5 ORDAIN AS FOLLOWS:

SECTION 1. Section 3.52.030 of the San Bernardino Municipal
7 Code is amended to read:
8 "3.52.030 Tax imposed.
9 For the privilege of occupancy in any hotel, each transient
10 is subject to and shall pay a tax in the amount of ten percent of
11 the rent charged by the operator. The tax constitutes a debt owed
12 by the transient to the City which is extinguished only by payment
13 to the operator or to the City. The transient shall pay the tax
14
to the operator of the hotel at the time the rent is paid.
If the
15 re~t is paid in installments, a proportionate share of the tax
16 shall be paid with each installment. The unpaid tax shall be due
17
upon the transie~t's ceasing to occupy space in the hotel.
If for
18 any reason the tax is not paid to the operator of the hotel, the
19 City Clerk may require that such tax shall be paid directly to the
20 City Clerk."

SEC'rION 2. Urgency. This ordinance is adopted as an urgency
22 measure relating to taxation and shall take effect and become
23 operative on August 1, 1983. The facts constituting such urgency
24 are that an increase in the rate of the Uniform Transient Occu-
25 pancy tax to ten percent is necessary in order to provide suffi-
26 cient revenue to balance t~e 1983-1984 fiscal budget of the City
27 of San Bernardino which must be approved on or before July 1,
28 1983, so that adequate revenue can be anticipated

to meet the financial obligations and indebtedness of the City and
its various departments which will be incurred thereafter.
I HEREBY CERTIFY that the foregoing ordinance was duly
adopted by the Mayor and Common Council of the City of San
Bernardino at a
