attached spreadsheet entitled "'Se\ver and Street Improvement Cost Distribution for Project No. 11147."

Subject:
Resolution awarding a contract to David T. Wasden, Inc., for Sewer and Street Improvements on 34th Street -
Leroy Street to Waterman Avenue (SW 04-23); 48th Street - "F" Street to Electric Avenue (SW 04-24); and
Street Improvements on Richardson Street - San Bernardino Avenue to Victoria Avenue (SW 04-34); Cooley
A venue - Tippecanoe A venue to Gage Canal (SW 04-35); and "E" Street - 2nd Street to 4th Street (SW 04-06),
per project Plan No. 11147 and authorization for the Director of Finance to amend the FY 05/06 Budget.
Background:
On August 1, 2005'1 the Mayor and Conlmon Council allocated funds, as part of the FY 2005/06 Capital
Improvement Program (CIP) for ~~34th Street Sewer Main from Leroy Street to Waterman Avenue (SW 04-23)",
-.48tl1 Street from HF" Street to Electric A venue (SW 04-24), HRichardson Street Sewer Main from Cooley Drive
to Victoria Avenue (SW 04-34)"'1 Heooley Avenue Replace a Parallel Sewer Main from Tippecanoe Avenue to
Gage Canal (SW 04-35)"'1'1 and HSewer main repair on HE" Street from 2nd Street to 4th Street (SW 04-06)".
This project consists of the follo\\'ing:
1. Construction of ne\\r se\ver mains in 34th Street and 48th Street.
2.
Grind and overlay asphalt pavement full width on the following streets (includes removal and
replacement of failed areas):
a) 34th Street from Leroy Street to Waterman Avenue.
b) 48th Street from HF" Street to Electric Avenue.
c) Richardson Street from Victoria Avenue to San Bernardino Avenue.
d) Cooley l\ venue fronl Gage Canal to Tippecanoe A venue.
e) ~"E" Street from 2nd Street to 4th Street.
The plans and specifications for this project are- conlplete. The project \vas advertised locally in the San
Bernardino County Sun Newspaper, F. \\T. Dodge, Construction Bid Board, Construction Data Hot Sheet, Reed
Construction Data and Bid America, Construction Bid Source, the City's \veb sites, and \vith the San Bernardino
Area Chamber of Commerce.

Based on review of the sealed competitive bids received, staff has determined that David T. Wasden, Inc. of
Riverside, the apparent 10\\' bidder, has met the minimum requirements of the specifications and bid guidelines;
and, therefore, recommends that the Mayor and Common Council award the referenced contract to David T.
Wasden, Inc.

. The estimated project costs are as follows:

If approved, this project is expected to begin construction in late September of 2005 and be completed by
February of 2006.
Financial Impact:
Adequate funding for these projects is available in FY 2005/2006 CIP, subject to adjustment of the various
accounts as indicated in the attached spreadsheet "Sewer and Street Improvement Cost Distribution for Project
No. 11147."
Recommendation:
1. Authorize the Director of Finance to amend the FY 2004/05 Budget by transferring funds as indicated in the
attached spreadsheet entitled "Sewer and Street Improvement Cost Distribution for Project No. 11147."
2. Adopt Resolution.

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AWARDING A CONTRACT TO DAVID T. WASDEN, INC., FOR
SEWER AND STREET IMPROVEMENTS ON 34TH STREET - LEROY STREET TO
WATERMAN AVENUE (SW 04-23); 48TH STREET - "F" STREET TO ELECTRIC
AVENUE (SW 04-24); AND STREET IMPROVEMENTS ON RICHARDSON STREET -
SAN BERNARDINO AVENUE TO VICTORIA AVENUE (SW 04-34); COOLEY
AVENUE - TIPPECANOE AVENUE TO GAGE CANAL (SW 04-35); AND "E"
STREET - 2ND STREET TO 4TH STREET (SW 04-06), PER PROJECT PLAN NO. 11147.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. David T. Wasden, Inc., 1240 San Cristobal Drive, Riverside, CA 92506,
is the lowest responsible bidder for Sewer and Street Improvements on 34th Street - Leroy Street to
Waterman Avenue (SW 04-23); 48th Street - "F" Street to Electric Avenue (SW 04-24); and Street
Improvements on Richardson Street - San Bernardino Avenue to Victoria Avenue (SW 04-34); Cooley
Avenue - Tippecanoe A venue to Gage Canal (SW 04-35)~ and "E" Street - 2nd Street to 4th Street (SW
04-06), per project Plan No. 11147. A contract is awarded accordingly to said bidder in a total
amount of $874,701.00, with a contingency amount of $140,794.00, but such award shall be
effective only upon being fully executed by both parties. All other bids, therefore, are hereby
rejected. The Mayor is hereby authorized and directed to execute said contract on behalf of the
City; a copy of the contract is on file in the office of the City Clerk and incorporated herein by
reference as fully as though set forth at length.
SECTION 2. This contract and any amendment or modifications thereto shall not take
effect or become operative until fully signed and executed by the parties and no party shall be

obligated hereunder until the time of such full execution. No oral agreements, amendments,
26 modifications or waivers are intended or authorized and shall not be implied from any act or
27 course of conduct of any party.
