Monday, June 22, 1987, in the Management Information Center (MIC Room), Sixth Floor, City Hall, 300 North "D" Street, San Bernardino, California. The City Clerk has caused to be posted the Notice of Adjournment of said meeting held at 1: 10 p.m., Saturday, June 20, 1987, and recessed to 8: 00 a. m.. Monday, June 22, 1987, and has on file in the Office of the City Clerk an Affidavit of said posting, together with a copy of said Order, which was posted at 1: 00 p.m., Tuesday, June 23, 1987, in the Council Chambers of City Hall, 300 North "D" Street, San Bernardino, California. The Adjourned Regular Meeting of the Mayor and Common Council of the City of San Bernardino was called to order by Mayor Wilcox at 8: 15 a.m., Saturday, June 27, 1987, in the Management Information Center (MIC Room), Sixth Floor, City Hall, 300 North "D" Street, San Bernardino, California. ROLL CALL Roll Call was taken by the Deputy Ci ty Clerk with the following being present: Council Members Estrada, Reilly, Flores, Maudsley, Minor, Miller; Deputy City Clerk Copeland, City Administrator Schweitzer. Absent: Mayor Wilcox; Coun- cil Member Pope-Ludlam, City Attorney Penman. PUBLIC COMMENTS There were no comments by the general public. (A) RES. 87-214 - RESOLUTION OF THE CITY OF SAN BERNARDINO, ESTABLISHING THE APPRO- PRIATION LIMIT FOR THE FISCAL YEAR 1987/88 FOR THE CITY OF SAN BERNARDINO IN ACCOR- DANCE WITH THE PROVISIONS OF DIVISION 9 OF TITLE 1 OF THE CALIFORNIA CODE, AND RE- PEALING RESOLUTION NO. 87-201. (1) Mayor Pro Tempore Miller read the title of the resolu- tion. MAYOR WILCOX AND COUNCIL MEMBER POPE-LUDLAM ARRIVED At 8: 20 a.m., Mayor wilcox and Council Member Pope- Ludlam arrived at the Council Meeting, and took their places at the Council Table. City Administrator Schweitzer answered questions re- garding the Proposition 4 spending limitation. Warren Knudson, Director of Finance, stated that the City's legal spending ceiling limit is approximately $77 million, and that the current spending amount is at approxi- mately $55 million. Council Member Estrada made a motion, seconded by Coun- cil Member Maudsley and unanimously carried, that further reading of the resolution be waived, and that said resolu- tion be adopted. 1 6/27/87 ~ Resolution vote: Ayes: Maudsley, Minor, None. No. 87-214 was adopted by the following Council Members Estrada, Reilly, Flores, Pope-Ludlam, Miller. Noes: None. Absent: RESOLUTION APPROVING BUDGET OF 1987/88. OF THE CITY OF SAN BERNARDINO AND ADOPTING THE PRELIMINARY SAID CITY FOR THE FISCAL YEAR (2 ) Deputy City Clerk Copeland read the title of the reso- lution. Council Member Reilly made a motion, seconded by Coun- cil Member Minor, that only vacancies specifically approved by the City Administrator may be filled; and that only equipment and capital purchases specifically identified as emergencies and approved in writing by the City Admini- strator may be purchased. The motion failed by the following vote: Ayes: Coun- cil Members Reilly, Maudsley, Minor. Noes: Council Members Estrada, Flores, Pope-Ludlam, Miller. Absent: None. Discussion continued regarding the authority of the City Administrator and freezing expenditures concerning personnel, equipment and capital expenditures. Council Member Estrada made a motion, seconded by Coun- cil Member Miller, that there be a total freeze on person- nel, equipment and capital expenditures; and that under emergency situations, those matters be brought before the Mayor and Common Council on an interim basis until the bud- get is approved. The motion carried by the following vote: Ayes: Coun- cil Member Estrada, Flores, Pope-Ludlam, Miller. Noes: Council Members Reilly, Maudsley, Minor. Absent: None. Mayor Evlyn Wilcox vetoed the motion, as she felt the action to be in opposition to the manner in which City busi- ness should be handled. She explained that the City Admini- strator is in daily contact with City business, and for per- sonnel vacancies to have to go before the Council each time a vacancy occurs is not good business. (This matter was discussed later in the meeting - See Page 6) BUDGET SESSION - CEMETERY Dan Ustation, Superintendent of the Cemetery Depart- ment, presented his budget, and answered questions regarding a proposed fee increase. He sta ted tha t he would prov ide a report of fees charged in neighboring cities after the next Cemetery Commission meeting of July 14, 1987. (4) No formal action was taken. 2 6/27/87 BUDGET SESSION - ANIMAL CONTROL Paul Turner, Director of Animal Control, explained how two services, if reinstated, would increase his budget for the Fiscal Year 1987/88. The two services, which were eliminated last year were: Owner Release Fee and Field Service Fee. (4) Paul Turner, Director of Animal Control, answered ques- tions regarding the possibility of turning over the Animal Control Department to the Humane Society. No formal action was taken. BUDGET SESSIONS - OVERVIEW DEVELOPMENTAL SERVICES In a memorandum dated June 26, 1987, James Richardson, Deputy City Administrator, addressed the proposed service fee increases, and the overall funding levels and priorities of the Planning, Building & Safety and Public Works/Engi- neering Departments. (4) James Richardson, Deputy City Administrator, answered questions regarding a comparison survey of fees charged in other cities for developmental services. No formal action was taken. BUDGET SESSIONS - PLANNING DEPARTMENT Ann Siracusa, Director of Planning, presented her bud- get with the proposed 4% reduction. (4) She stated that there are services, such as compliance letters, appeals and plan checking, for which the City does not charge, and for which many developers and mortgage com- panies expect to pay. She answered questions regarding the General Plan Pro- ject. No formal action was taken. 