2 ORDINANCE Of THE CITY OF SAN BERNARDINO EXTENDING ORDINANCE
NO. MC-58 AND THE DEVELOPMENT MORATORIUM CONTAINED IN THAT
3 ORDINANCE FOR A PERIOD OF 120 DAYS, AND DECLARING ITS URGENCY.
4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO D
ORDAIN AS FOLLOWS:

SECTION 1. Findings. The following findings are made:

(a) On May 18, 1981, the Mayor and Common Council adopted
7
urgency Ordinance No. MC-58 which established a l20-day moratorium
8
upon development, construction or occupancy of property located in
9
the "clear zone" at each end of the runway of Norton Air Force
10
Base, pending a study of appropriate regulations for properties in

those areas. The Mayor approved Ordinance No. MC-58 on May 19,

1981.

(b) Ordinance No. MC-58 will expire, by its terms, on
14
September 17, 1981.

(c) On September 14, 1981, the Mayor and Common Council
16
conducted a public hearing regarding the possible extension of
17
Ordinance No. MC-58 for an additional period of eight months.

Appropriate notice of the hearing was given pursuant to Resolution
]9
No. 81-395.

(d) The Mayor and Common Council desire to extend the life
21
of Ordinance No. MC-58 for an additional period of 120 days.
22
There is insufficient time to adopt and put into effect an
23
ordinance extending the life of Ordinance No. MC-58 except by an
24
urgency ordinance.

SECTION 2. Extension of Ordinance No. MC-58. The expiratio
26
of Ordinance No. MC-58, and of the development moratorium
27
contained in that ordinance, are extended for an additional period

1 of 120 days, to expire on January 14, 1982.

SECTION 3. Urgency. This ordinance is an urgency measure
3 for the immediate preservation of the public peace, health or
4 safety. Provided that it is adopted by a 5/7ths vote of the
5 Council, this ordinance shall go into effect immediately upon its
6 adoption and approval. The facts constituting the urgency are set
7 forth in Section 1 of this ordinance and in Section 1 of Ordinance
8 No. MC-58.
9 I HEREBY CERTIFY that the foregoing ordinance was duly
10 adopted by the Mayor and Common Council of the City of San
11
Bernardino at an adjourned regular
meeting thereof, held
