ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTIONS
5.12.130 AND 5.12.140 OF THE SAN BERNARDINO MUNICIPAL CODE TO
PROVIDE THAT EXPOSURE OF PRIVATE PARTS BY WAITERS, WAITRESSES AND
ENTERTAINERS IN PLACES WHERE ALCOHOLIC BEVERAGES ARE SERVED OR
SOLD FOR CONSUMPTION ON THE PREMISES IS A MISDEMEANOR; AND
REPEALING SUBSECTION D OF SECTION 5.12.130 AND SUBSECTION C OF
SECTION 5.12.140.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

SECTION 1. Section 5.12.130 Subsection A of the San
9 Bernardino Municipal Code is amended to read:

"A. Every person is guilty of a misdemeanor who, while
11 acting as a waiter, waitress or entertainer in an establishment
12 which serves or offers for sale alcoholic beverages for
13 consumption on the premises of such establishment:
14
1. Exposes his or her genitals, pubic hair, buttocks, natal
15 cleft, perineum, anal region or pubic hair region; or
16
2. Exposes any device, costume or covering which gives the
17 appearance of or simulates the genitals, pubic hair, buttocks,
18 natal cleft, perineum, anal region or pubic hair region; or
19
3. Exposes any portion of the female breast at or below the
20 areola thereof."

SECTION 2. Section 5.12.140 Subsection A of the San
22 Bernardino Municipal Code is amended to read:

"A. Every person is guilty of a misdemeanor who, while
24 participating in any live act, demonstration, or exhibition in any
25 establishment which serves or offers for sale alcoholic beverages
26 for consumption on the premises of such establishment:

1. Exposes his or her genitals, pubic hair, buttocks, natal
28 cleft, perineum, anal region, or pubic hair region; or

aerola thereof."
SECTION 3. Section 5.12.130 Subsection D and Section
5.12.140 Subsection C of the San Bernardino Municipal Code are
hereby repealed.
