ORDINANCE OF THE CITY OF SAN BERNARDINO REPEALING SECTION
3.52.140 OF THE SAN BERNARDINO MUNICIPAL CODE RELATING TO THE
UNIFORM TRANSIENT OCCUPANCY TAX TO ELIMINATE THE RESTRICTION THAT
ALL TAXES AND PENALTIES PAID SHALL BE EXPENDED ONLY FOR PROMOTING
AND ADVERTISING THE CITY, TOURISM, ESTABLISHING A CONVENTION AND
CULTURAL CENTER AND RELATED PURPOSES, AND DECLARING THE URGENCY
THEREOF.

THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO
ORDAIN AS FOLLOWS:

SECTION 1. Section 3.52.140 of the San Bernardino Municipal
9 Code is repealed.

SECTION 2. Urgency. This ordinance is an urgency measure,
11 which shall take effect and become operative upon its adoption and
]2 approval. The facts constituting such urgency are as follows:
13 the ordinance is necessary to clarify the discretion of the Mayor
]4 and Common Council in a matter relating to general fund taxes,
15 and the allocation of general funds must be determined in the
16 1983-1984 budget by June 3D, 1983.
