ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
18.24.220 OF THE SAN BERNARDINO MUNICIPAL CODE TO PROVIDE, UNDER
CERTAIN CIRCUMSTANCES, WITH THE APPROVAL OF THE DIRECTOR OF PUBLIC
WORKS/CITY ENGINEER, THAT THE FINAL MAP MAY BE RECORDED BEFORE THE
IMPROVEMENT PLANS ARE SIGNED.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

SECTION 1. Section 18.24.220 of the San Bernardino Municipal
8 Code is amended to read as follows:
9 "Prior to filing the original tracing of the final map with
10 the Public Works Department, the subdivider shall secure the
11 required approvals with respect to easements, plans for drains,
12 drainage works, sewers, improvement plans and specifications, and
13 all applicable provisions of Chapter 18.44. All certificates
14 shall be executed except those to be executed by the Director of
15 Public Works/City Engineer, the City Clerk, and the County
16 Recorder. The subdivider shall file with the Public Works
17 Department the original tracing of the final map and as many
18 prints thereof as may be required, along with the accompanying
19 statements and documents.
20 Notwithstanding any provisions of this or any other section
21 of this Code to the contrary, the Director of Public Works/City
22 Engineer may execute the Director of Public Works/City Engineer's
23 Certificate on a map, and may file the map and accompanying
24 materials with the City Clerk, prior to the subdivider securing
25 the required approvals with respect to plans for drains, drainage
26 works, sewers, improvement plans and specifications; if the
27 Director of Public Works/City Engineer determines that the map has
28 been created to facilitate continued planning, provided that

the total acreage of the map exceeds one-hundred (lOO) acres; all
2 lots created by the map, except those proposed for dedication to
3 the City, exceed ten (lO) acres; and no lots created by the map
4 are intended for direct sale for residential purposes. When
5 certifying a map under the provisions of this paragraph, the
6 Director of Public Works/City Engineer shall require improvement
7 security in an amount fifty percent (50%) greater than normally
8 required when the improvement plans have been fully certified.
9 Such increased improvement security shall be kept in force until
10 the improvement plans have been certified at which time they shall
11 be reduced to the normal amount as specified in Chapter 18.44."
