NO. 3974 ENTITLED IN PART "ORDINANCE . . . ADOPTING THE UNIFORJI.1
3 BUILDING CODE, 1979 EDITION. . ." MEl THE APPROPRIATE SECTION OF
THE SAN BERNARDINO MUNICIPAL CODE; REVISING THE PROVISIONS RELATIN
4 TO WAIVER OF FEES FOR PROPERTY DN.~GED DUE TO NATURAL DISASTER;
AND REPEALING ORDINANCE NO. MC-5.

SECTION 1. Ordinance No. 3974 Section 3 and the appropriate
8 section of the San Bernardino Municipal Code are amended by
9 amending Section 303(f) of the Uniform Building Code, 1979
10 Edition, to read:

"(f) Waiver of Building Permit Fees.

1. Historic Preservation - No fees shall be charged
13 for permits issued for repairs, alterations or additions for the
14 preservation, restoration or rehabilitation of a building or
15 structure which is a qualified historical building or structure
16 pursuant to Health and Safety Code section 18955, a qualified
17 historical property pursuant to Public Resources Code Section
18 5031, a registered historical landmark pursuant to Public
19 Resources Code section 5021, or a point of historical interest
20 pursuant to Public Resources Code Section 5022.5.

2. Natural Disaster Damage - No fees shall be charged
22 for permits issued within 180 days after the disaster to owners 0
23 damaged or destroyed structures located in an area designated as
24 disaster area by resolution of the Mayor and Cornmon Council to
25 repair damage caused by natural disaster. This exception shall
26 apply only to property owners of record at the time of the dis-
27 aster, and not to persons subsequently acquiring the property."

SECTION 2. Ordinance No. MC-5 is hereby repealed.
