ORDINANCE NO.
MC-189
2 ORDINANCE OF THE CITY OF SAN BERNARDINO APPROVING
AND ADOPTING THE REDEVELOPMENT PLAN FOR THE
3 NORTHWEST REDEVELOPMENT PROJECT AREA.
4 WHEREAS, the Community Development Commission of the City
5 of San Bernardino, hereafter "Commission" has formulated, prepared
6 and approved the proposed Redevelopment Plan for the Northwest
7 Redevelopment Project Area, hereafter "Project Area"; and
8 WHEREAS, the Planning Commission of the City of San
9 Bernardino has submitted its report and recommendation to the
10 Mayor and Common Council, recommending approval of said proposed
11 Redevelopment Plan with the addition of an implementation section;
12 and
13 WHEREAS, the Commission has adopted Rules for Owner partici-
14 pation and Business Re-Entry in the Project Area; and
15 WHEREAS, the Commission has had prepared a Draft Environ-
16 mental Impact Report, hereafter "Draft EIR", regarding said
17 Redevelopment Plan; and
18 WHEREAS, the Draft EIR was offered for review as authorized
19 and directed by the Commission; and
20 WHEREAS, pursuant to notice duly given, the Commission and
21 the Mayor and Common Council have held a full and fair Joint
22 Public Hearing on said Draft EIR and are fully advised in the
23 premises; and
24 WHEREAS, the Commission has adopted the following Resolution

"RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE
CITY OF SAN BERNARDINO APPROVING A REDEVELOPMENT PLAN; APPROVING
A REDEVELOPMENT PLAN REPORT; APPROVING AN ENVIRONMENTAL IMPACT
REPORT CONTAINED THEREIN; AND DIRECTING THE FILING OF A NOTICE
OF DETERMINATION; and
WHEREAS, the above-entitled Resolution was transmitted to
the Mayor and Common Council; and
WHEREAS, the Mayor and Common Council have adopted a
Resolution entitled:
"RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING A
REDEVELOPMENT PLAN, APPROVING A REDEVELOPMENT PLAN REPORT, APPROV-
ING AN ENVIRONMENTAL IMPACT REPORT CONTAINED THEREIN, AND DIRECT-
ING THE FILING OF A NOTICE OF DETERMINATION; and
WHEREAS, pursuant to notice duly given, a full and fair
Joint Public Hearing has been held on said Redevelopment Plan;
and
WHEREAS, 'all actions required by the Community Redevelop-
ment Law and other applicable laws have been taken in an appro-
priate and timely manner,
NOW, THEREFORE, THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO DO ORDAIN AS FOLLOWS:
SECTION 1. The purposes and intent of the Mayor and
Common Council with respect to the Project Area are to:
1. Eliminate the conditions of blight existing in the
Project Area;
2. Insure, as far as possible, that the causes of blight-
ing conditions in the Project Area will be either eliminated or

1 protected against;
2 3~ Provide participation for owners and business tenants
3 in the Project Area;
4 4. Encourage and insure the rehabilitation, rebuilding and
5 development of the Project Area;
6 5. Encourage and foster the economic revitalization of
7 the Project Area;
8 6. Redevelop and rebuild the public facilities in the
9 Project Area to provide safer and more efficient public services.
10 SECTION 2. The Redevelopment Plan for the project Area,
11 transmitted to the Mayor and Common Council with the above
12 entitled Commission Resolution, is hereby incorporated herein by
13 reference and made a part hereof as fully as if set out at length
14 herein.
15 SECTION 3. The Mayor and Common Council hereby find and
16 determine that:
17 1. The Project Area is a blighted area, the redevelopment
18 of which is necessary to effectuate the public purposes declared
19 in the Community Redevelopment Law;
20 2. The Redevelopment Plan for the Project Area will
21 redevelop the Project Area in conformity with the Community
22 Redevelopment Law and in the interest of the public peace, health,
23 safety and welfare;
24 3. The adoption and carrying out of the Redevelopment Plan
25 for the Project Area is economically sound and feasible;
26 4. The Redevelopment Plan for the Project Area conforms
27 to the General Plan of the City of San Bernardino;
28 5. The carrying out of the Redevelopment Plan for the

