MC-225 ORDINANCE OF THE CITY OF SAN BERNARDINO ESTABLISHING A HOME FINANCING PROGRAM FOR MODERATE AND LOW INCOME FAMILIES PURSUANT TO PART 5 OF DIVISION 31 OF THE CALIFORNIA HEALTH AND SAFETY CODE THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: Section 1. Vital Importance of Housing. The California State Legislature has declared that the subject of housing is of vital importance to the health, safety, and welfare of the residents of the State of California for the following reasons: (i) Decent housing is an essential motivating force in helping people achieve self-ful- fillment in a free and democratic society. (ii) Unsanitary, unsafe, overcrowded, or congested dwelling accommodations constitute conditions which cause an increase in, and spread of, disease and crime. (iii) A healthy housing market is one in which residents of this state have a choice of housing DIS292.4(gs) JWB052 11/17/82 . MC-225 ,. . San Bernardino 60,009-39-2 opportunities and one in which the housing consumer may effectively choose within the free narketplace. Section 2. Local Housing Finance Agencies Law. Upon finding that: (a) there exists within the state a serious shortage of decent, safe, and sanitary housing which is affordable to many persons in the state; (b) this shortage is exacerbated during periods of rising interest rates, particularly as high interest rates have the effect of diminishing the nuwber of otherwise creditworthy buyers from qualifying for private sector mortgage capital sources; and (c) in order to remedy this adverse effect on potential home buyers on the lower end of the purchasing spectrum, it is necessary to implement a public program to reduce the cost of mortgage financing for single-family purchases for those persons unable to compete for mortgage financing in the conventional mortgage market; the California State Legislature adopted the Local Housing Finance Agencies Law (Part 5 of Division 31, commencing with Section 52000, of the Health and Safety Code of the State of California). This law provides cities and counties with the authority to undertake a 2 DIS292.4(gs) JWB052 11/17/82 MC-225 San Bernardino 60,009-39-2 home financing program and to issue revenue bonds to fund such programs. Section 3. Findings. Within the City of San Bernardino there is a shortage of decent, safe and sanity housing, particularly of housing affordable by persons in the lower end of the purchasing spectrum, and a consequent need to encourage the construction of homes affordable by such persons and otherwise to increase the housing supply for such persons. Section 4. Adoption of Home Financing Program. The Mayor and Common Council hereby adopt this Ordinance, pursuant to the powers granted by Part 5 of Division 31 of the Health and Safety Code of the State of California, and hereby establish a Home Financing Program for the public purposes set forth in the Act. Section 5. Compliance With Land Use and Housing Elements. The City of San Bernardino Home Financing Program shall comply with the land use element and the housing element of the general plan of the City and the applicable general plan of the City. 3 DIS292.4(gs) JWB052 11/17/82 MC-225 l_ .: San Bernardino 60,009-39-2 Section 6. Liberal Construction. The provisions of this ordinance, being necessary for the welfare of the City of San Bernardino and its inhabi- tants, shall be liberally construed to effect the purpose of the Program. Section 7. Effective Date. This Ordinance shall take effect immediately as provided in Section 52031 of the Health and Safety Code of the State of California.
