The City Clerk has caused to be posted the Notice of Adjournment of said meeting held at 9:05 a.m., Monday, June 8, 1987, and has on file in the Office of the City Clerk an Affidavit of said posting, together with a copy of said Order, which was posted at 11:00 a.m., Tuesday, June 9, 1987, in the Council Chambers of City Hall, 300 North "0" Street, San Bernardino, California. The Adjourned Regular Meeting of the Mayor and Common Council of the City of San Bernardino was called to order by Mayor Pro Tempore Mi ller at 1: 20 p. m., Thursday, June 11, 1987, in the Management Information Center (MIC Room), Sixth Floor, City Hall, 300 North "0" Street, San Bernar- dino, California. ROLL CALL Roll Call was taken by the Ci ty Clerk wi th the fol- lowing being present: Mayor Pro Tempore Miller; Council Members Estrada, Reilly, Flores, Maudsley, Minor, Miller; City Attorney Penman, City Clerk Clark, City Administrator Schwei tzer. Absen t: Mayor Wi lcox; Counc i 1 Member Pope- Ludlam. PUBLIC COMMENTS There were no comments made by the public. (A) BUDGET HEARINGS This is the time and place set for the Fiscal Year 1986/87. for Budget Hearings (1 ) Jim Robbins, Deputy City Administrator, answered questions regarding Utility Tax, stating that it was brought into effect at 6% in September, 1968, and that an increase was made to 8% in October, 1983, which was con- sistent with an increase in police personnel. A chart reflecting possible changes in order for the budget to balance was presented. City Attorney Penman requested that the Common Council recess to Closed Session due to litigation requiring his presence. Mayor and impending RECESS MEETING - CLOSED SESSION At 1:25 p.m., Council Member Flores made a motion, seconded by Council Member Miller and unanimously carried, that the meeting be recessed to Closed Session pursuant to Government Code Section 54956.9 (a), to discuss pending litigation to which the City is a party. The title of the litigation is Saldecke, et al. v. City of San Bernardino, et aI, San Bernardino Superior Court Case No. 236836. CLOSED SESSION Mayor Pro Tempore Miller called the Closed Session to order in the Management Information Center (MIC Room), of the Sixth Floor, City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll Call was taken with the following being present: Council Members Estrada, Reilly, Flores, Maudsley, Minor, Miller; City Attorney Penman, City Clerk Clark. Absent: Mayor Wilcox; Council Member Pope-Ludlam; City Administra- tor Schweitzer. Also present: Deputy City Attorney Cynthia Grace. MAYOR WILCOX ARRIVED At 1:26 p.m., Mayor wilcox arrived at the Closed Session. COUNCIL MEMBER POPE-LUDLAM ARRIVED At 1:28 p.m., Council Member Pope-Ludlam arrived at the Closed Session. COUNCIL MEMBER ESTRADA EXCUSED At 1:45 p.m., Council Member Estrada left the Closed Session. ADJOURN CLOSED SESSION At 2:00 p.m., the Closed Session of the Mayor and Common Council of the City of San Bernardino adjourned to the Adjourned Regular Meeting in the Management Informa- tion Center (MIC Room), of the Sixth Floor of City Hall, 300 North "D" Street, San Bernardino, California. RECONVENE MEETING At 2:00 p.m., the Adjourned Regular Meeting of the Mayor and Common Council of the City of San Bernardino reconvened in the Management Information Center (MIC Room), of the Sixth Floor, City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll Call was taken by the City Clerk with the fol- lowing being present: Mayor Wilcox; Council Members Reilly, Flores, Maudsley, Minor, Pope-Ludlam, Miller; City Clerk Clark, City Administrator Schweitzer. Absent: Coun- cil Member Estrada; City Attorney Penman. BUDGET HEARINGS - CONTINUED FROM EARLIER IN MEETING This is the time and place continued to for Budget Hearings for the Fiscal Year 1986/87. (1) Warren Knudson, Director of Finance, answered ques- tions regarding annual fees paid by the City. Jim Robbins, questions regarding out" figures listed Deputy City Administrator, answered the computation of the "transferred in the proposed budget. Warren Knudson, Director of Finance, spoke regarding the cost of liability insurance. He answered questions regarding the amount of money budgeted for outside legal counsel. A revision showing reduced figures for outside legal counsel will be made before the next meeting of the Mayor and Common Council. Ray Schweitzer, City Administrator, stated that the budget financial sheets were compiled in April, 1987. 