The City Clerk has caused to be posted the Notice of Adjournment of said meeting held at 9:00 a.m., Friday, July 10, 1987, and has on file in the Office of the City Clerk an Affidavit of said posting together with a copy of said Order which was posted at 5:00 p.m., Friday, July 10, 1987, in a conspicuous place on the door of the place at which the meeting of July 10, 1987, was held. The Adjourned Regular Meeting of the Mayor an Common Council of the City of San Bernardino was called to order by Mayor Pro Tempore Miller at 8:13 a.m., Monday, July 13, 1987, in the Management Information Center (MIC Room), Sixth Floor, City Hall, 300 North "D" Street, San Bernar- dino, California. ROLL CALL Roll Call was taken by Deputy City Clerk South with the following being present: Mayor Pro Tempore Miller; Council Members Reilly, Flores, Maudsley, Minor, Miller; Deputy City Clerk South, City Administrator Schweitzer. Absent: Mayor Wilcox; Council Members Estrada, Pope- Ludlam; City Attorney Penman. BRIEF COMMENTS BY GENERAL PUBLIC There were no comments by the general public. (A) BUDGET - FISCAL YEAR 1987/88 This is the time and place set for the budget for the Fiscal Year 1987/88. consideration of (1) James Robbins, Deputy the proposed budget, and balancing the budget. Ci ty Administrator, recapped provided recommendations for MAYOR WILCOX ARRIVED At 8:22 a.m., Mayor Wilcox arrived at the Council Meeting. Roger Hardgrave, City Engineer, made a presentation regarding the Capital Improvement Fund, and answered ques- tions of the Mayor and Common Council. In a memorandum dated July 10, 1987, Roger Hardgrave, City Engineer, provided information regarding the Street Construction Fund Budget, which totaled slightly over $6 million, and listed projects that the City is committed to complete, and projects which are considered essential. He stated that $189,200 is expected to be available from Local Transportation Funds (SB 325), which can be used to provide the Local Agency's share. 1 7/13/87 The Mayor and Common Council requested that the City Engineer research the contractual agreement with Cliff Carel regarding the Third Street Bridge project. Discussion ensued regarding the use of future monies from the 1/2 cent sales tax for street improvements. Council Member Minor made a motion, seconded by Coun- cil Member Miller and unanimously carried, that the trans- fer of $19,371 from Account No. 242-362-57332, "Meridian Avenue Grade Crossing," $11,750 from Account No. 242-362- 336, "Marshall and "E" Traffic Signals," and $38,800 from Account No. 242-362-57362, "Highland and Palm Traffic Signals," to the unappropriated reserves in the Street Construction Fund, be approved. COUNCIL MEMBER POPE-LUDLAM ARRIVED At 9: 05 a.m., Council Member Pope-Ludlam arrived at the Council Meeting. City Engineer Hardgrave answered questions regarding areas of the City in critical need of repair. CITY ATTORNEY PENMAN At 9:07 a.m., City Council Meeting. ARRIVED Attorney Penman arrived at the Ci ty Eng ineer Hardgrave answered questions regard ing projects that could be taken out of the proposed budget, as they are in the building moratorium area. He also answered questions regarding the installation of a pipe in Del Rosa Avenue, near 39th Street, to take care of the drainage problem at that location, and the use of funds previously earmarked for projects in the building moratorium area. The Mayor and Common Council requested that the City Engineer provide further information regarding the drain- age problem on Del Rosa Avenue during the afternoon ses- sion of the meeting. (See Page 3) RECESS MEETING - CLOSED SESSION At 9: 21 a.m., Council Member Flores made a motion, seconded by Council Member Reilly and unanimously carried, that the meeting recess to Closed Session pursuant to Government Code Section 54956.9 (b) (1), to discuss pending litigation. BUILDING HEIGHT LIMIT IN COMMERCENTER AREA - AMENDING MUNICIPAL CODE SECTION 19.30.010 AND PROVIDING FUNDS FOR CONSULTANT In a memorandum dated July 10, 1987, Ann Siracusa, Planning Director, provided information concerning the proposed amendment of Municipal Code Section 19.30.010, regarding building height limitations in the Commercenter area, and her request for an allocation of $10,000 to retain a