2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
5.44.020 OF THE SAN BERNARDINO MUNICIPAL CODE TO MAKE IT A
3 MISDEMEANOR FOR A BUSINESS TO HAVE UNTAGGED GAME MACHINES ON ITS
PREMISES.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
5 ORDAIN AS FOLLOWS:

SECTION 1. Section 5.44.020 of the San Bernardino Municipal
7 Code is amended by adding Subsection C. to read:

"c. It is unlawful for any person operating any business
9 enterprise within the City to have in operation upon the premises
10 of such person any coin-operated game machine as defined in this
11 Chapter which does not have affixed thereto in a conspicuous place
12 thereon the tag or plate issued under this Chapter as required by
13 Section 5.44.080. This section shall not apply to a person
14 owning, operating and maintaining not more than two coin-operated
15 machines as an incidental business used at a local place of
16 business having the requisite business license pursuant to Article
17 I of this Title, so long as the person actually owns, operates and
18 maintains the machine himself. A violation of the provisions of
19 this subsection shall be a misdemeanor punishable by a five
20 hundred dollar fine or six months in the County jail, or by both
21 such fine and imprisonment."
