CALLING A SPECIAL 3 ELECTION TO BE HELD IN THE FOURTH WARD. . ."; PROVIDING THAT THE REGISTRAR OF VOTERS SHALL CERTIFY THE CANVASS OF THE RETURNS TO 4 THE MAYOR AND COMMON COUNCIL WHO SHALL DECLARE THE RESULTS THEREOF; AND DECLARING THE URGENCY THEREOF. 5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO 6 ORDAIN AS FOLLOWS: 7 8 SECTION 1. Recitals. (al Ordinance No. MC-193 called a special election for 9 November 2, 1982 to fill the vacancy in the Fourth Ward and 10 consolidated the special election with the statewide general 11 election. 12 (b) Charter Section 14-A provides that such election shall 13 be conducted in accordance with state law, provided that an 14 ordinance may be adopted which can provide for the manner of 15 holding such election and prevail over state law. 16 (cl Ordinance No. MC-193 provides that the Board of 17 Supervisors shall canvass the returns but does not provide for 18 certification of the returns canvassed or declaring the results 19 thereof. 20 (dl Elections Code Section 23314 provides that the results 21 shall be declared and other proceedings done in accordance with 22 state law. 23 (e) The Mayor and Common Council desire that the Registrar 24 of Voters certify the canvass of the returns to the legislative 25 body of the City and that the Mayor and Common Council declare the 26 results thereof. 27 SECTION 2. Ordinance No. MC-193 Section 5 is amended to read 28 as follows: HC-222 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 "SECTION 5. Election Procedures and Time Limits. The election is hereby called in accordance with and under and pursuant to the Charter of the City, and will be conducted in accordance with the provisions of the Elections Code of the State of California, except that the Registrar of Voters shall canvass the returns and shall make his certification thereof to the Mayor and Common Council who shall declare the results thereof and the City Clerk shall issue the certificate of election, and with such other exceptions as may be herein provided." SECTION 3. Urgency Matter. The passage of this ordinance is an urgency matter relating to elections, and said ordinance shall be in force and take effect immediately after its passage. I HEREBY CERTIFY that the foregoing ordinance was duly adopted by the Mayor and Common Council of the City of San Bernardino at an ad-journed regular meeting thereof, held on the ~~ day of , 1982, by the following vote, November to wit: AYES: Council Members Castaneda, Reilly, Quiel, Hobbs, Strickler.
