ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING THE SAN
BERNARDINO MUNICIPAL CODE BY ADDING CHAPTER 8.01, ADOPTING, BY
REFERENCE, TITLE 3 OF THE SAN BERNARDINO COUNTY CODE AS THE
HEALTH AND SANITATION CODE OF THE CITY OF SAN BERNARDINO.

5 DO ORDAIN AS FOLLOWS:

SECTION 1. There is hereby added to the San Bernardino
7 Municipal Code Chapter 8.01 to read as follows:
8 "HEALTH AND SANITATION CODE

8.01.010
Purpose. For the purpose of providing regula-
10
Iltions relating to public health and sanitation, the issuance of
permits and the collection of fees, and providing penalties for
11
12
the violations of such regulations, there is hereby adopted by
13
the City of San Bernardino as its Health and Sanitation Code
14
that certain code known as Title 3 of the San Bernardino County
15
Code and the whole thereof as amended, save and except such portio s
16 as are hereinafter deleted, modified or amended. Not less than
17 three copies of said code have been filed and now are on file in
18 the office of the City Clerk of San Bernardino, and the same are
19 hereby adopted and incorporated as fully as if set out at length
20 herein.

8.01.020 Exceptions to adopted code. The Health and
22 Sanitation Code is amended and changed or deleted in the following
23 respects:

A. DIVISION 1. ADMINISTRATIVE AND GENERAL REGULATIONS.
25 Chapter 1. Health Officer. Section 31.011 - Health Officer
26 appointment and duties. The phrase "outside of incorporated citie "
27 is deleted.

8.01.030 Conflict with other code provisions. Wherever

any provision of the San Bernardino Municipal Code, other than the
provisions of this Health and Sanitation Code, is in conflict with
any provision of this Health and Sanitation Code, the provision
of the San Bernardino l1unicipal Code, other than the provision
of this Health and Sanitation Code, shall prevail.
8.01.040 Penalty. Any person violating any provision
of this chapter shall be deemed guilty of a misdemeanor and,
upon conviction thereof, shall be punished as prescribed in
Chapter 1.12 of the San Bernardino Municipal Code."
SECTION 2. Validity. If any section, subsection, sentence
clause or phrase of this ordinance, or of the Health and Sanita-
tion Code adopted hereby, is for any reason held to be invalid,
such holding or holdings shall not affect the validity of the
remaining portions of this ordinance. The City Council hereby
declares that it would have passed this ordinance and each section,
subsection, sentence, clause or phrase thereof, irrespective of
the fact that anyone or more section, subsection, sentence,
clause or phrase be declared invalid.
