ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
,19.56.290 OF THE SAN BERNARDINO MUNICIPAL CODE RELATING TO IN-LIEU
,
PARKING FEES.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

SECTION 1. Section 19.56.290 Subsection C. of the San
7 Bernardino Municipal Code is amended to read:
8
"C. For purposes of this section, the estimated cost per
9 parking space shall be that cost set forth by annual resolution of
10 the mayor and common council and adopted in May of each year."

SECTION 2. Section 19.56.290 Subsection D. of the San
12 Bernardino Municipal Code is amended to read:

"D. 1. The in-lieu payment shall be made to the city prior
14 to the issuance of a building permit for the development. At the
15 Irequest of the owner, payment of the in-lieu parking fees may be
]6 deferred until actual occupancy is approved by the City, as
17 evidenced by a certificate of occupancy for the building or for
18 the portion of the building to be occupied. The amount of the in-
19 lieu fee due shall be equal to the amount necessary to provide the
20 number of spaces required by Sections 19.56.190 through 19.56.360,
21 for the building or the portion to be occupied. Payment of the
22 required in-lieu fee shall be a condition precedent to issuance of
23 a certificate of occupancy.

2. The City shall refund all or the proportionate part
25 of an in-lieu fee paid by a property owner who subsequently
26 furnishes parking for the property, meeting the parking
27 requirements of Sections 19.56.190 through 19.56.360 of the San
28 Bernardino Municipal Code in whole or in part, within twenty-four