consultant. (S-2) At the July 6, 1987, meeting of the Mayor and Common Council, the Planning Department was directed to initiate proceedings to consider the amendment of Municipal Code Section 19.30.010, that in the Commercenter Area only, the height limit shall be 62 feet. City Attorney Penman stated that he had met with Planning Director Siracusa to discuss concerns regarding pending projects in the Commercenter area for which developers have requested greater building height allow- ances, and the need for an amendment to Municipal Code Section 19.30.010 in order to facilitate these requests. Council Member Flores made a motion, seconded by Council Member Reilly and unanimously carried, that a study of the building height limit in the Commercenter area, covered under Munic ipal Code Section 19.30.010, be authorized, contingent upon funding being available from the Redevelopment Agency or that the developer is agree- able to paying for the consultant; that the study include the flight patterns in the area, and that if funding re- quirements are met, this matter need not come back before the Mayor and Common Council in order to proceed with the hiring of the consultant. BUDGET - FISCAL YEAR 1987/88 - DRAINAGE PROBLEM ON DEL ROSA AVENUE NEAR 39TH STREET - CONTINUED FROM EARLIER IN MEETING This is the time and place continued to for consi- deration of the budget for the Fiscal Year 1987/88 and allocation of funds to correct the drainage problem on Del Rosa Avenue near 39th Street. (See Page 2) (1) COUNCIL MEMBER POPE-LUDLAM RETURNED At 10:40 a.m., Council Member Pope-Ludlam returned to the Council Meeting. In a memorandum dated February 10,1987, City Engi- neer Hardgrave provided a preliminary estimate of costs for the control of surface spring water on Del Rosa Drive from Foothill Drive to a point north of Foothill Drive. The Mayor and Common Council discussed the history of the water drainage problem on Del Rosa Avenue. Council Member Maudsley made a motion, seconded by Council Member Miller and unanimously carried, that the City Engineer be instructed to prepare a firm estimate of the costs involved to install a drainage pipe to solve the water drainage problem on Del Rosa Avenue near Foothill Boulevard and 39th Street; and that funds for the project be allocated from previously budgeted projects, which are now involved in the building moratorium area. BUDGET - FISCAL DEPARTMENT Warren Knudson, proposed budget and a Finance Department. YEAR 1987/88 - FINANCE Director of Finance, presented the 10 Year Expend i ture Summary for the (1 ) He answered questions concerning data processing costs, trends of sales tax producers, and garage charges. CITY ATTORNEY PENMAN RETURNED At 11:20 a.m., City Attorney Penman returned to the Council Meeting. Ci ty Treasurer Graves answered questions regard ing data processing costs. RECESS MEETING At 11:20 a.m., the meeting was recessed in order that a representative from the Data Processing Division may be present. The Mayor and Common Council requested that a spread sheet report be made to show the distribution of charges for data processing. CLAIM - REIMBURSEMENT TO WESTS IDE COMMUNITY DEVELOPMENT CORPORATION FOR PROPERTY DAMAGE This is the time and place set for consideration of a claim from the Westside Community Development Corporation for sewer back-up and water damage to their offices. (5 ) City Attorney Penman stated that although this agenda item had been set for Closed Session discussion, since a Council Member is the owner of the Westside Community Development Corporation, discussion regarding the claim should be held in open session to avoid the appearance of a conflict of interest. Council Member Pope-Ludlam stated that she would abstain from discussion and voting on this item due to a potential conflict of interest, as she is the owner of the Westside Community Development Corporation. City Attorney Penman stated for the record that the claim for sewer damages to the Westside Community Develop- ment Corporation offices was submitted to the City of San Bernardino prior to Council Member Pope-Ludlam assuming the office of Council Member representing the Sixth Ward on June 1, 1987. Deputy City Attorney Wilson provided a copy of his memorandum dated June 9, 1987, to City