2.40 OF THE SAN BERNARDINO MUNICIPAL CODE; DECLARING A NEED FOR
3 A COMMUNITY DEVELOPMENT CO~1ISSION OF THE CITY OF SAN BERNARDINO
TO FUNCTION WITH RESPECT TO THE REDEVELOPMENT AGENCY OF THE CITY
4 OF SAN BERNARDINO AND CO~1UNITY DEVELOPMENT ACTIVITIES IN THE CITY;
DECLARING THE COMMON COUNCIL TO BE THE COMMISSION; AND ENACTING
5 PROCEDURAL PROVISIONS FOR THE EXERCISE OF CHARTER POWERS BY THE
MAYOR.

SECTION 1. Chapter 2.40 of the San Bernardino Municipal
9 Code is amended to read as follows:

Need for Commission.
17 This ordinance is enacted pursuant to California Health &
18 Safety Code Part 1.7 sections 34100 et seq., the home rule and
19 charter powers of the City of San Bernardino (City), including
20 Charter section 40, and the California State Constitution.
21 It is hereby declared that there is a need for a Community
I
22 Development Commission of the City of San Bernardino (Commission)
23 to function with respect to the Redevelopment Agency of the City
24 of San Bernardino (Agency) and community development activities
25 in the City. The operational designation of the two public
26 bodies, to wit: the Commission and Agenc~ shall be the Redevelop-
27 ment Agency of the City of San Bernardino.

Common Council as commission.
It is further declared that the Common Council shall be the
Community Development Commission of the City of San Bernardino.
2.40.030 Commission Powers.
All powers, responsibilities, authority, functions and jur-
isdiction relating to community development as currently vested
in and performed by the Community Development Division of the
office of the Mayor are delegated to the Community Development
Commission of the City of San Bernardino, subject to any condi-
tions which may be imposed by the Mayor and Common Council by
resolution, provided that the Mayor and Common Council at any time
may by resolution terminate, modify, or expand such powers,
responsibilities, authority, functions and jurisdiction.
2.40.040 Administration.
Additional powers and the power and authority to administer
and manage the operations and activities of the Commission and the
Agency through an executive director may from time to time be
established, delegated, modified, or repealed by resolutions
adopted by the Mayor and Common Council.
2.40.050 Powers of Mayor.
The Commission in the procedures for adoption of orders and
resolutions and in the conduct of its meetings shall exercise its
powers in conjunction with the powers of the Mayor in accordance
with the intent of the provisions of Charter Sections 31, 34 and
36, San Bernardino ~1unicipal Code Chapter 1.08, Common Council
Rules adopted pursuant thereto, and administrative interpretations
and practices thereunder. The Mayor shall be the Chairman of the
meetings of the Commission. The Mayor shall have the same power

1 and authority in the conduct of the affairs of the Commission and
2 Agency that the Mayor has in the conduct of the affairs of the Cit
3 in accordance with Charter Section 50 and 52, except that the
4 Mayor shall not be empowered hereunder to appoint, discipline or
5 discharge any officer or employee of the Commission or Agency.
6 This section is enacted pursuant to the authority of the Health &
7 Safety Code Part 1.7 including Section 34151, the State Constitu-
8 tion and the City Charter, including Section 40 thereof.

2.40.060 Bonds.
10 The enactment of this Chapter is not intended to and shall
11 not affect outstanding or future bonds issued or to be issued
12 by the Agency or the City of San Bernardino. Future bonds shall
13
be issued in the name of the Agency rather than the name of the

Commission as a public body."

SECTION 2. This Ordinance shall become operative and

effective on
November 15

A certified copy of Ordinance No. MC-105, passed and
adopted by the Mayor and Common Council of the CITY
OF SAN BERNARDINO on October 5, 1981. declaring the
need for a Community Development Commission to function
in the City of San Bernardino and declaring the Common
Council to be the Community Development Commission.
