Synopsis of Previous Council action:
12-18-89 -- Authorization to proceed was given for the annexation of the
territory generally located . Southeast of the I -15 Freeway,
Southwest of the 1-215 Freeway.
11-21-94 Plan for services was approved.
01-09-94
Resolution No. 95-8, adopted, determining the amount of property
tax revenues to be exchanged between the City and County of San
Bernardino, relative to the proposed reorganization.
02-20-95
06-05-95
Resolution No. 95-41 adopted, making application to LAFCO.
Resolution No. 95-175 adopted, making initiating proceedings and
setting a Public Hearing relative to the proposed reorganization
for July 10, 1995.

STAFF REPORT
On 12-18-89, authorization was given to proceed with the proposed annexation of the
area generally located Southeast of the 1-15 Freeway, Southwest of the 1-215 Freeway.
The area just South if this proposed annexation was annexed to the City in 1992,
leaving this area as a strip of unincorporated territory.
On 11-21-94, the Plan for Providing Services for the proposed annexation was approved.
The plan was filed with the Local Agency Formation Conunission (LAFCO), and On January
9, 1994, the Resolution approving the tax transfer from County to City was adopted.
On February 20, 1995, Resolution No. 95-451 was adopted, making application to LAFCO
for this proposal. Even though the proposed annexation was initiated by property owner
and resident petitions, this action eliminated the need for an EIR, which would have
been very costly.
LAFCO approved the proposal on 4-19-95 but modified the limits to eliminate the area
generally Northwest of Devore Road from this action.
On 6-5-95, Resolution No. 95-175 was adopted inititaing proceedings and setting a
Public Hearing for 7-10-95. All property owners within the proposed annexation area
and other interested parties were given notice by mail.
Staff recommends that the Public Hearing be closed and the matter continued to July
24, 1995 to allow a determination to be made on the value of any protests filed.

REFUSAL OF BILL
NOTIC~ is hereby given to the Mayor & Common Council of the
CITY OF SA~ BER~ARLING at 300 N. 'D' Street, San Bernardino County,
State of California regarding Resolution No.95-175 dated 5 June 1995
as it affects SHIRLEY BLACK EWING & MIKAL ThOMAS EwING and any
interest, title, possession, use etc. they have in Rancho Muscupiabe;
THAT SAID RESOLUTION is HEREBY REFUSED for just cause and without
dishonor.
This Refusal of Reolution No. 95-175 is made for the following
reasons:
1. FULL EXTENT OF BILL IS UNSTATED:
2. WE HAVE NOT RECEIVED ANY NOTICE OF DUTY TO DISCHARGE OR ACCEPT;
3. WE HAVE NO CONTRACTUAL OBLIGATION REGARDING SAID BILL/RESOLUTION;
4. NO EQUITABLE CAUSE HAS BEEN PRESENTED:
5. IT IS COMMON KNOWLEDGE THAT CITY OF SAN BERNARDINO's BIlLS
ARE OFTEN ERRONEOUS;
6. SAID BILL/RESOLUTION IS IN BAD FAITH and VIOLATES PREVIOUS
