ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SAN
BERNARDINO MUNICIPAL CODE SECTION 3.38.060 TO ESTABLISH STORM
DRAINAGE FACILITY CREDITS TO SUBDIVIDERS.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

SECTION 1.
Section 3.38.060 of the San Bernardino Municipal
7 Code is amended to read:

"3.38.060 Master plan storm drainage facility credits to
9 subdividers.

A. Subdividers who are permitted to make a cash payment in
11 lieu of construction of required master plan storm drainage
12 facili ties specified in Section 18.40.040 (" in lieu amounts"),
13 shall be given a credit limited to the difference between the cost
14 (57" RCP maximum) of the master plan facility and a 30" RCP, or
15 the amount of the standard development acreage fee provided for in
16 Section 3.38.040, whichever is less. Credits will be deducted
17 from the in lieu amount at the time of payment to the Public Works
18 Department.

B. The in lieu amount and the credit shall be limited to the
20 cost of a 57" RCP at a 14' depth for the length of one side of a
21 square parcel containing the same acreage as the subject
22 subdi vision. "
