ORDINANCE NO.
2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTION
3.38.040 OF THE SAN BERNARDINO MUNICIPAL CODE WAIVING FEES FOR
3 STORM WATER DRAINAGE FACILITIES FOR HOUSES BEING RELOCATED WITHIN
THE CITY DUE TO A DISASTER.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
5 ORDAIN AS FOLLOWS:

SECTION 1. Section 3.38.040 of the San Bernardino Municipal
7 Code is amened to read:

"3.38.040 Drainage fee.
9
A. There is hereby imposed a drainage fee on all land
JO development within the City. The amount and payment schedule for
11 said fee shall be established by resolution of the Common Council.
12 All drainage fees collected shall be deposited in the Planned
]3 Local Drainage Facilities Fund.

B. Notwithstanding the above, no drainage fee shall be
15 charged for houses being relocated from one site to another site
16 within the City as a result of moving the house from a disaster
17 area where the resolution of the Mayor and Common Council
18 declaring the disaster area specifically references this section
]9 of the Code."
