MC-277 2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING TITLE 2 AND TITLE 15 OF THE SAN BERNARDINO MUNICIPAL CODE TO ESTABLISH UNIFORM 3 PROCEDURES FOR APPOINTMENTS, TERMS, COMPENSATION, MEETINGS AND QUORUMS FOR CERTAIN BOARDS, BUREAUS, AND COMMISSIONS, AND 4 REPEALING PORTIONS OF TITLE 2, OF TITLE 3 AND OF TITLE 5 OF THE SAN BERNARDINO MUNICIPAL CODE. 5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO 6 ORDAIN AS FOLLOWS: 7 SECTION 1. Chapte~ 2.17 is added to the San Bernardino 8 Municipal Code to read as follows: 9 "Chapter 2.17 10 BOARDS, BUREAUS AND COMMISSIONS - GENERAL 11 2.17.010 General provisions. 12 This chapter establishes the manner of appointments, term of 13 service, compensation, meeting times, and provisions for vacating 14 of offices of members of the following boards, bureaus and 15 commissions: 16 A. Human Services Commission; 17 B. Planning Commission; 18 C. Central City Parking Place Commission; 19 D. Animal Advisory Commission; 20 E. Commission for Disabled Persons; 21 F. Board of Fire Commissioners; 22 G. Board of Police Commissioners; 23 H. Community Television Commission; 24 I. Cemetery Commission; 25 J. Bureau of Franchises; 26 K. Board of Building Commissioners; 27 L. Central City Advisory Board. 28 2.17.020 Members. 29 Each board, bureau and commission subject to the provisions MC-277 , 1 of this chapter shall consist of nine members, selected in the 2 anner specified in Section 2.17.030. 3 2.17.030 Nomination - Terms. 4 Each Council member shall nominate one member of each such 5 board, bureau and commission who shall serve during and for the 6 term of the nominating Council member. The Mayor shall nominate 7 two members to each such board, bureau and commission, who shall 8 serve during and for the term of the Mayor. The terms of board, 9 bureau and commission members shall coincide with the term of the 10 nominating Council member or Mayor, provided that when a vacancy 11 shall occur in the office of the Council member or the Mayor who 12 originally nominated any member, the applicable term of that 13 member of the board, bureau or commission shall continue until a 14 successor has been appointed. Nomination and appointment of a 15 replacement member at any time shall terminate the appointment of 16 any member so replaced, without need for formal removal action. 17 2.17.040 Appointment - Registered voter requirement - 18 Compensation - Oath. 19 Each member of such board, bureau or commission, after having 20 been nominated, shall be appointed by the Mayor, with the approval 21 of the Common Council. Each member shall be and remain a 22 registered voter within the City and each member of such board, 23 bureau or commission nominated by a Council member shall be and 24 remain a resident of the ward of the such Council member during 25 the term of appointment. Members shall serve, without 26 compensation, at the pleasure of the Mayor and Common Council. 27 Any member no longer holding the qualifications required for 28 appointment shall cease to serve as a member, and such member's -2- MC-277 . ~. 1 position shall be deemed vacant, except that if a ward boundary 2 change results in the member no longer residing in the nominating 3 Council member's ward, such member may continue to serve until a 4 replacement member is nominated and appointed. Any vacancy shall 5 be filled and appointment shall be made in the manner hereinbefore 6 set forth as for an original appointment. 7 2.17.050 Oath of Office. 8 Prior to undertaking his or her duties as a member of any 9 such board, bureau or commission, the member shall subscribe and 10 file his or her official oath of office with the City Clerk. 11 2.17.060 Chairman - Meetings - Absences. 12 A. Each board, bureau and commission shall elect a chairman 13 and vice-chairman from among its members, and the chairman and 14 vice-chairman shall serve for a term of one year. The board, 15 bureau or commission shall meet not less than once a month in the 16 City Hall, San Bernardino, California, or such other place within 17 the City as the board, bureau or commission may select. 18 B. If a member of any board, bureau or commission fails to 19 attend three consecutive regular meetings without excuse from the 20 chairman, which excuse must be obtained within five calendar days 21 before or after any meeting date, he or she shall automatically 22 cease to be a member of the board, bureau or commission, and the 23 chairman of such board, bureau or commission shall notify the 24 former member and the nominating official of the declared vacancy. 25 The vacant office shall be filled by nomination and appointment 26 made in the manner of the original appointment. 27 C. Meetings of each board, bureau or commission shall be 28 open to the public and shall be governed by the provisions of the 29 Ralph M. Brown Act, Sections 54950.5, et seq., California -3- MC-27/ . 