ORDINANCE OF THE CITY OF SAN BERNARDINO ADDING SECTION
8.18.082 TO THE SAN BERNARDINO MUNICIPAL CODE TO PROVIDE FOR
SUMMARY ABATEMENT WITHOUT NOTICE OF NUISANCES PER SE AS DECLARED
IN COMMON OR STATUTE LAW, AND FOR RECOVERY AGAINST THE PROPERTY OF
THE COSTS OF ABATEMENT, AND DECLARING THE URGENCY THEREOF.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

SECTION 1. Section 8.18.082 is added to the San Bernardino
8 Municipal Code to read:

"8.18.082 Summary abatement of nuisance per se without
10 notice.
11 In cases where the Fire Chief of the City finds the existence
12 of a public emergency or threatening public calamity or where
13 immediate action is essential, he may order the abatement of any
14 or all matter referred to in Section 8.18.010 without notice or
15 hearing, and the expense of such abatement shall be a lien on the
16 lot.
17 The matter referred to in Section 8.18.010 which may be
18 abated pursuant to this section shall be those things which are by
19 the common or statute law declared to be nuisances per se, or
20 which are in their very nature palpably and indisputably such.
21 The procedures to be followed with respect to the assessment
22 of the expense of abatement shall be the same as those set forth
23 in Section 8.18.060 and Chapter 3.68."

SECTION 2. This ordinance is an urgency measure, which shall
25 take effect and become operative upon its adoption and approval.
26 The facts constituting such urgency are that the City is
27 presently subject to climatic conditions which give rise to fire
28 emergencies, and there are numerous untended, dilapidated

1 properties within the City, estimated to be as many as one
2 thousand parcels of land, where conditions of an urgent nuisance
3 might develop.
