MC-148 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER 19.68 OF THE SAN BERNARDINO MUNICIPAL CODE TO SPECIFICALLY REQUIRE THAT MANUFACTURED HOUSING (OTHER THAN SUCH HOUSING WHICH HAS NEVER PREVIOUSLY BEEN OCCUPIED) OBTAIN BUILDING MOVING PERMITS BEFORE BEING ESTABLISHED IN RESIDENTIAL ZONES, MAKING OTHER PROCEDURAL CHANGES TO BUILDING MOVING REQUIREMENTS, INCLUDING HEARING REQUIREMENTS, EXEMPTING MANUFACTURED HOUSING BEING MOVED INTO MOBILE HOME PARKS, AND REPEALING SECTIONS 19.68.060C and 19.68.070C RELATING TO INACTION BY THE PLANNING COMMISSION. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. Section 19.68.010 of the San Bernardino Municipal Code is amended to read as follows: "19.68.010 Permit required - Filing application. No building or structure, including manufactured housing, shall be moved into the City, or from one lot or parcel in the City to another lot or parcel in the City, without first filing with the Planning Commission an application for such moving and obtaining a permit therefrom to allow such moving to be done. Any manufactured housing certified under the National Mobile Home Construction and Safety Standards Act of 1974 which has never previously been occupied for any purpose is exempt from this restriction. II SECTION 2. Section 19.68.020 of the San Bernardino Municipal Code is amended to read as follows: "19.68.020 Placement of manufactured housing. Any manufactured housing to be located outside of a mobile orne park or subdivision shall be permitted on any lot within single family residential zones provided such manufactured housing is certified under the National Mobile Honle Construction and Safety Standards Act of 1974." Section 19.68.030 of the San Bernardino Municipal Code is amended to read as follows: "19.68.030 Information required in application. An application for a building moving permit shall be submitted to the Commission on forms provided for this purpose, setting forth in detail such data as may be required by the Commission. The application shall include the following information: A. Location and address of the old and proposed new site; B. Plot plan of the new site, setting forth the size and shape of the adjacent lots or parcels, including a description of structures and improvements thereon; C. Plans and specifications setting forth proposed improvements and remodeling of such building or structure at the new site, including landscaping; D. Building elevations or photographs specifying exterior building materials and dimensions, including roof overhangs; E. Foundation plans." SECTION 4. Section 19.68.040 of the San Bernardino Municipal Code is amended to read as follows: "19.68.040 Fees to accompany application. An application to move a building or structure shall be accompanied by fees established by resolution of the Mayor and Common Council, which fees shall be in addition to fees required by any other ordinance for this code, and said fees shall include a basic fee for processing the application, a fee for inspection by the Chief Building Inspector, and, in the case of buildings or structures moved from outside the City, a mileage charge." -2- MC-l48 1 SECTION 5. Section 19.68.050 of the San Bernardino Municipal 2 Code is amended to read as follows: 3 "19.68.050 Referral of application to building inspector. 4 Upon the filing of the application and payment of the 5 required fees, the application shall be referred to the Chief 6 Building Inspector, who shall within five days inspect the 7 building or structure and report to the Commission the type of 8 construction, age and present condition of the building or 9 structure. The applicant shall make the building or structure 10 available for inspection at the time requested by the Chief 11 Building Inspector." 12 SECTION 6. Section 19.68.060 Subsection B of the San 13 Bernardino Municipal Code is amended to read as follows: 14 "B. Within forty days after the conclusion of the hearing, 15 the Commission shall render a decision in writing. The 16 commission, in granting a building moving permit, may establish 17 conditions of approval and require such changes, repairs or 18 modifications which in its judgment are necessary and reasonable 19 to comply with the provisions of this title and other applicable 20 ordinances and regulations. In the case of manufactured housing, 21 required changes, repairs and modifications shall be limited to 22 roof overhang, roofing material, and siding material." 23 SECTION 7. Section 19.68.070 Subsection B of the San 24 Bernardino Municipal Code is amended to read as follows: 25 "B. The filing of an appeal stays proceedings in the matter 26 appealed from until the determination of the appeal. On the 27 appeal, the Council shall review the decision of the Commission, 28 ear new evidence and testimony if offered, and in deciding the -3- MC-148 I appeal may either affirm, reverse, or modify the decision of the 2 Commission. II 3 SECTION 8. Section 19.68.080 of the San Bernardino Municipal 4 Code is amended to read as follows: 5 "19.68.080 Findings of Commission. 6 The Commission shall find, in the event it approves the 7 building moving request, that such building shall be compatible 8 with and have no detrimental effect on the living environment in 9 the area into which the building or structure is to be moved. The 10 building moving request shall not be approved in the event that it II is found that one or more of the following conditions pertaining 12 to compatibility exist: 13 A. That the building or structure, other than manufactured 14 housing, to be moved does not conform to development standards of 15 the zone in which it is to be located. 16 B. That the building or structure is not in harmony with the 17 predominant general exterior architectural style of the immediate 18 neighborhood to which it is to be moved." 19 SECTION 9. Section 19.68.120 is hereby added to the San 20 Bernardino Municipal Code to read as follows: 21 "19.68.120 Exemptions. 22 Manufactured housing being moved to a site inside an approved 23 mobile home park shall be exempt from the provisions of this 24 chapter. Manufactured housing certified under the National Mobile 25 orne Construction and Safety Standards Act of 1974 which has never 26 reviously been occupied is exempt from the building moving permit 27 equirements of this chapter." 28 SECTION 10. Sections 19.68.060 Subsection C and 19.68.070 -4- . MC.-148 .'
