROM AUGUST 3, 1987 In a memorandum dated July 29, 1987, Council Member Pope-Ludlam requested that the $400 fee for the proposed vacation of an alley west of Mt. Vernon Avenue and north of Evans Street, be waived. (7) Council Member Miller made a motion, seconded by Council Member Reilly and unanimously carried, that the proposed vacation of an alley west of Mt. Vernon Avenue, north of Evans Street, be referred to the Ways and Means Committee for their review. USE OF EQUIPMENT - OUR LADY OF GUADALUPE COMMITTEE - CONTINUED FROM AUGUST 3, 1987 This is the time and place continued to for consi- deration of a request from Our Lady of Guadalupe Committee to utilize a section of bleachers and a portable stage or two flatbed trailers for a fiesta to be held August 16, 1987. (9) 3 8/7/87 Annie Ramos, Director of the Parks, Recreation and Community Services Department, answered questions regard- ing the normal fee charged for rental of equipment and whether the request from Our Lady of Guadalupe Committee included a request for a waiver of fees. Council Member Estrada made a motion, seconded by Council Member Reilly and unanimously carried, that the matter concerning rental of equipment by Our Lady of Guadalupe Committee be continued until later in the meeting. SPECIAL MEETING - REDEVELOPMENT AGENCY/ DEVELOPMENT COMMISSION - APPOINTMENT, EMPLOYMENT, EVALUATION OF PERFORMANCE OR DISMISSAL OF PUBLIC EMPLOYEES Mayor wilcox read the following statement taken by the Community Development Commission Session as result of the Special Meeting: of action in Closed The Community Development Commission recessed to Closed Session to consider the appointment/employment evaluation performance or dismissal of a public employee. The Commission did discuss the performance and evaluated the Executive Director of the Redevelopment Agency, and have voted to retain the services of the Executive Direc- tor. The other action taken was to refer the policies and procedures of the Redevelopment Agency to the Redevelop- ment Committee for recommendation as to changes, etc., to the full Commission. Absent: Council Member Maudsley. 5 8/7/87 JOINT USE OF NORTON AIR FORCE BASE - GRANT ASSISTANCE APPLICATION - AIRPORT MASTER PLAN - CONTINUED FROM AUGUST 3, 1987 In a memorandum dated July 27, 1987, Glenda Saul, Execu ti ve Director of the Redevelopment Agency, prov ided information regarding the possible joint use of Norton Air Force Base to accommodate civilian air operations. (R-3 ) In order to pursue the joint use of the air base, an Airport Master Plan is necessary. Airport Improvement Program (AlP) grant monies are available from the Federal Aviation Administration for 90% of the cost of this type of venture. Council Member Estrada made a motion, seconded by Council Member Flores and unanimously carried, that sub- mittal of an application to the Federal Aviation Admini- stration for grant funds for the preparation of an Airport Master Plan relating to the joint use of Norton Air Force Base, be approved. READING AND WAIVING OF RESOLUTIONS ON REDEVELOPMENT AGENCY AGENDA City Clerk Clark read the titles of the resolutions on the Redevelopment Agency Agenda. Council Member Reilly made a motion, seconded by Council Member Flores and unanimously carried, that fur- ther reading of the resolutions be waived. RES. 87-270 - RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNAR- DINO, CALIFORNIA, AUTHORIZING AND DIRECT- ING THE EXECUTION OF AN AGREEMENT FOR PROFESSIONAL SERVICES IN CONNECTION WITH WIDENING OF 1-215 UNDERCROSSING IN THE STATE COLLEGE PROJECT AREA. (R-4C) Council Member Flores made a motion, seconded by Counc il Member Re illy and unanimously carr ied, that sa id resolution be adopted. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, CALIFORNIA, AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE AN URBAN DEVELOPMENT ACTION GRANT AGREEMENT IN CONNECTION WITH A PROPOSED SUPERMARKET TO BE DEVELOPED AT BASELINE AND MEDICAL CENTER DRIVE LOCATED IN THE NORTHWEST REDEVELOPMENT PROJECT AREA. (R-6) Glenda Saul, Executive Director of the Redevelopment Agency, expressed concern regarding the contract as sub- mitted, stating that the concerns can be resolved. Tim Saba, Agency Counsel, recommended that the agree- ment be approved, as there will be ample opportunity for amendments. 6 8/7/87 Glenda Saul answered questions regarding the acquisi- tion of land for the project. James Penman, City Attorney, recommended a closed session discussion of the agreement, as there is threatened litigation regarding the supermarket project. Council Member Reilly made a motion, seconded by Council Member Flores and unanimously carried, that the resolution be deferred to later in the meeting after Closed Session. COUNCIL MEMBER MAUDSLEY RETURNED At 2:30 p.m., Council Member Maudsley returned to the Council Meeting and took his place at the Council Table. (See Page 4) (9) Council Member Estrada made a motion, seconded by Council Member Reilly and unanimously carried, that Our Lady of Guadalupe Committee be provided with a section of bleachers and a portable stage or two flatbed trailers for use at the August 16, 1987 Fiesta, based upon a finding that the rental fee would create a financial hardship, jeopard i zing the even t planned for such use, and tha t the event will be of unusual benefit to the inhabitants of the City and should be supported with public funds. BRIEF COMMENTS BY GENERAL PUBLIC - NOISE PROBLEM AT FISCALINI FIELD - SAN BERNARDINO SPIRIT BASEBALL CLUB Virginia Nelson, 2302 Newport Avenue, San Bernardino, read from a prepared statement concerning the noise ex- perienced in the neighborhood surrounding Fiscalini Field, perris Hill Park, as result of San Bernardino Spirit Base- ball Club games. (A) She requested that the Mayor and Common Council clarify their previous action to have supervisors of the Parks, Recreation and Community Services Department in the neighborhood in order to ascertain if the sound from Fis- calini Field is too loud and disturbing in the surrounding neighborhood. James Penman, City Attorney, answered questions re- garding the amount of discussion and Council action allow- able at Council Meetings under the Brown Act, regarding subjects broached during time allotted on the Council Agenda for brief comments by the general public. Shauna Clark, City Clerk, stated that meeting is considered a Recessed Meeting from of August 7, 1987, at which time the noise Fiscalini Field was on the Council Agenda. the present the meeting problem at Dennis Barlow, Senior Assistant City Attorney, stated tha t under the Brown Act, i terns placed on the Counc i I Agenda may be reheard on recessed meeting dates. City Attorney Penman recommended that no action be taken at the recessed meeting regarding the noise problem at Fiscalini Field, as a representive from the San Ber- nardino Spirit Baseball Club was not present. Interpretation of the Council directive, and events occurring at the San Bernardino Spirit Baseball Club games held during the previous weekend, were discussed. John Kramer, Acting Director of the Parks, Recreation and Community Services Department, answered questions regarding action taken during the previous weekend games. He stated the willingness of the Parks, Recreation and Community Services Department to follow any directive and guidelines authorized by the Mayor and Common Council. COUNCIL MEMBER POPE-LUDLAM ARRIVED At 2: 53 p.m., Council Member Pope-Ludlam arrived at the Council Meeting. Sharon Brouse, resident of the neighborhood surround- ing Fiscalini Field, spoke regarding the noise level ex- perienced during the previous weekend, and action taken by employees of the Parks, Recreation and Community Services Department. Council Member Miller made a substitute motion, seconded by Council Member Pope-Ludlam, that the Police Department Budget be approved in the amount of $17,451,882, with the understanding that a position of lieutenant and sargeant, which are expected to become vacant, would not be filled.
