ORDINANCE Of' THE CITY OF SAN BERNARDINO AMENDING SECTION
18.44.030 OF THE SAN BERNARDINO MUNICIPAL CODE TO PERMIT GUARANTEE
BY REDEVELOPMENT AGENCY IN LIEU OF BOND, CASH OR SECURITY IN
DEVELOPMENTS COVERED BY DISPOSITION AND JOINT DEVELOPMENT
AGREEMENT.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

SECTION 1. Section 18.44.030 of the San Bernardino Municipal
8 Code is amended to read:

"18.44.030 Agreement between Redevelopment Agency and City
10 in lieu of bond.
11 An agreement between the Redevelopment Agency of the City and
12 the City, approved by the City Attorney and unconditionally
13 providing and guaranteeing that said agency shall provide any or
14 all required improvements and pay the costs thereof pursuant to
15 the provisions of this chapter, and which pledges the full faith
16 and credit of said Redevelopment Agency, may be filed ,lith the
17 Director of Public Works as security in lieu of bond, cash, or
18 certificate of deposit whenever the project is located in a
19 redevelopment project area or the project is covered by a
20 disposition and joint development agreement of which the City or
21 Redevelopment Agency is a party. The guarantee agreement shall
22 recite that the improvements will be in compliance with the
23 redevelopment plan, if any, for the area and in furtherance of the
24 pub I ic interest in promoting public or private development."
