HomeMy WebLinkAboutMC-242 , ; ~ ~ 1 2 3 4 5 6 7 8 9 Ie 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 --- ORDINANCE NO. _~'~""--242 ORDINANCE OF THE CI'rY OF SAN BERNARDINO AMENDING CHAPTER 8.33 OF THE SAN BERNARDINO MUNICIPAL CODE TO REQUIRE NOTICE TO OWNERS AS ASCERTAINED FROM TITLE RECORDS. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. Section 8.33.030 Subsection B of the San Bernardino Municipal Code is amended to read: "B. The building official shall also make prompt and adequate inspections of all buildings and structures reported or observed as being dangerous or unsafe or a public nuisance. Whenever the Superintendent of the Building and Safety Department of the City, or his representative, hereinafter called 'building official', determines that any premises are maintained contrary to one or more of the provisions of Section 8.33.010, he shall glve written notice stating the defects thereof to the owners of record as ascertained from title records or other sources. This noti.ce shall require the owner to commence the required demolition, repairs or rehabilitation of such nuisance on the premises within ten days and to complete such work within sixty days from the date of notice unless otherwise stipulated by the building official." SECTION 2. Section 8.33.030 Subsection C of the San Bernardino Municipal Code is amended to read: "C. The notice shall be served upon all persons entitled thereto, either personally or by certified mail. Service by certified mail shall be effective on the date of mailing if a certified letter containing a copy of such notice is mailed postage prepaid, return receipt requested, to each such person at the address of such person as it appears in title company record, . , MC-242 r 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 .' or as otherwise known to the building official. If no address so appears or is known to the building official, then a copy shall be addressed to such person at the address of the building or structure involved in the proceedings. The failure of any owner or other person in interest to receive such notice shall not affect in any manner the validity of any proceedings taken hereunder. The building official shall also post conspicuously at least one copy of a notice bearing the title in letters one inch high: 'NOTICE TO ABATE NUISANCE' on the building or structure or premises alleged to constitute a public nuisance as defined in section 8.33.010." SECTION 3. Section 8.33.040 of the San Bernardino Municipal Code is amended to read: "8.33.040 Noncompliance with notice - Service of notice to owner and lien, mortgage or trust deed holders. If the owner of the premises does not comply with the notice by commencing the required work within the time allowed or make such other arrangements as may be satisfactory to the building official, the building official shall thereupon serve personally or by certified mail as provided above the following form of notice to the owner and a copy to any lien, mortgage or trust deed holder or lessee as ascertained from title records or as otherwise known. The cost of consulting title records shall be charged to the owner in the same manner and using the same procedure as all other costs incurred by the City which are to be charged to the owner as set forth in this chapter. 'NOTICE OF HEARING BEFORE THE BOARD OF BUILDING COMMISSIONERS OF THE CITY OF SAN BERNARDINO. -2- MC~242 . 1 The owner of the premises situated at __ is hereby notified to appear before the Board of Building Commissioners of the City of San Bernardino at its meeting to be held on in the Council Chambers, City Hall, 300 North "D" Street, San Bernardino, California, at the hour of or as soon thereafter as he may be heard, and show cause, if any, why said premises should not be condemned as a public nuisance and said nuisance be abated by the City of San Bernardino by demolishing, repairing or rehabilitating same and charging the costs thereof to the owner as provided in Chapter 8.33 of the San Bernardino Municipal Code. 2 3 4 5 6 7 8 The sum of costs incurred to date and the alleged defects of the building are set forth in Exhibit "A" attached hereto and incorporated herein by reference. 9 10 11 Clerk to the Board of Building Commissioners for the City of San Bernardino'" 12 13 SECTION 4. Section 8.33.050 Subsection D of the San 14 Bernardino Municipal Code is amended to read: 15 "D. within ten days after the premises are posted, the Clerk 16 of the Board of Building Commissioners shall mail copies of the 17 resolution to the owner and other persons in interest to the 18 addresses as ascertained from title company records or as otherwisE 19 known by the building official. Two copies of the resolution 20 shall be fOri-larded to the City Clerk for transmitting to the l1ayor 21 and Common Council.
