ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER
'13.08 OF THE SAN BERNARDINO MUNICIPAL CODE ADDING SECTION
13.08.055 TO EXEMPT CERTAIN PROPERTY FROM CONNECTION FEES
DESIGNATED FOR OFF-SITE TRUNK LINES AND COLLECTION FACILITIES
REQUIRED FOR DISPOSAL OF SANITARY SEWAGE, AND FEES FOR CONSTRUCTIOl
I AND IMPROVEMENT OF WASTE WATER TREATMENT PLANT FOR D\~LLINGS
I BEING RELOCATED WITHIN THE CITY DUE TO A DISASTER, OR FOR THE
FIRST RECONSTRUCTION OF DWELLINGS DEMOLISHED AT THE ELECTION
OF THE OWNER OR AS A PUBLIC NUISANCE PURSUANT TO CHAPTER 8.33,
OR DESTROYED BY FIRE, FLOOD OR OTHER DISASTER.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1. Section 13.08.055 is added to the San

Bernardino Municipal Code to read:

"13.08.055 Exemption of fees.
]2
A. The fees prescribed in Section 13.08.050 shall not be
13
charged for any dwelling being relocated from one existing sewer
]4
line to another existing sewer line within the City as a result
]5
of moving any such dwelling from an area designated as a disaster
]6
area by resolution of the Mayor and Common Council.
]7
B. The fees prescribed in Section 13.08.050 shall not be
]8
charged for the first reconstruction of any dwelling demolished
]9
at the election of the owner, or as a public nuisance pursuant
20
to Chapter 8.33 of this Code, or destroyed by fire other than
21
fire intentionally set by the applicant, flood or other disaster.

This exemption shall apply only if applicable permits are sought
23
within five years of the date of loss or demolition, and if
24
such fees were collected by the City at the time of construction
25
of the dwelling to be replaced. If the dwelling being recon-
26
structed includes a greater number of bedrooms than the destroyed
27
dwelling, the fees imposed in Section 13.08.050 shall apply
28
pro rata to the number of additional bedrooms in the reconstructed