1 Government Code. 2 2.17.070 Quorum. 3 Any five members in attendance at any meeting shall 4 constitute a quorum. Except for public hearings (which shall not 5 be conducted without a quorum), a board, bureau or commission may 6 meet in the absence of a quorum as a committee of the whole, and 7 recommend actions and propose resolutions which, if ratified at a 8 subsequent meeting of such board, bureau or commission at which a 9 quorum is present, shall constitute the official action of such 10 board, bureau or commission." 11 SECTION 2. Section 2.20.020 of the San Bernardino Municipal 12 Code is amended to read: 13 "2.20.020 Members - Appointment. 14 The Human Services Commission of the City shall consist of 15 nine members who shall serve at the pleasure of the Mayor and 16 Common Council. Members shall be appointed and shall serve 17 pursuant to the provisions of Chapter 2.17." 18 SECTION 3. Section 2.22.010 of the San Bernardino Municipal 19 Code is amended to read: 20 "2.22.010 Members - Appointment. 21 The Planning Commission of the City shall consist of nine 22 members who shall serve at the pleasure of the Mayor and Common 23 Council. Members shall be appointed and serve pursuant to the 24 provisions of Chapter 2.17." 25 SECTION 4. Section 2.22.020 of the San Bernardino Municipal 26 Code is amended to read: 27 "2.22.020 Duties. 28 The commission shall perform the duties and functions -4- MC-2~7 .. 1 prescribed in Title 19 and other ordinances. The commission shall 2 prepare, adopt and periodically review and revise a comprehensive 3 long-term general plan for the physical development of the City 4 and any land outside the boundaries thereof which in the 5 commission's judgment bears relation to the planning or 6 development of the City itself. Such plans shall be known as the 7 general plan and shall be so prepared that all or portions thereof 8 may be adopted by the Common Council as a basis for the 9 development of the City for such reasonable period of time next 10 ensuing after the adoption thereof as may be practicably covered 11 thereby." 12 SECTION 4. Chapter 2.24 of the San Bernardino Municipal Code 13 is amended to read: 14 "Chapter 2.24 15 CENTRAL CITY PARKING PLACE COMMISSION 16 2.24.010 Members - Appointment. 17 The Central City Parking Place Commission shall consist of 18 nine members who shall serve at the pleasure of the Mayor and 19 Common Council, all of whom shall be owners or lessees of property 20 or the holders of licenses for businesses located within the 21 limits of the Central City Parking District, or the designees of 22 such persons. Members shall be appointed and serve pursuant to 23 the provisions of Chapter 2.17, except that the registered voter 24 and residency requirements of Section 2.17.040 shall not apply. 25 2.24.020 Representation of public generally. 26 The Mayor and Common Council declare that the individuals 27 appointed to the commission are intended to represent and further 28 the interest of the holders of licenses of all businesses and the -5- MC-277 . .. 1 owners or lessees of all property located within the district, and 2 that such representation and furtherance will ultimately serve the 3 public interest. Accordingly, the Mayor and Common Council find 4 that for the purposes of members of the commission, the holders of 5 licenses of all businesses in the district and the owners or 6 lessees of property located in the district are tantamount to and 7 constitute the public generally within the meaning of Section 8 87103 of the California Government Code. 9 2.24.030 Responsibilities. 10 'l'he commission shall be responsible for recommending 11 operating policies and procedures for Parking Lots 1, 2 and 3, and 12 such other parking places and facilities as may be assigned for 13 such responsibility by the Mayor and Common Council, including the 14 provision of security, enforcement of regulations, lighting, 15 maintenance, repair and needed improvements. 16 2.24.040 Recommendations. 17 The commission may recommend time-limit parking to be 18 effective in the parking facilities and such other measures as it 19 may consider necessary in order to effectively control and operate 20 the facilities. The commission may also recommend rental fees or 21 charges for all or a portion of the parking places under its 22 con trol. 23 2.24.050 Time-limit parking controls and restrictions. 24 The commission, in the exercise of its responsibilities for 25 maintaining and operating an effective system of public, off- 26 street parking within the district, may recommend such time-limit 27 parking controls and restrictions with respect to on-street 28 parking as it may believe to be necessary to implement the overall -6- MC-277 1 goals and objectives of the parking district. 