Project Area will promote the public peace, health, safety and
welfare of the City of San Bernardino and will effectuate the
purposes and policy of the Community Redevelopment Law;
6. The condemnation of real property, as provided for in
the Redevelopment Plan for the project Area is necessary to the
execution of such Redevelopment Plan and adequate provisions have
been made for payment for property to be acquired as provided by
law;
7. That the formation of a project area committee was not
necessary nor required because the plan does not provide for the
displacement of a substantial number of low-and moderate-income
families by the implementation of the plan.
8. The Agency has a feasible method and plan for the
relocation of families and persons that may be displaced from
housing facilities in the Pro4ect Area;
9. There are or will be provided in the Project Area or
in other areas not generally less desirable in regard to public
utilities and public and commercial facilities and at rents or
prices within the financial means of the families and persons
displaced from the Project Area; decent, safe, and sanitary
dwellings equal in number to the number of and available to such
displaced families and persons and reasonably accessible to
their places of employment;
10. There are noncontiguous areas within the Northwest
Redevelopment Project Area. However, they are either blighted
or necessary for effective redevelopment and are not included
for purpose of obtaining the allocation of taxes from such area
pursuant to Section 33670 without other substantial justification

1 for their inclusion.
2 11. There are inclusions of lands, buildings and improve-
3 ments which are not detrimental to the public health, safety, or
4 welfare, which are included because the inclusion thereof is
5 necessary for the effective development of the area of which they
6 are a part; and any such area included is necessary for effective
7 redevelopment and are not included for the purpose of obtaining
8 the allocation of tax increment revenues from such area pursuant
9 to Section 33670 of the California Health and Safety Code, with-
10 out other substantial justification for its inclusion.
11 12. The elimination of blight and the redevelopment of
12 the project area could not be reasonably expected to be accom-
13 plished by private enterprise acting alone without the aid and
14 assistance of the Redevelopment Agency.
15 SECTION 4. The Mayor and Common Council are satisfied
16 that permanent housing facilities will be available within three
17 years from the time occupants of the Project Area are displaced
18 and that pending the development of such facilities there will
19 be available to such displaced occupants adequate temporary
20 housing facilities at rents comparable to those in the City of
21 San Bernardino at the time of their displacement.
22 SECTION 5. The Mayor and Common Council are convinced
23 that the effect of tax increment financing will not cause a
24 severe financial burden or detriment on any taxing agency de-
25 riving revenues from the Project Area.
26 SECTION 6. A full and fair public hearing has been held
27 on the Redevelopment Plan for the Project Area, as stated in the
28 recitals herein, and the Mayor and Common Council having

1 considered all evidence and testimony for and against the
2 adoption of said Redevelopment Plan and all written and oral
3 objections thereto and the Mayor and Common Council being fully
4 advised in the premises, all written and oral objections to
5 said Redevelopment Plan, Report on the Plan and Environmental
6 Impact Report are hereby overruled.
7 SECTION 7. The Redevelopment Plan for the Northwest
8 Redevelopment Project Area (incorporated by Section 2 above)
9 is hereby approved and adopted and designated the official
10 Redevelopment Plan for the Northwest Redevelopment Project Area,
11 for the Project Area described therein.
12 SECTION 8. In order to implement and facilitate the effec-
13 tuation of the Redevelopment Plan for the project Area, hereby
14 approved and adopted, certain official action must be taken by