Attorney Penman, regarding Claim 86B-135 from the Westside Community Development Corporation. City Attorney Penman answered questions regarding the handling of the claim. COUNCIL MEMBER POPE-LUDLAM EXCUSED Council Member Pope-Ludlam left the Council Meeting. Deputy City Attorney Wilson answered questions re- garding the requested amount of payment for damages by Westside Community Development Corporation. Manuel P. Moreno, Jr., Director of Public Services, answered questions regarding the procedure followed by his department when called upon to clean up sewage back-up, and the manner in which determination is made as to Ci ty responsibility. City Attorney Penman requested that strator ensure that waivers be signed by claims are paid. the City Admini- claimants before 7 7/13/87 ,- Council Member Maudsley made a motion, seconded by Council Member Miller and unanimously carried, that the City pay the claim for cleaning the sewage back-up; that the claimant obtain bids from two local carpet instal- lation firms; that the Risk Management Department select the lowest bid and replace the carpet as to like kind, quality, and installation, and that a release be obtained before the damages are paid. MEMBER POPE-LUDLAM RETURNED TO THE MEETING Member Pope-Ludlam returned to the Council VARIANCE - HIRING FREEZE - 15 PART-TIME EXTRA RELIEF HEAVY LABORERS - PUBLIC SERVICES DEPARTMENT In a letter dated July 6,1987, Manuel P. Moreno, Jr., Director of Public Services, requested a variance to the Hiring Freeze in order to consider the hiring of 15 part-time Extra Relief Heavy Laborers to provide vacation relief for permanent employees of the Refuse Section of the Public Services Department. (2) Council Member Reilly made a motion, seconded by Council Member Minor and unanimously carried, that the request for a var iance rela ti ve to the hi ring freeze for 15 part-time Extra Relief Heavy Laborers for the Public Services Department, be granted. RECONVENE MEETING At 4:02 p.m., the Adjourned Regular Meeting of the Mayor and Common Council of the City of San Bernardino reconvened in the Management Information Center (MIC Room), Sixth Floor, City Hall, 300 North "D" Street, San Bernardino, California. Absent: Council Member Estrada. BUDGET - FISCAL YEAR 1987/88 Ken Henderson, Director of Community presented a list of Revenue Generators and for the Fiscal Year 1987/88 as proposed heads. Development, Cost Savings by department (1 ) He answered quest ions regard ing the proposed Ren tal Inspection Fee by the Building and Safety Department. Manuel P. Moreno, Jr., Director of Publ ic Services, answered questions regarding his department's involvement in condemning and boarding up properties. Ray Schweitzer, City Administrator, answered ques- tions reg ard ing the proposed Publ ic Documen ts Fee by the City Clerk's Office. The Mayor and Common Council discussed fees for Site Plan Review for Conformance with Zoning Ordinances, MC Section 2.64 Appeals, Surcharge for Environmental Reviews of Specific Areas for Developments Benefitting from Master EIR as proposed by the Planning Department. 8 7/13/87 DEPUTY CITY CLERK SOUTH EXCUSED At 4:20 p.m., Deputy City Clerk South Council Meeting and was replaced by Deputy Reese. left the Ci ty Clerk Ken Henderson, Director, Community Development De- partment, answered questions regarding the surcharge for environmental reviews of specific areas for developments benefitting from Master EIR. The Mayor and Counc i 1 agreed tha t the three sugges- tions regarding increase of fees by the Planning Depart- ment, as listed above be referred to staff and the Ways and Means Committee before coming back to the Council. Ken Henderson, Director, Community Development De- partment, presented suggestions from the Public Works Department regarding an increase in pre-engineering site approval fees and engineering fees. Mr. Henderson presented suggestions from the Parks, Recreation and Community Development Department regarding possible admission fees to special events in City parks. City Attorney Penman answered questions regarding the legality of exempting City residents from paying admission fees to City parks, stating that the Courts had struck down such requests. The Council did not approve further study of this