2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER 2.56
OF THE SAN BERNARDINO MUNICIPAL CODE TO PROHIBIT THE HANDLING AND
3 MAILING OF ABSENTEE BALLOTS BY VOLUNTEERS OR WORKERS OF ANY
CANDIDATE OR SUPPORTING OR OPPOSING ANY MEASURE. (URGENCY

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

SECTION 1. Chapter 2.56 of the San Bernardino Municipal Code
8 is amended by adding thereto Section 2.56.001 to read:

"2.56.001 Law governing municipal elections.

A. Primary, general, special or recall municipal elections
11 shall be conducted in the manner provided for by general law
12 except as hereinafter set forth, or as may be otherwise provided
13 by ordinance or resolution.

1. Notwithstanding the provisions of Elections Code
15 Section 1013 or any judicial interpretation thereof, after the
16 receipt by the voter of an absent voter ballot, no election
17 campaign volunteer or worker shall handle or mail the ballot of
18 such absentee voter in any primary, general, special, or recall
19 municipal election."

SECTION 2. This ordinance is an urgency measure relating to
21 elections and shall become effective and operative on April 26,
22 1983 at 12:00 noon. It shall apply prospectively to absent voting
23 for the General Election to be held on May 3, 1983. The
24 circumstances constituting the urgency are that one or more
25 candidates are presently using campaign workers to collect and
26 handle voted absentee ballots, and that the possibility of vote
27 fraud is present which may taint the pending municipal election.
