MC-H3 2 ORDINANCE OF THE CITY OF SAN BERNARDINO CALLING A SPECIAL ELECTION TO BE HELD IN THE FIFTH WARD OF SAID CITY ON TUESDAY, THE 3 16TH DAY OF FEBRUARY, 1982, FOR THE PURPOSE OF FILLING A VACANCY IN THE COMMON COUNCIL REPRESENTING THE FIFTH WARD. (URGENCY) 4 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO 5 ORDAIN AS FOLLOWS: 6 SECTION 1. Recitals. 7 (a) Lionel E. Hudson, Member of the Common Council, 8 representing the Fifth Ward, passed away on October 29, 1981. 9 (b) The Mayor and Common Council of the City of San IBernardino desire to call a special election for the purpose of I 10 11 filling the vacancy in the Fifth Ward created by said death. 12 SECTION 2. Special Municipal Election; Ward Lines to be 13 Used. A special election is called in the Fifth Ward of the City 14 of San Bernardino to be held on Tuesday, the 16th day of February, 15 1982, for the purpose of electing a member of the Common Council 16 in and for the Fifth Ward of the City of San Bernardino to fill 17 the unexpired term ending on the 6th day of June, 1983. The 18 election shall be held based on the ward boundaries for the Fifth 19 Ward as established in Ordinance No. MC-112 adopted by the Mayor 20 and Common Council of the City of San Bernardino. as such 21 boundaries shall be in effect as of the date of the election. The 22 person receiving the highest number of votes at said election 23 shall be declared elected to fill the vacancy in the Fifth Ward. 24 SECTION 3. Nomination Papers. The City Clerk shall make 25 available during the period for Obtaining and filing nomination 26 papers, as specified in San Bernardino Municipal Code Chapter 2.56, 27 nomination papers for candidates seeking election to the Common 28 Council to fill the vacancy in the Fifth Ward, such papers to be MC-1l3 1 provided to candidates residing within the boundaries of the Fifth 2 Ward as established by Ordinance No. MC-112, and the City Clerk 3 shall accept completed nomination papers from candidates for such 4 vacancy who reside within the boundaries of the Fifth Ward as so 5 established. 6 SECTION 4. Non-Eligibility of Former Residents. No person 7 who is not a resident of the Fifth Ward as determined by the 8 boundaries thereof established under Ordinance No. MC-112 shall be 9 qualified as a candidate to fill such vacancy, notwithstanding JO that he or she may have resided within the former boundaries of ] 1 such Fifth Ward. ]2 SECTION 5. Clerk's Duties. The City Clerk is hereby ]3 instructed and authorized to procure, prepare and distribute all 14 necessary ballots and election supplies for the election. ]5 SECTION 6. Election Procedures and Time Limits. The ]6 election is hereby called and will be held in accordance with and ]7 under and pursuant to the Charter of the City, and in accordance ]8 with the provisions of the Elections Code of the State of 19 California, except as herein specifically provided. 20 The time provisions and procedures for filing and 21 nominations, and hours of polls shall be the same as those 22 specified in San Bernardino Municipal Code Chapter 2.56 for the 23 primary Municipal Election. 24 SECTION 7. Urgency Matter.