2 2.24.060 Review of improvements, modifications or deletions 3 of parking places. 4 No improvements, modifications or deletions of any parking 5 places under the charge of the commission shall be made unless, or 6 until, the improvements, modifications or deletions shall first 7 have been reviewed by the commission and a recommendation made 8 thereon to the Mayor and Common Council. 9 2.24.070 Responsibility for recommending parking 10 requirements. 11 The commission shall be responsible for developing and 12 recommending parking requirements for adoption by the Mayor and 13 Common Council in connection with the construction of new 14 buildings and the major modification of existing buildings within 15 the district. All requests for the waiver of any required off- 16 street parking within the district shall be referred to the 17 commission for review and recommendation prior to any such waiver 18 being granted by any other agency of the City. 19 2.24.080 Annual estimate of proposed expenditures. 20 Annually, on or before April 30th of each year, the 21 commission shall cause to be prepared an estimate of proposed 22 expenditures required for meeting the costs of security, 23 operation, maintenance, repair and improvement of parking places 24 within the district for the ensuing fiscal year, together with 25 such funds as may be required for any additional parking spaces 26 which the commission may be recommending for acquisition. 27 2.24.090 Annual estimate of resources. 28 Concurrently with the submission of the estimate of proposed -7- MC-271 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ~ '. expenditures mentioned in Section 2.24.080, the commission shall also submit an estimate of the district resources required to meet the financial needs of the parking district, including unexpended funds, projected revenues from parking fees and charges, if any, and the amount to be raised by taxation. The commission shall cause to be prepared a listing by July 15th of the amounts recommended to be levied on each parcel of property within the district during the ensuing year in order to meet the obligations of the district." SECTION 5. Chapter 2.26 of the San Bernardino Municipal Code is amended to read: "Chapter 2.26 ANIMAL ADVISORY COMMISSION 2.26.010 Members - Appointment. The Animal Advisory Commission of the City shall consist of nine members who shall serve at the pleasure of the Mayor and Common Council. Members shall be appointed and serve pursuant to the provisions of Chapter 2.17. 2.26.020 Duties. The commission shall: A. Review all City ordinances and procedures relating to animals and animal control, and make recommendations to the Mayor and Common Council regarding amendment or revision of ordinances or procedures, or the adoption of any new programs relating to animals; B. Maintain liaison with organizations in the San Bernardino community having an interest in matters relating to animals, and cooperate with and assist such organizations whenever consistent -8- M.C-277 . ... 1 with the objectives and policies of the City." 2 SECTION 6. Chapter 2.27 of the San Bernardino Municipal Code 3 is amended to read: 4 "Chapter 2.27 5 COMMISSION FOR DISABLED PERSON 6 2.27.010 Members - Appointment. 7 The Commission for Disabled Persons of the City shall consist 8 of nine members who shall serve at the pleasure of the Mayor and 9 Common Council. Members of the commission shall be appointed and 10 serve pursuant to the provisions of Chapter 2.17. 11 2.27.020 Duties. 12 The commission shall: 13 A. Provide the expertise of disabled persons and others upon 14 request to assure that City officers and agencies are cognizant of 15 policies or practices that will enhance accessibility of 16 facilities and services within the City to the disabled. 17 B. Make recommendations to the Mayor and Common Council 18 concerning the development of programs and the adoption or 19 amendment of ordinances or procedures having a special impact on 20 disabled persons. 21 C. Provide information and recommendations regarding public 22 and private funding sources available to the City for financing 23 programs affecting the interests of disabled persons. 24 D. Provide a forum for discussion of topics of special 25 interest or relevance to disabled persons, consistent with the 26 objectives and policies of the City, including the right to hold 27 public hearings on matters of concern. 28 E. Maintain liaison with organizations within the City -9- , MC-2.77 .. 1 comprised of disabled persons or persons having an interest in the 2 interaction of municipal government with disabled persons. 3 F. Perform such other duties as are requested by the Mayor 4 and Common Council." 5 SECTION 7. Chapter 2.32 of the San Bernardino Municipal Code 6 is amended to read: 7 "Chapter 2.32 8 BOARD OF FIRE COMMISSIONERS 9 2.32.010 Members - Appointment. 