issue. The Mayor Guard program, School District and Council discussed the School Crossing and the possibility of requesting the to assume responsibility for this program. City Administrator Schweitzer answered questions regarding San Bernardino County's part in the Crossing Guard Program. He also spoke of the possible use of Fines and Forefeitures for this program. Director of Finance Knudson agreed to have a report back regarding County charges for their part in the Cross- ing Guard Program. The Mayor tax of 10% ($576,167) and Council discussed a proposed amusement on businesses providing entertainment. Director of Finance Knudson answered questions re- garding the amusement tax, stating that most cities that charge entertainment tax have special events, such as race tracks, Rose Bowl and the Forum. He also stated that questions have been raised in the past by local theatre owners who fel t that an amusement tax on thea ters was illegal. The Mayor and Council discussed whether or not to include video rental stores in the amusement tax proposal. The amusement tax proposal was referred to the Ways and Means Committee for further study. The Mayor and Council discussed two of the items presen ted by the Publ ic Works/Eng ineeri ng Department for estimated income: Anticipated rebate from Edison for overbilling for street lights not actually in operation ($40,000); and Reduction in amount budgeted for street light electrical energy charges due to reduction in number of lights billed by Edison ($25,000). 9 7/13/87 The Mayor and Council discussed whether or not these figures were a one-time amount, or an annual payment, and referred them to City Administrator Schweitzer for further study. The Mayor and Council discussed another proposal from Publ ic Works/Eng ineeri ng regard ing one-half of proposed traffic impact fee to cover traffic engineering personnel cost for development, review and installation of new traf- fic operations control devices to improve capacity. ($150,000) . City Administrator Schweitzer answered questions, and stated there is no such fee presently, and should be de- termined as a policy decision. This proposal will be studied by City Administrator Schweitzer, Director of Public Works/City Engineer Hard- grave and Assistant City Engineer Klatt and then referred to the Ways and Means Committee. The Mayor and Council discussed a suggested service fee of $0.50 per month for each parcel in City for opera- tion and maintenance of street lights (either placed on water bill like sewer services charge, or City-wide as- sessment district). ($420,000) City Administrator Schweitzer and Director of Finance Knudson answered questions regarding possible methods to implement such a service fee and ways to set up an assess- ment district. The Mayor and Council discussed the suggestion to include subdivision at northeast corner of Kendall Drive and 48th Street in assessment district for landscape main- tenance. ($3,500) City Administrator Schweitzer will study all the assessment districts in the City. The Mayor and Council discussed the proposal to the bed tax from 8% to 10%. 10% is presently charged in Montclair and Rancho Cucamonga. All neighboring cities charge 8%. ($25,000) raise being other Mayor Wilcox indicated she was opposed to this pro- posal No further action was taken. The Mayor and Council discussed Public Services proposals to initiate a street sweeping fee of $1.00 per month on residential and $0.10 per cubic yard on commer- cial, to be included in trash bill ($400,000); and a storm drain usage fee of $0.50 per month per household. ($323,000) Manuel Moreno, Director of Public Services, answered questions and described some of the problems encountered in the street sweeping program. ($300,000) The Mayor and Council indicated interest in two pro- posals by the Building & Safety Department regarding com- prehensive zoning enforcement program where citations are issued and fines collected administratively, depending on type of program and amount of fines ($400,000); and Certi- ficate of Occupancy increase fee from $30.00 to $50.00. ($28,800) Fire Chief Newcombe stated ways to provide sufficient funds of San Bernardino a safe City in tha t the Ci ty must fi nd to prov ide the c i ti zens which to live.
