2 ORDINANCE OF THE CITY OF SAN BERNARDINO AHENDING CHAPTER
18.28 OF THE SAN BERNARDINO HUNICIPAL CODE PERTAINING TO DEDI-
3 CATIONS ON PARCEL HAP TO PROVIDE THAT CITY ENGINEER MAY ACCEPT
OR REJECT DEDICATIONS OR OFFERS TO DEDICATE INTERESTS IN REAL
4 PROPERTY ON BEHALF OF THE CITY, AND PROVIDING THAT THE CITY
ENGINEER SHALL APPROVE, CONDITIONALLY APPROVE OR DISAPPROVE
5 PARCEL MAPS.
6 THE MAYOR AND COMHON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1. Section 18.28.200 of the San Bernardino
9 Municipal Code is amended to read:

"18.28.200 Dedications.

A. Dedications of, or offers to dedicate interests
12
in real property for specified public purposes, shall be made

by a certificate on the parcel map, signed and acknowledged
14
by those parties having any record title interest in the real
15
property being subdivided, subject to the provisions of the Map
16
Act:

1. If any street shown on a parcel map is not offered
18 for dedication, the certificate shall so state. If such statement
19
appears on a map which is approved by the City Engineer, the use
20
of the street by the public shall be permissive only.

2. An offer of dedication of real property for street
22
or public utility easement purposes shall include public utility
23
facilities located on or under the real property only to the
24
extent the intent to dedicate the facilities is expressly stated
25
in the certificate.

B. The City Engineer is hereby empowered to accept or
27
reject such dedications or offers to dedicate interests in real
property on behalf of the City, which action shall be indicated

on the parcel map, signed by the City Engineer."
SECTION 2. Section 18.28.240 is added to the San
Bernardino Municipal Code to read:
"18.28.240 Director of Public Works/City Engineer
Action.
The Director of Public Works/City Engineer shall approve,
conditionally approve or disapprove parcel maps. When a parcel
map is approved by the Director of Public Works/City Engineer,
the following certification shall be placed on the map:
'City Engineer's Certificate
This map conforms with the requirements of
the Subdivision Hap Act and local ordinance.'"
I HEREBY CERTIFY that the foregoing ordinance was duly
adopted by the Mayor and Common Council of the City of San