10 A Board of Fire Commissioners of the City, to be known as the 11 Fire Commission, shall consist of nine members who shall serve at 12 the pleasure of the Mayor and Common Council, six of whom shall be 13 persons with substantial experience in fire control 14 administration, fire insurance, or fire control enforcement. 15 Members shall be appointed and serve pursuant to the provisions 16 of Chapter 2.17. 17 2.32.020 Definitions. 18 For the purpose of this chapter, the term 'members' means the 19 members of the Fire Commission of the City; 'Council' means the 20 Mayor and Common Council; 'Chief' means Fire Chief of the City; 21 and' rules' means the rules and regulations of the Fire 22 Commission. 23 2.32.030 Powers. 24 The commission shall have power to: 25 A. Prescribe such rules and regulations as they deem 26 necessary or expedient for the administration of their duties, 27 subject to approval by the Council, and shall adopt as a part of 28 said rules the present rules and regulations of the Fire -10- MC-277 I . 1 Department, which may be amended from time to time; 2 B. Investigate and examine or inquire into the affairs or 3 operation of any division or department of the Fire Department and 4 make such recommendations to the Chief as the commission may seem 5 desirable; 6 C. Keep informed as to the latest practices in the field of 7 fire control and administration and recommend to the Chief such 8 new practices as appear to be of benefit to the Fire Department 9 and to the public; 10 D. Assist the Chief upon his request in matters pertaining 11 to appointments and promotions in the Fire Department; 12 E. Conduct public hearings on matters assigned to the Fire 13 Commission under provisions of the San Bernardino Municipal Code, 14 and as may be requested by the Council. 15 F. Appear before and address the Council at any meeting." 16 SECTION 8. Chapter 2.34 of the San Bernardino Municipal Code 17 is amended to read: 18 "Chapter 2.34 19 BOARD OF POLICE COMMISSIONERS 20 2.34.010 Members - Appointment. 21 A board of Police Commissioners of the City, to be known as 22 the Police Commission, shall consist of nine members who shall 23 serve at the pleasure of the Mayor and Common Council. Members of 24 the commission shall be appointed and serve pursuant to the 25 provisions of Chapter 2.17." 26 2.34.020 Definitions. 27 For the purpose of this chapter, the term 'members' means the 28 members of the Police Commission; 'Council' means the Mayor and -11- C"'1U-&.~ ' 1 Common Council; 'Chief' means Chief of Police of the City; 2 and 'rules' refers to the rules and regulations of the Police 3 Commission. 4 2.34.030 Powers. 5 The board shall have power to: 6 A. Prescribe such rules and regulations as it deems 7 necessary or expedient for the administration of its duties, 8 subject to approval by the Council, and to adopt as a part of said 9 rules the present rules and regulations of the Police Department, 10 wh ich may be amended from time to time; 11 B. Investigate and examine or inquire into the affairs or 12 operation of any division or section of the Police Department and 13 make such recommendations to the Chief or Council as may seem 14 des irable; 15 C. Keep informed as to the latest practices in the field of 16 law enforcement and recommend to the Chief or Council such 17 practices as may appear to be beneficial to the Police Department 18 and to the public; 19 D. Assist the Chief, upon his request, in matters pertaining 20 to appointments and promotions in the Police Department; 21 E. Upon request of the Chief or Council, review and hear 22 such matters as the Chief may submit for consideration and 23 recommendation. 24 F. Appear before and address the Council at any meeting. 25 G. In January of each year, review the current rate schedule 26 of the California Highway Patrol for towing charges, and other 27 relevant information, and make recommendations to the Council for 28 any appropriate revisions of the City's rate schedule for towing -12- ". 1 charges. 2 2.34.040 Notification of civil disaster or disorder. 3 The Police Department, in its discretion, shall notify the 4 commission as soon as possible of the occurrence of any civil 5 disaster or disorder which the Chief determines to be likely to 6 attract public comment or inquiry." 7 SECTION 9. Chapter 2.42 of the San Bernardino Municipal Code 8 is amended to read: 9 "Chapter 2.42 10 COMMUNITY TELEVISION COMMISSION 11 2.42.010 Members - Appointment. 12 The Community Television Commission shall consist of nine 13 members who shall serve at the pleasure of the Mayor and Common 14 Council, and who shall be and shall remain as users of cable 15 television with the City. The Mayor and Common Council declare 16 that the individuals appointed to the Commission are intended to 17 represent and further the interests of consumers of cable 18 television services and to serve the public interests. Members of 19 the Commission shall be appointed and serve pursuant to the 20 provisions of Chapter 2.17. 