ORDINANCE NO.
2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER
2.28 OF THE SAN BERNARDINO MUNICIPAL CODE RELATING TO THE BOARD
3 OF WATER COMMISSIONERS; AND AUTHORIZING THE APPROVAL OF CHANGES
IN WATER RATES AND CHARGES BY RESOLUTION OF THE MAYOR AND COMMON
4 COUNCIL.
5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

Section 1. Chapter 2.28 of the San Bernardino Municipal
7
Code is amended by adding Section 2.28.040 to read:

"2.28.040 Water rates approval by Council resolution.
9
Water rates and charges established by the Board of Water
Commissioners pursuant to Charter Section 163 may be approved by
resolution of the Mayor and Common Council. Failure of the Mayor

and Common Council to act by the adoption of a resolution or

ordinance within 90 days after the establishment of such water
14
rates and charges shall be deemed an automatic approval of such
15
water rates and charges."
