2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER 8.30
OF THE SAN BERNARDINO MUNICIPAL CODE TO REQUIRE NOTICE TO OWNERS
3 AS ASCERTAINED FROM TITLE RECORDS AND TO REQUIRE OWNERS TO RECORD
CERTIFICATES OF COMPLIANCE.

THE MAYOR AND CUdHOI, COUNCIL OF THE CITY OF SAN BERNARDINO DO
5 ORDAIN AS FOLLOWS:

SECTION 1. Section 8.30.040 of the San Bernardinu Municipal
7 Code is amended to read:

"8.30.040 Notice and order - Service and recordation.
9 Service of the notice and order shall be made upon all
10 persons entitled thereto either personally or by mailing of
11 notice and order by certified mail, postage prepaid, return
12 receipt requested, to each such person at his address as
13 ascertained from title company records or as known to the City
14 officer. If no address of any such person so appears or is known
15 to the City officer, then a copy of the notice and order shall be
16 so mailed and addressed to such person at the address of the land
17 or real property involved in the proceedings. The failure of any
18 such person to receive such notice shall not affect the validity
19
of any proceedings taken under this chapter.

20 mail in the manner herein provided shall be effective on the date
21 of mailing. Proof of service of the notice and order shall be
22 certified at the time of service by a written declaration under
23 penalty of perjury executed by the person effecting service,
24 declaring the time, date and manner in which service was made.
25 The declaration, together with any receipt card returned in
26 acknowledgment of receipt by certified mail, shall be affixed to
27 the copy of the notice and order retained by the City officer. If
28 compliance is not had with the order within the time specified

1 therein, and no appeal has been properly and timely filed, the
2 City officer shall file in the office of the county recorder a
3 certificate describing thc property and certifying that a public
4 nuisance exists on the real properly and that the owner has been
5 so notified. Whenever the corrections ordered have been completed
6 or the public nuisance demolished so that it no longer exists on
7 the property described in the certificate, the City officer shall
8 execute a new certificate to be filed by the owner with the county
9 recorder certifying that the public nuisance has been demolished
10 or all required corrections have been made so that a public
11 nuisance no longer exists, whichever is appropriate."