2 6/11/87 Director of Finance Knudson explained the Parks, Recreation and Community Services fund. The Mayor and Common Council discussed salaries of City personnel, and the costs of materials used by the City and services provided by the City. Alternative measures to decrease the budget deficit by raising additional funds were discussed. Ray Schweitzer, City Administrator, warned the Mayor and Common Council of problems that arise when street maintenance is deferred. Mayor Wilcox stated that code enforcement and street maintenance were two of her priorities. CITY ATTORNEY PENMAN RETURNED At 2:45 p.m., City Attorney Penman returned to the Council Meeting. BUDGET - CITY CLERK'S OFFICE This is the time and place set for the 1986/87 Fiscal Year Budget for Office. consideration of the City Clerk's (1) Shauna Clark, City Clerk, described the responsibili- ties of the three divisions of her department: Admini- stration, Business Licenses and Elections. The total revenue generated by the City Clerk's Office is $3,705,000, and the total proposed budget is $546,548. The City Clerk spoke regarding the need for the Coun- cil to consider funding of programs before their adoption. For example, the Records Management Program, which was authorized by the Council for funding in the 1987-88 bud- get, was deleted in the first round of cuts, which were made by the Finance Director and Deputy City Administrator Robbins. After the first round of cuts, the City Clerk's Department was then required to cut an additional $21,000. The City Clerk explained that the only equipment items left in her budget were two typewriters. Cutting this equipment would not come close to the $21,000. She recommended that the Council consider cutting the $60,000 set aside in the Elections Division budget for a Special Election on pound seizure. An initiative petition for curtailing the sale of pound animals to research institutions is being circulated and is near completion. Depending upon when the petition is turned in to the City Clerk, the City may have to con- duct a Special Election, costing approximately $60,000. If the group circulating the petition is willing for the election to be consolidated with the County's November election, the cost to the City would be less than $20,000. If the Mayor and Common Council choose to adopt the measure, this would save the cost of either election. The City Clerk explained that upon the qualification of an initiative measure, the Mayor and Common Council have the option of adopting the measure, rather than placing it on the ballot. 3 6/11/87 ROLL CALL Roll Call was taken with the following being present: Mayor Wilcox; Council Members Reilly, Flores, Maudsley, Minor, Pope-Ludlam, Miller; City Attorney Penman, City Clerk Clark. CITY OF SAN BERNARDINO, ET AL GENERAL PLAN EXTENSION APPLICATION - OFFICE OF PLANNING AND RESEARCH Council Member Flores made a motion, seconded by Council Member Minor and unanimously carried, that the conditions of the General Plan Extension application, as set forth by the State Office of Planning and Research in a document dated June 11, 1987, be accepted. (2) BUDGET HEARING - PERSONNEL DEPARTMENT This is the time and place set for consideration of the Personnel Department Budget. Mary Jane Perlick, Director of Personnel, presented the Personnel Department Budget. (1) Ms. Perlick explained the many functions of the Per- sonnel Department, which also include: open and contin- uous recruitment for law enforcement personnel, finger- printing and the checking of driver's licenses. She suggested that certain departments, such as the Water Department, make a financial contribution to pay for the recruitment performed for them by Personnel, in order to raise revenue to offset the cuts she has not been able to meet within her budget. Ms. Perlick answered questions regarding an account within her department's budget for car allowance. The Mayor and Common Council discussed the use of City vehicles by various employees.
