2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING SECTIONS
5.40.090 AND 8.15.170 SUBSECTION B OF THE SAN BERNARDINO MUNICIPAL
3 CODE AND ADDING CHAPTER 9.90 TO THE SAN BERNARDINO MUNICIPAL CODE
TO ESTABLISH AUTHORITY OF CERTAIN FIRE OFFICERS, POLICE OFFICERS,
4 PARKING CONTROL CHECKERS AND CERTAIN SECURITY OFFICERS, TO ENFORCE
LITTER PROVISIONS OF THE SAN BERNARDINO MUNICIPAL CODE.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
6 ORDAIN AS FOLLOWS:

SECTION 1. Section 5.40.090 of the San Bernardino Municipal
8 Code is amended to read:

"5.40.090 Enforcement.
10 Security guard personnel employed by the Redevelopment Agency
11 of the City of San Bernardino shall enforce the provisions of this
12 chapter under authority granted pursuant to Section 9.90.010 of
13 the San Bernardino Municipal Code."

SECTION 2. Section 8.15.170 Subsection B of the San
15 Bernardino Municipal Code is amended to read:

"E. The Fire Chief of the City shall have primary
17 responsibility for enforcement of this chapter, and shall
18 coordinate the efforts of fire enforcement personnel, parking
19 control checkers, security officers of the Redevelopment Agency of
20 the Ci ty of San Bernard ino, and pol ice off icers. Parking control
21 checkers, security officers employed by City through the budget
22 of the Central City Parking District, fire enforcement personnel
23 designated by the Fire Chief, and police officers shall have
24 authority, and security officers employed by the Redevelopment
25 Agency of the City of San Bernardino shall have authority within
26 all public areas of the Central City Mall complex bounded by
27 Second Street on the south, "E" Street on the east, Fourth Street
28 on the north, and "G" Street on the west, to perform any act,

1 including the preparation and issuance of written notices to
2 appear for violations of this chapter, under and pursuant to
3 Section 836.5 and Chapter 5C of Part 2 Title 3 (Sections 853.6, et
4 seq.) of the California Penal Code."

SEC'i'ION 3. Chapter 9.90 is added to the San Bernardino
6 Municipal Code to read:
7 "Chapter 9.90
8 AUTHORITY TO ARREST - CITATIONS

9.90.010 Arrest - Citation.
10 Security guard personnel, who shall be off-duty or retired
11 pol ice off icers or reserve pol ice officers, employed by the
12 Redevelopment Agency of the City of San Bernardino pursuant to an
13 agreement between said Agency and the City, relating to a security
14 guard program, are authorized and empowered to arrest and issue
15 notices to appear for violations of the provisions of Chapter
16 5.40, Chapter 8.15, Chapter 9.48, Chapter 12.44, and Section
17 9.12.030 as to incidents arising in the Central City Mall and
18 public areas in, adjacent to, or immediately surrounding said
19 Mall, pursuant to Section 836.5 and Chapter 5C and 5D of Part 2,
20 Title 3 (Sections 853.6, et seq.l of the California Penal Code."
21 I HEREBY CERTIFY that the foregoing ordinance was duly
22 adopted by the Mayor and Common Council of the City of San