15 the City of San Bernardino, and the Mayor and Common Council
16 declare their intention to undertake and complete any proceed-
17 ings necessary to be carried out by the City of San Bernardino
18 under the provisions of said Redevelopment Plan, including,
19 without limitation, changes in zoning, the location and reloca-
20 tion of public facilities, and other similar public actions,
21 and in pursuance thereof, and without limitation, the Mayor and
22 Common Council hereby:
23 1. Pledge their cooperation in helping to carry out the
24 Redevelopment Plan;
25 2. Direct the various officials, departments, boards and
26 agencies of the City of San Bernardino having administrative
27 responsibilities in the premises likewise to cooperate to such
28 end and to exercise their respective functions and powers in a

manner consistent with said Redevelopment Plan; and
3. Use their best efforts to cause any agreement, deed
or lease submitted by the Agency to the Mayor and Common Council
for their approval or disapproval to be acted upon within thirty
(30) days after submission to the Mayor and Common Council.
SECTION 9. The Mayor and Common Council may exoend funds
of the City of San Bernardino from time to time in accordance
with the applicable provisions of the Redevelopment Plan for the
Project Area.
SECTION 10. The City Clerk is hereby directed to send a
certified copy of this Ordinance to the Commission and the
Commission is hereby vested with the responsibility for carrying
out the Redevelopment Plan for the Project Area.
SECTION 11. The City Clerk is hereby directed to record
with the County Recorder of San Bernardino County a description
of the land within the Project Area and a statement that proceed-
ings for the redevelopment of the Project Area have been
instituted under the Community Redevelopment Law.
SECTION 12. The City Clerk is hereby directed for a period
of two (2) years after the effective date of this Ordinance, to
advise all applicants for building permits within the Project
Area that the site for which a building permit is sought for the
construction of buildings or for other improvements is within
a redevelopment project area.
SECTION 13. The City Clerk is hereby directed to transmit,
on or before January 1st next: Ii) a copy of the description
and statement recorded by the City Clerk pursuant to Section 10
of this Ordinance; (ii) a copy of this Ordinance; and (iii) a

1 map or plat indicating the boundaries of the Project Area, to
2 the Auditor and Tax Assessor of San Bernardino County, to the
3 governing body of each of the taxing agencies which levies taxes
4 upon any property in the Project Area and to the State Board
5 of Equalization.

SECTION 14. The City Clerk shall certify to the adoption
7 of this Ordinance and shall cause the same to be published in
8 the Sun.

SECTION 15. In case anyone or more of the provisions of
10 this Ordinance shall for any reason be held to be illegal or
11 invalid, such illegality or invalidity shall not affect any
12 other provision of this Ordinance but this Ordinance shall be
13 construed and enforced as if such illegal or invalid provi-
14 sions had not been contained herein.

This is to aclmowledge receipt of Ordinance No. MC-189 on July 12, 1982
adopting and approving the redevelopnent plan for the Northwest Redevelop-
ment Project Area. Also received were the map and description of the pro-
ject boundaries. Your filing is hereby accepted.
These documents have been transmitted to our mapping unit for processing.
They will establish the tax-rate area codes needed to identify this pro-
ject. This will facilitate the future computation of tax increments.
We find that the final boundaries are identical to the preliminary ones,
and that the ordinance was adopted within the time frame specified in the
Statement of Preparation. The base-year values of state-assessed properties
contained in our letter of May 5, 1982 to the San Bernardino County Auditor
are therefore still valid.

Gentlemen:
Enclosed herewith is a copy of an Ordinance of the Mayor and Common Council
of the City of San Bernardino entitled:
"An Ordinance of the City of San Bernardino Approving and
Adopting the Redevelopment Plan for the Northwest Redevelopment
Project Area".
The Redevelopment Agency of the City of San Bernardino is vested with the
responsibility for carrying out said Redevelopment Plan.
In accordance with Section 33374 of the Community Redevelopment Law, all
applicants for building permits in this area for a period of two years
thereafter shall be advised by the building department that the site for
which a building permit is sought for, is within a redevelopment project
area.
