This amount was based upon the assumption that the area would be developed into 36 single family houses on 7,200-square foot lots. However, the property has been developed with 178 multi-family units, subsequent to preparation of the 1994/95 roll. The proposed 1995/96 roll was accordingly prepared on the basis of 178 units, which increased the total assessment to $18,308.94. A notice was sent to the property owner with the amount of the increased assessment, and advising of the scheduled public meeting and hearing. The owner filed a protest at the public hearing on 6-26-95 over the increased assessment. A representative for the owner of the Northpointe Apart- ment Complex also appeared at the public hearing. This property could not protest the amount of their assessnent, since it was considerably less than the previous year. The representative challenged the nethod of calculating assessments, due to the fact that the proposed 1995/96 assessment of $55,543 was considered as still being too high. Action was taken at the Council meeting of 6-26-93 to close the public hearing and overrule the one protest filed by the Victoria Woods Apartment Complex. The item was referred to the Council Housing Committee, and continued to 7-10-95, in order to afford an opportunity to review the method of spreading the assessments. Copies of the documents establishing the district were provided to the City Attorney's office for review. After re- viewing these documents, the City Attorney's office concluded that the Engineer's Report prepared in the early 1980's does not clearly authorize basing the assessments on the number of multi- family units. Therefore, in order to avoid the possibility of legal challenge, the assessnent roll has been recalculated on the basis of equivalent single family residences on 7,200-square foot lots, for the two apartment complexes. While the amount per assessment unit has increased from $103 to $196, the total assessments for Victoria Woods will decrease from $18,308 to $7,066, and for Northpointe from $55,543 to $22,964. Rhemrev, Deputy City Attorney DATE: July 10, 1995 RF: Assessment District 959 This item was continued (along with others) from 6/26/95 to review the method of calculation after protests were received from the owner of Northpointe Apartments. After review, we noted and so advised staff that the documents establishing the assessment district do not clearly support the method of calculation used. Discussions were held with the owners, represented by Burke, Williamson, and Sorensen, to discuss the effect of the change in method of calculation (if implemented) on this year's assessment as well as the previous years' assessments. We have taken the position that since a valid protest was filed this year that the City should consider changing the method of calculation for this assessment roll. Our preliminary research indicates that because no protests were filed by the owners for the previous years' assessments, they may not be able to challenge the pervious years' assessments. However, the research is not yet completed and there are some remaining issues. Our recommendation would be to amend the assessment roll to reflect the revised method of calculation and address the issues relative to the previous years' calculation if and when they are raised by the owners. Agenda Item No. n - Z '" :3 ~ -, 75-0262 -0 CITY OF SAN BERN.DINO - REQUEST ~ COUNCIL ACTION . . . 75-0264 STAFF REPORT New subdivisions are conditioned to petition the City for an assessment district to be formed, in order to provide for continuing maintenance of the landscaping installed along back-up parkways or significant open areas. The property owners within these districts are assessed each year for the contract costs and incidental expenses. Items such as inspection, contract administration, water and electrical utility bills are included in the incidental costs. The assessments on properties within these districts may vary from year to year, depending upon the actual costs incurred for contract and incidental costs. Nineteen (19) assessment districts have been established for maintenance of landscaping that are currently under a maintenance contract. One of these includes the maintenance and operation of a sewer lift station by City forces. The assessments in 10 of these districts will increase over last year. Some of these increases are for only one zone, or in one case, one parcel, within the district. The Brown Act requires that a public meeting and public hearing be held on all assessments being levied for the first time, or when the assessments are increased over the previous year. All property owners whose assessments are being levied for the first time, or being increased, are sent notices by mail of the public meeting and pub I ic hearing. The requirement to hold a public meeting resulted in additional time needed for the process of approving the rolls for districts with higher assessments. This resulted in the accounts for 1994 being closed with less than 12 months of costs. Seven of the districts have increased for 1995, since the cycle has been extended back to the normal cycle of about one year. One district only had an increase in one of the parcels, due to a land use change resulting in higher density housing than was originally estimated when the district was formed. When the land was vacant, the estimated number of single family homes that could be developed was 36 and previous assessments were based on this number. When the land was developed, however, 178 apartment units were built, so the total amount of the assessment is increased due to the additional units. The actual costs proposed to be assessed last year for Assessment District 991 was $234 per assessment. However, due to protests of homeowners, the assessments were reduced by Council action to the prior years amount of $157 per assessment, with the City absorbing the difference. Even though this years assessment of $183 is an increase over last year, it represents a significant reduction over the actual costs for last year. Two additional assessment districts have been established for the maintenance of sewer lift stations. Maintenance of these lift stations is provided by personnel from our Street Lighting Section. The assessments for one of these districts will increase for 1995, due to additional costs incurred for the replacement of a large pump motor. A Public meeting was on May 22, 1995, to allow property owners the opportunity to ask questions and obtain information relative to the increased assessments. The Public Hearing is a time for protests to be submitted. Only one valid protest was received from a business owner owning two parcels in Assessment District 968 (Airport Drive). This protest represents 20% of the District.
