Description: Finance: Council Notes Agenda Item No. ~ g LtI 05' . . e City of San Bernardino - Request for Council Action STAFF REPORT Subject: Resolution Approving an Agreement with The California Newspapers Partnership for deferral of Sidewalk Installation on Georgia Boulevard. Background: On December 16, 2004, the Development Review Committee approved Development Permit Type II No. 04-31 for the addition of a two story, 54,320 square foot office building at 2239 N. Gannett Parkway which is located on Georgia Boulevard at Gannett Parkway. This site is the current location of the Sun newspaper's printing facilities and, upon completion of the new building, the entire Sun administrative and writing staff will move from its current location in downtown San Bernardino to the Gannett Parkway site. Conditions of Approval for the new building require construction of approximately 600 feet of sidewalk along Georgia Boulevard adjacent to the site. There is no existing sidewalk on Georgia Boulevard or Gannett Parkway. The nearest bus stop is located on University Parkway about 1,300 feet from the site and there is no access for pedestrians from that bus stop along Hallmark Parkway or Gannett Parkway to the site. Facilities are also not available for pedestrian travel from the site to retail stores, which are located about 600 feet northeasterly of the Sun site. Due to the lack of connecting pedestrian facilities in the area, The California Newspapers Partnership has requested that installation of the sidewalk be deferred until such time as the property between their site and Hallmark Parkway develops and the sidewalk can be extended in a continuous fashion to the bus stop and to the adjacent retail facilities. A proposal has been received for development of the land between Georgia Boulevard and Hallmark Parkway along Gannett Parkway. As part of the development proposal, Gannett Parkway at Georgia Boulevard would be substantially modified and a portion of Gannett Parkway would be vacated. Improvement of a pedestrian path of travel to connect Georgia Boulevard to Hallmark Parkway would be required as a condition of approval of the vacation and/or the development project. The California Newspapers Partnership has submitted the attached Agreement (see Exhibit "A") which will be recorded and bind current and future owners of the property. When directed to do so by the City, the current or future owner will be required to construct within 180 days: 1) A sidewalk in the public right-o-way of Georgia Boulevard; 2) Provide a handicap accessible path of travel from the public right-of-way to the entrance of all buildings on the site, including the existing structure. Due to the lack of connecting pedestrian facilities in the area, staff feels the request IS reasonable and recommends approval of the Agreement. 2 . . e City of San Bernardino - Request for Council Action STAFF REPORT (Continued) Financial Impact: None.
