ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING THE SAN
BERNARDINO MUNICIPAL CODE BY ADDING CHAPTER 1.26 RELATING TO TIME
LIMITATIONS FOR ADMINISTRATIVE MANDAMUS PROCEEDINGS.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:
SECTION 1. Chapter 1.26 is added to the San Bernardino
Municipal Code to read:
"Chapter 1.26
TIME LIMITATIONS FOR
ADMINISTRATIVE MANDAMUS PROCEEDINGS
1.26.010 Adoption of Section 1094.6 of the Code of Civil
Procedure.
The provisions of Section 1094.6 of the Code of civil
Procedure shall be applicable to decisions of the Mayor and
Common Council and of any commission, board, officer, or agent of
the City of San Bernardino.
1.26.020 Definition of "Decisionll.
As used in this chapter, "decision" means an adjudicatory
administrative decision made, after hearing, suspending, demoting,
or dismissing an officer or employee, revoking or denying an
application for a permit or a license, or denying an application
for any retirement benefit or allowance."
