MC..163 2 ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING CHAPTER 2.27 TO THE SAN BERNARDINO MUNICIPAL CODE CREATING THE COMMISSION FOR 3 DISABLED PERSONS. 4 THE MAYOR AND COMMON COUNCIL OF THE CI'rY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: 5 6 SECTION 1. Chapter 2.27 is added to the San Bernardino 7 Municipal Code to read: 8 "Chapter 2.27 9 COMMISSION FOR DISABLED PERSONS 10 2.27.010 Creation. II There is created the Commission for Disabled Persons of the 12 city, which shall consist of nine members who shall serve at the 13 pleasure of the Mayor and Common Council. 14 2.27.020 Nomination - Terms. 15 Each councilman shall nominate one member who shall serve 16 during and for the term of the nominating councilman. The Mayor 17 shall nominate two members who shall serve during and for the term 18 of the Mayor. The terms shall commence and terminate at the same 19 time as, and shall coincide with, the term of the nominating 20 councilman or Mayor; provided, that when a vacancy shall occur in 21 the office of a councilman or the Mayor, the applicable term of 22 the member of the Commission shall continue until a successor has 23 been appointed by the Mayor after nomination by the councilman or 24 Mayor elected to fill such vacancy. 25 2.27.030 Appointment - Residency requirement. 26 Each member of the Commission, after having been nominated, 27 shall be appointed by the Mayor, subject to the approval of the 28 Common Council. Each member shall be and remain a local elector, MC-163 , I and each member nominated by a councilman shall be a resident of 2 the ward of such councilman at the time of his appointment and 3 shall remain a resident of the ward during his term of service. 4 It is the intent of this provision that all members appointed 5 should themselves be physically, developmentally or sensorily 6 disabled, or the parent, spouse or guardian of such a disabled 7 person, or shall otherwise be closely involved with the problems 8 of disabled persons. Subsequent vacancies shall be filled and 9 [apPointments shall be made in the manner hereinbefore set forth. 'Each member shall serve without compensation. ]0 11 2.27.040 Duties. 12 The commission shall: 13 A. Provide the expertise of disabled persons and others upon 14 request to assure that City officers and agencies are cognizant of 15 policies or practices that will enhance accessibility of 16 facilities and services within the City to the disabled. 17 B. Make recommendations to the Mayor and Common Council 18 concerning the development of programs and the adoption or 19 amendment of ordinances or procedures having a special impact on 20 isabled persons. 21 C. Provide information and recommendations regarding public 22 nd private funding sources available to the City for financing 23 rograms affecting the interests of disabled persons. 24 D. Provide a forum for discussion of topics of special 25 "nterest or relevance to disabled persons, consistent with the 26 bjectives and policies of the City, including the right to hold 27 ublic hearings on matters of concern. 28 E. Maintain liaison with organizations within the City -2- MC-163 ~ . , . . . '. . . 1 comprised of disabled persons or persons having an interest in the 2 interaction of municipal government with disabled persons. 3 F. Perform such other duties as are requested by the Mayor 4 and Common Council. 5 2.27.050 Meetings. 6 A. The Commission shall meet once a month in the City Hall, 7 San Bernardino, California, and shall adopt, by majority vote, 8 such rules as it shall deem expedient for the conduct of its 9 business. 10 B. If a member of the Commission shall fail to attend three II consecutive regular meetings without being excused by the 12 Corrmission, he shall automatically cease to be a member of the 13 Commission, and the Mayor shall fill such vacancy in the same 14 manner as set forth in Section 2.27.020. 15 C. Each meeting of the Commission shall be open to the 16 public and shall be governed by the provisions of the Ralph M. 17 Brown Act, Government Code Sections 54950.5, et seq., of the 18 state." 19 I HEREBY CERTIFY that the foregoing ordinance was duly 20 adopted by the Mayor and Common Council of the City of San 21 Bernardino at a meeting thereof, held on regular 22 the 3rd May , 1982, by the following vote, day of 23 to wit: 24 AYES: Council Members Castaneda, Reilly, Quiel, Hobbs, 25 Strickler 26 NAYS: None 27 ABSENT: Council Members Hernandez, Botts 28 ..L~ I:lt'~~ ./ City Clerk -3- MC-163 . .. .
