HomeMy WebLinkAbout04-13-1987 Minutes r City of San Bernardino, California April 13, 1987 This is the time and place set for an Adjourned Regu- lar Meeting of the Mayor and Common Council of the City of San Bernardino at their Regular Meeting held at 9:07 a.m., on Monday April 6, 1987, in the Council Chambers of City Hall, 300 North "0" Street, San Bernardino, California. The City Clerk has caused to be posted the Notice of Adjournment of said meeting held at 9:07 a.m., on Monday, April 6, 1987, and has on file in the Office of the City Clerk an Affidavit of said posting together with a copy of said Order which was posted at 3:00 p.m., on Tuesday, April 7, 1987, in the Council Chambers of City Hall, 300 North "0" Street, San Bernardino, California. The Adjourned Regular Meeting of the Mayor and Common Council of the City of San Bernardino was called to order by Mayor Wilcox at 4:10 p.m., in the Council Chambers of City Hall, 300 North "0" Street, San Bernardino, Cali- fornia. ROLL CALL Roll Call was taken by the City Clerk with the fol- lowing being present: Mayor Wilcox; Council Members Estrada, Reilly, Flores, Maudsley, Quiel, Frazier, Strickler; City Attorney Prince, City Clerk Clark, City Administrator Schweitzer. Absent: None. GENERAL PLAN - APPLICATION FOR EXTENSION OF TIME WITH STATE This is the time and place set to consider the filing of an application for a time extension with the State of California Office of Planning and Research, for the Gen- eral Plan of the City of San Bernardino. Such application shall include the following: (1) A resolution entitled: "Resolution of the City of San Bernardino supporting the request to the State Office of Planning and Research for a time extension to complete the General Plan"; Extension Form, Interim Policies and Pro- cedures; Budget and Work Program, and current General Plan documents. Vince Bautista, Principal Planner, Planning Depart- ment, distributed amended pages for the Request for the General Plan Extension, dated April 13, 1987, and ex- plained each amendment. He answered questions of the Council, stating that the Planning Department has been in touch with the State Office of Planning and Research and had invited their staff to come to San Bernardino. How- ever, they have declined the invitation until the applica- tion is submitted. Mr. Bautista also explained that the amendments to the Request for General Plan Element Exten- sion would leave the door open for certain annexations to take place and explained other changes in the document one by one. Glenda Saul, Executive Director of the Redevelopment Agency, answered questions regarding Overlay Zones. Mayor Wilcox invited the public to come forward with their questions. Darlene Fischer, Attorney, Hill, Farrer & Burrill, 445 South Figueroa St., Los Angeles, CA 90071-1666, ex- plained that she preferred to hear the entire presentation on the General Plan before she made a statement on behalf of her clients. Brian Simpson, Attorney, 234 N. Arrowhead Avenue, requested a one week extension to allow himself and sev- eral of his clients to review the documents prepared by the Planning Department. Marguerite Battersby, representing the plaintiffs in the lawsuit of ~~nd Saldecke vs. the City of San Ber- nardino, stated that she had not had time to review the amendments to the Request of General Plan Element Exten- sion Plan. City Attorney Prince answered questions regarding an extension, and stated that as long as the City continues to proceed in a timely manner that an extension does not hurt the City's position. He added that a concurrence from Ms. Battersby on an extension would be helpful. It was recommended that all sides present their re- sponses to the request for General Plan Element Extension in writing for the purpose of review. Council Member Strickler made a motion, seconded by Council Member Quiel, that the public hearing concerning the Extension of Time for the General Plan be continued to 9: 00 a.m., on Wednesday, April 22, 1987, in the Council Chambers of City Hall, 300 North "D" Street, San Bernar- dino, California; that all parties provide in writing their concerns on the request for a General Plan Element Extension by 3:00 p.m., on Monday, April 20, 1987, and that copies of the responses can be exchanged by 4:00 p.m., in the City Clerk's Office. Ms. Battersby explained that originally their side had asked for an open ended extension in court and it was the City that requested a closed time frame. Now the City wants more time. She stated she would not oppose the Council's motion. The motion carried unanimously. RES. 87-123 - RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH SMITH, PERONI & FOX RELATING TO CONSULTING SERVICES FOR THE CITY'S GEN- ERAL PLAN. (2) City Clerk Clark read the title of the resolution. Council Member Quiel made a motion, seconded by Council Member Strickler and unanimously carried, that further reading of the resolution be waived and said reso- lution be adopted. Resolution No. 87-123 was adopted by the following vote: Ayes: Council Members Estrada, Reilly, Flores, Maudsley, Quiel, Frazier, Strickler. Noes: None. Ab- sent: None. RES. 87-124 - RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING AND RATIFYING THE EXECUTION OF AN AGREEMENT WITH THE LAW OFFICE OF BALFREY & ABBOTT RELATING TO LEGAL SERVICES PERTAINING TO THE CITY'S GENERAL PLAN. (3) City Clerk Clark read the title of the resolution. 2 4/13/87 Council Member Quiel made a motion, seconded by Council Member Strickler and unanimously carried, that further reading of the resolution be waived and said reso- lution be adopted. Resolution No. 87-124 was adopted by the following vote: Ayes: Council Members Estrada, Reilly, Flores, Maudsley, Quiel, Frazier, Strickler. Noes: None. Ab- sent: None. COUNCIL MEMBER REILLY EXCUSED Council Member Reilly left the Council Meeting. APPOINTMENT - DIRECTOR OF RISK MANAGEMENT - GENE LIGHT Council Member Strickler made a motion, seconded by Council Member Quiel and unanimously carried, to approve the appointment of Gene Light as Director of Risk Manage- ment, Range 4151, Step 5 ($3,837/mo.), effective April 27, 1987. (5) COUNCIL MEMBER REILLY RETURNED Council Member Reilly returned to the Council Meeting and took his place at the Council Table.