3 6/27/87 RECESS MEETING At 10:48 a.m., Mayor wilcox recessed the meeting for a IS-minute break. RECONVENE MEETING At 11:03 a.m., in the Management Floor, City Hall, California. the Adjourned Regular Meeting reconvened Information Center (MIC Room), Sixth 300 North "D" Street, San Bernardino, ROLL CALL Roll Call was taken by the Deputy Ci ty Clerk wi th the following being present: Mayor Wilcox; Council Members Estrada, Reilly, Flores, Maudsley, Minor, Pope-Ludlam, Miller; Deputy City Clerk Copeland, City Administrator Schweitzer. Absent: City Attorney Penman. BUDGET SESSION - BUILDING AND SAFETY John Tucker, Director of the Building and Safety Department, discussed the revenue section of his budget, and explained that the new budget reflects a 20% fee increase over what is in the current Building and Safety Code, but that the increase is 20% less than the 1985 Code. (4) He answered questions regarding his proposed 50% fee increase. He sta ted tha t due to proposed cuts in hi s budget, some of the field inspection personnel would be put in code enforcement until revenues could support them, as building is being done in areas of the City without permits. No formal action was taken. BUDGET SESSION - PUBLIC WORKS Roger Hardgrave, Director of Public Works/Engineering, presented an overview of his proposed budget, and provided the following recommendations by Hughes & Heiss for the Garage Division: that a swing shift be established; that two 3-post hoists be installed to facilitate maintenance to large vehicles for refuse vehicles; and that a part-time person be utilized to locate parts instead of using a super- visor. (4) BUDGET SESSION - PUBLIC BUILDINGS Wayne Overstreet, Superintendent of answered questions regarding maintenance in the City of San Bernardino. Public Bui Id i ngs, of public buildings (4 ) He stated that he currently maintains 132 buildings, and that with the proposed budget cuts, he would not be able to maintain facilities at the Senior Centers located at Perris Hill Park and Tri-City Fire Station. He answered questions regarding City-owned property. A discussion ensued regarding overcharges billed to the City by Southern California Edison. Wayne Overstreet, Superintendent of Public Buildings, stated that the City will be receiving a check from Southern California Edison for approximately $70,000 for the over- charges. No formal action was taken. 4 6/27/87 GLENDA SAUL, EXECUTIVE DIRECTOR, REDEVELOPMENT AGENCY - ARRIVED At 1:1313 p.m.. Glenda Saul, Executive Director of the Redevelopment Agency, arrived at the Council Meeting. BUDGET SESSION - PUBLIC SERVICES In a memorandum dated June 22, 1987, Manuel Moreno, Jr.. Director of Public Services, addressed concerns for projects that were eliminated from his budget. (4) He sta ted tha t chases, and that the once-a-month service cuts were made on all equipment pur- sweeping program was reduced to provide to residential areas. He answered questions regarding his request for part- time employees, stating that due to the proposed budget, it would take longer to get to citizen and Council requests, and that the work may not be as thorough as before. No formal action was taken. MEMORANDUM OF UNDERSTANDING - CITY OF SAN BERNARDINO AND THE FIRE SAFETY UNIT In a letter dated June 23, 1987, written by City Attorney Penman, a side letter was entered into by and between the City of San Bernardino and Firefighter's Local 891, amending the present outstanding Memorandum of Under- standing. (3) Council Member Pope-Ludlam made a motion, seconded by Council Member Minor, that the side letter between the City of San Bernardino and the Fire Safety Unit, be approved as submitted in typewritten form. COUNCIL MEMBER POPE-LUDLAM EXCUSED Council Member Pope-Ludlam left the Council Meeting. As a vote had not yet been taken on Council Member Pope-Ludlam's motion, the motion was reaffirmed by Council Member Estrada, seconded by Council Member Minor and unani- mously carried, that the side letter between the City of San Bernardino and the Fire Safety Unit, be approved as sub- mitted in typewritten form. REDEVELOPMENT AGENCY BUDGET FOR 1987/88 Council Member Maudsley made a motion, seconded by Council Member Estrada and unanimously carried, that dis- cussion concerning the Redevelopment Agency Budget for the Fiscal Year 1987/88 be recessed until 2:1313 p.m.. Monday, June 29, 1987, in the Management Information Center (MIC Room), Sixth Floor, 31313 North "D" Street, San Bernardino, California. RES. 87-215 - RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING AND ADOPTING AN INTERIM BUDGET OF SAID CITY FOR THE FISCAL YEAR 1987/88 FOR THE PERIOD JULY 1 THROUGH AUGUST 3, 1987. (2) City Clerk Clark read the title of the resolution. Council Member Estrada made a motion, seconded by Coun- cil Member Pope-Ludlam and unanimously carried, that further reading of the resolution be waived, and that said resolu- ti on be adopted. Mary Jane Perlick answered questions regarding the cost of the recruitment process. The Council clarified their intent, which is that the existing Budget for the Fiscal Year 1986/87 be carried for a period of thirty days, and that no capital or equipment expenses be authorized. Departments are to remain at the 1986/87 salary, material, services and supplies levels. Resolution vote: Ayes: Maudsley, Minor, None.