21 2.42.020 Responsibilities. 22 The commission shall: 23 A. Prescribe such rules and regulations as it deems 24 necessary or expedient for the administration of its duties, 25 including a procedure for complaint resolution, subject to 26 approval by the Mayor and Common Council. 27 B. Review all City franchises, ordinances, resolutions, and 28 procedures relating to cable television service, and make -13- MC-277 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 . I recommendations to the Mayor and Common Council regarding amendment or revision of ordinances or procedures or the adoption of any new rules or regulations relating to services provided by cable television companies. C. Review and make recommendations to the Mayor and Common Council on requested rate increases, establish criteria for determining whether rate changes should be recommended, and recommend changes designed to afford all users within the City comparable service at comparable cost. D. Investigate, hear and resolve complaints regarding community cable television services and non-compliance with applicable ordinances and law. E. Study developments in cable television technology to determine whether and when to recommend that service to the San Bernardino community should be expanded or improved. F. Establish criteria for the solicitation and granting of additional franchises for providing service within the City. G. Recommend action to be taken by the Mayor and Common Council in regard to state or federal administrative and legislative action, including but not limited to applications, licensing, studies, and legislative enactments. H. Upon request, maintain the confidentiality of business documents and information which are not public records, and the same shall not become public records by reason of disclosure to the Commission." SECTION 10. Chapter 2.43 is added to the San Bernardino Municipal Code to read: . . . . . -14- MC-277 . . ., 1 2 3 "Chapter 2.43 BUREAU OF FRANCHISES 2.43.010 Members - Appointment. 4 The Bureau of Franchises of the City shall consist of nine 5 members who shall serve at the pleasure of the Mayor and Common 6 Council. Members shall be appointed and serve pursuant to the 7 provisions of Chapter 2.17. 8 2.43.020 Powers - Authority to adopt rules. 9 The bureau shall have the power to promulgate rules and 10 regulations as may be necessary for the service and safety of the 11 operation of the motor vehicles regulated under the provisions of 12 Chapter 5.76, and shall have, subject to the approval of the 13 Common Council, power and authority to adopt such rules and 14 regulations as are consistent with the provisions of Chapter 15 5.76." 16 Section 11. Chapter 2.44 of the San Bernardino Municipal 17 Code is amended to read: 18 "Chapter 2.44 19 CEMETERY COMMISSION 20 2.44.010 Pioneer Memorial Cemetery. 21 The cemetery establ ished upon Lots 8, 9, and 10, Block 3, 22 Rancho San Bernard ino, heretofore conveyed to the City, and 23 dedicated to cemetery purposes, is designated 'Pioneer Memorial 24 Cemetery.' 25 2.44.020 Members - Appointment - Duties. 26 The Cemetery Commission shall consist of nine members who 27 shall serve at the pleasure of the Mayor and Common Council. 28 Members shall be appointed and shall serve pursuant to the -15- MC-277 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 -< ,. provisions of Chapter 2.17. The duties of the commission shall include the maintaining of Pioneer Nemorial Cemetery. The Cemetery Superintendent shall serve as secretary of the commission, and the chairman shall be designated and serve as president of the commission. 2.44.030 Powers. A. The commission shall have the sole management and control of Pioneer Nemorial Cemetery, with power to contract for the sale or endowment care of burial lots or plots within the cemetery in accordance with a schedule of sale prices established by resolution adopted by the Mayor and Common Council. The president and secretary of the commission are authorized to execute on behalf of the City such authorized sales and endowment care contracts. The commission shall administer, collect and recommend changes in rates and charges established by the i1ayor and Common Council for digging graves, preparation of graves, setting monuments, care of plots and such other services as may be provided. B. Except as specifically authorized by this chapter, the commission shall not create any indebtedness against the City without securing authorization therefor from the Mayor and Common Council. C. The commission may recommend the appointment of a Cemetery Superintendent to the Mayor, and the Mayor shall consider any such recommendation in making an appointment. Such appointment shall be subject to the approval of the Common Council. -16- Me-i77: . . . :; '. i. 1 2.44.040 Record of deceased persons. 