MC-l28 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION 15.04.078 OF THE SAN BERNARDINO MUNICIPAL CODE MAKING INDEFINITE THE PERIOD DURING WHICH EXEMPTION FROM BUILDING PERMIT FEES SHALL BE GRANTED TO PROPERTY OWNERS OF RECORD AT THE TIME OF THE DISASTER FOR REPAIR OR REBUILDING. 3 4 5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 6 7 SECTION 1. Section 15.04.078 of the San Bernardino Municipal 8 Code is amended to read: 9 "15.04.078 UBC Section 303(f) added - Exemption from fees. 10 UBC Section 303 (f) is added to read as follows: 11 Section 303. (f) Exemption from Building Permit Fees. 12 1. Historic Preservation - No fees shall be charged for 13 permits issued for repairs, alterations or additions for the 14 preservation, restoration or rehabilitation of a building or 15 structure which is a qualified historical building or structure 16 pursuant to Health and Safety Code Section 18955, a qualified 17 historical property pursuant to Public Resources Code Section 18 5031, a registered historical landmark pursuant to Public 19 Resources Code Se~tion 5021, or a point of historical interest 20 pursuant to Public Resources Code Section 5022.5. 21 2. Natural Disaster Damage - No fees shall be charged for 22 permits issued for the first rebuilding project after a disaster 23 to owners of damaged or destroyed structures located in an area 24 designated as a disaster area by resolution of the Mayor and 25 Common Council to repair damage caused by natural disaster, or to 26 rebuild after loss due to such natc.ral disaster. This exception 27 shall apply only to property owners of record at the time of the 28 disaster, and not to persons subsequently acquiring the property. This section shall apply only to the natural disaster commonly known as the "Panorama Fire", which occurred on November 24 and 25, 1980, and to other disasters which may hereafter occur, where Ithe resolution of the Mayor and Common Council declaring the disaster area specifically references this section of the Code."