2 The Cemetery Superintendent, or other authorized officer, 3 shall maintain a record of all deceased persons buried within the 4 cemetery and shall accept and deposit with the City Treasurer all 5 money received from cemetery endo..nnent care contracts, sale of 6 lots or plots, and any charges established by the Mayor and 7 Common Council." 8 SECTION 11. Chapter 2.45 is added to the San Bernardino 9 Municipal Code to read: 10 "Chapter 2.45 11 Board of Building Commissioners 12 2.45.010 Members - Appointment. 13 The Board of Building Commissioners shall consist of nine 14 members who shall serve at the pleasure of the Mayor and Common 15 Council. Members shall be appointed and serve pursuant to the 16 provisions of Chapter 2.17. 17 2.45.020 Duties. 18 The board shall have such duties as are delegated to it by 19 the Uniform Building Code, as adopted by the City, and any 20 amendments thereto, and such other duties as are prescribed in 21 Chapters 8.27, 8.30, 8.33 and 15.28 of the San Bernardino 22 Municipal Code, or any other section of the San Bernardino 23 Municipal Code assigning duties to such board." 24 SECTION 12. Section 15.04.070 of the San Bernardino 25 Municipal Code is amended to read: 26 27 28 "15.04.070 Board of appeals. UBC Section 204 is amended to read as follows: Section 204. The Board of Building Commissioners of the City -17- MC-277 , 28 - , ' , . . 1 of San Bernardino shall serve as the Board of Appeals. The 2 building official shall be clerk of the board. The board shall 3 have such duties as are delegated to it by the Uniform Building 4 Code as adopted in the City, and other duties as may be delegated 5 by other provisions of the San Bernardino Municipal Code." 6 SECTION 13. Chapter 2.47 is added to the San Bernardino 7 Municipal Code to read: 8 "Chapter 2.47 9 CENTRAL CITY ADVISORY BOARD 10 2.47.010 Members - Appointment. 11 The Central City Advisory Board of the City shall consist of 12 nine members who shall serve at the pleasure of the Mayor and 13 Common Council. Members shall be appointed and serve pursuant to 14 the provisions of Chapter 2.17. The City Administrator or his 15 designated representative shall administer the parking and 16 business improvement area tax and shall serve as the executive 17 officer of the board. 18 2.47.020 Duties - Expenditure of area tax funds. 19 The board shall: 20 A. Make recommendations to the Mayor and Common Council 21 relating to the proposed uses to which the proceeds from the 22 Central City Parking and Business Improvement Area Tax provided 23 for in Chapter 3.64 shall be put. 24 B. Submit annually a tentative budget at the same time to be 25 processed in the same manner as are the tentative budgets 26 submitted by the regular departments of the City. The tentative 27 budget shall cover the projects, programs and activities proposed for the ensuing fiscal year with a concentration on the problem -18- MC-217 '. . . .. ". . ... "", 1 of off-street parking. The majority of area tax revenue shall be 2 used for off-street parking purposes. All requests for the 3 expenditure of area funds shall be reviewed by the City 4 Administrator to assure conformity with the annual budget approved 5 by the Mayor and Common Council. All claims shall be processed by 6 the Finance Department in the same manner as are the claims of 7 other departments. 8 2.47.030 Conflict of interest. 9 The Mayor and Common Council declare that the individuals 10 appointed to the board are intended to represent and further the 11 interests of all businesses, occupations and professions of the 12 area, and that such representation and furtherance will ultimately 13 serve the public interest. Accordingly, the Mayor and Common 14 Council find that for the purposes of persons who are members of 15 the board, the businesses, occupations and professions in the area 16 are tantamount to and constitute the public generally within the 17 meaning of Section 87103 of the Government Code." 18 SECTION 14. All present members of boards, bureaus or 19 commissions serving under the provisions of Chapter 2.17 or 20 Chapter 3.64 shall continue to serve until the Council member or 21 Mayor who nominated such member or members shall cease to hold 22 that position, or until any such member is replaced by action of 23 the Mayor and Common Council, whichever shall occur first. Fixed 24 terms of members of boards, bureaus and commissions heretofore 25 existing are hereby abolished, effective immediately. All members 26 shall serve at the pleasure of the Mayor and Common Council. 27 SECTION 15.
